Because I keep to myself and do my job, I am the source of some really hurtful and childish gossip. The person who insists on perpetuating this gossip is a person in authority. He is a horribly self centered, self absorbed, unhappy person, but no one above him will put a stop to his misuse of authority. I enjoy my job and don't understand why the owner won't discipline this person. Has anyone else been in this situation?
been there done that

I had to quit my job over being harassed by a man I worked with. He had been there longer than I and refused to fire him. It was so terrible, he made me feel so low.

Sounds like you just need to tell him off! Why is he starting gossip? Can't make the workplace any better. Stand up for yourself, if not no one else will.

If you are a woman, and any of the childish behavior is sexual OR simply because you are a woman, you may have a valid hostile environment sexual harassment claim. I can't tell you if you do or if you don't based on your post, but it seems like it might be a possibility.

I would consult with an attorney bringing your employee handbook. Have you followed the proper procedures for reporting unwanted conduct. If the behavior is indeed illegal harassment and you have already followed the proper reporting procedures, an EEOC discrimination claim will likely get the owner's attention.

Yes, I've tried talking to the owners, but he is their "pet" and won't hear anything bad about him. He has something stupid/mean to say about EVERYONE here. I've confronted him about his comments about me, but he just laughs. It's really getting old. We are all in our 40's and 50's, and he wants to act as though we're in high school. And, we don't have an employee handbook, nor any formal guidelines. Even our minimum wage poster in the breakroom is outdated. These people are just a joke and I'd quit in a heartbeat if I could find another comparable position.

If he is a jerk to everyone (men, women, all races, etc.), he might just be a jerk, which is not illegal. If the things he says about you or to you are sexual in nature, you might still have a sexual harassment claim.

If he makes your job that miserable, I would start looking for a new one. If enough employees quit, the owner might start caring about how this guy treats everyone.
