my ex owes 80,000 in back child support we go to court next month he always got payed in cash told everyone he wasn't working I got names and numbers hope he'll pay now it's not fair to the kids they have to do with out what they would like to have even though they get what they need

I was court ordered to pay $250.00 a month support. I had a good paying job so I paid my EX $100.00 a week for around 18 months in cash. I lost my good paying job and could not pay for 3 months, she took me to court and the fact that I paid cash all of those months, I had no proof, I was ordered to pay back support for all of those months plus put in jail. Motto always pay with money order or check, cash payments will bite you in the but.

Thats pretty sad, my ex paid me in checks sometimes directly to me, and I immediately made a copy of the check before i cashed it and sent a copy to the child support office to let them know he had paid. Although I know he wouldn't do the same for me, I'm not out to hurt him, I just think he should help support his children he helped make them.

Child Support laws vary from state to state. There is now an interstate jurisdictional act that allows states to exchange information & collect support payments from those in different states.

Usually the "effective date" is the date of filing -- don't count on going back to the day the other parent left or the day the divorce papers were signed unless there was a legal request made on that date.

As for whether a delinquent parent is jailed - well, that changes from year to year. It used to be they didn't want you in jail, they wanted you to be able to earn & pay. Then, they started locking up the dead-beats for some short amount of time. Then again, I knew a guy who was more than $35,000 in arrears (yes, that was thirty-five *thousand*) for three kids. But since the mom didn't file anything the courts did nothing - no one asked them to.

Garnishing wages is standard in most states. Of course, that assumes the payor is legitimately employed (meaning the employer is doing everything legally).

As for confiscating (can't think of the right word at the moment) any lump sum issuance, there's no dollar limit. Whether it's an insurance settlement, tax refund, stimulus payment, or whatever the feds/staties learn about, it's all subject to seizure (is that the word?) for child/spousal support arrearages.

If you're concerned about not getting [enough] child/spousal support, best bet is to file something at the courthouse. Remember though, that if you're looking for a change in the amount you receive, there has to be a "change in circumstance" directly related to mom's or dad's income or the status of the child (school vs day care, emancipation, etc).

Well in ec the first time your late they want you in court the next friday of that month no matter how far back you are I been put in jail twice for being less than $700 behide.They think cause they have a job that no matter you better make the payment or your in contempt of court so they lock you up.Sum of us live in the real world were keeping a job isn't as easy as sum put on. I've worked contruction 4 ever and have been looking for a job indoors and can't even land a food job right now. so every time i'm late I'm comtempt of court and greg vincent think I should do 30 days.I mean this shit is a joke I always have took care of my kid but every time i miss a payment I have 2 go to court and wait for them to lock me up they based my child support at 12.00 an hour and I haven't made that in three years, tryed to get it lowed thier no way find a better job. They can give a f*ck less about the kids parents.

That they are way overworked, and apparently really don't care if they help you sometimes, they just put in their time like the rest of us, but sometimes that is all they are able to do without the courts on their side or ours.

My ex owes almost 8,000 and there has been a warrant on him for 10 months but lucky for him he creeps by the system. The deputy sherrifs and city cops don't give a damn. Other wise they would arrest his ass. He rides around town all the time and everyone knows there is a warrant on him. The sherrif had the balls to tell me to call him if I seen him. So I did and it took them over an hour to get where he was and by them he was gone. Everytime they go to his house his wife says he is not there. The justice system sucks when it comes to dead beat dads. If I had time I would just set and watch him but some of us have a life and although the cops are paid to do that they choose not to. ( this is not in warren county, it is butler county that I am talking about.)

If a parent wants to pay they will pay if not theres no sense in destroying yourself trying to get blood out of a turnip root. Mine is only supposed to pay $139 a MONTH and can't even come up with that lousy amount. But I won't push it because if I do he might come back into my child's life. My child does not know his sperm donor and has not seen him since he was 8 months old. He only knows of my husband as his father. I mean what child doesn't need that joke of $139 a month? But is it worth your sanity or jeopardizing the emotional and mental well being of your child?? Not to me...but it all depends on the situation.

The problem with the current child support system is that there is no penalty for NOT paying. Nothing will be said or done if the residential parent does not push the matter. Jail and/or prison is there, as with any crime, to teach a lesson. Hopefully the lesson only needs reiterated once. Also, custody or visitation has nothing to do with child support. Any judge will grant a resonable visitation, without regard to child support. Sadly many people who work in the current child support enforcement office (at least in Kansas) think that it is ok if the court ordered parent pays anything...however, if someone was ordered to do something specific (spend 30 days in jail, make restitution, stand on the corner with a sign) by a judge, and they chose to do only part of it, they would be thrown in jail. This is not so with child support. It is let go and ignored.

Child Support is itself a foolish law. Maybe if men and women were not made to feel like they had to pay it like taxes they would do it on their own. It is their kid right? You tell me where there is equality in a system that will tell a father he has to pay child support to woman he got pregnant and maybe didn,t want the kid but if a woman wants a abortion and the woman does he can,t stop it. Tell me where its right for a woman to leave another man for someone else then expect him to pay her money the for her adultry or vice versa. The whole system is flawed.

It takes two to tango, Want the kid or not the parent is liable for the child and should be... The child is innocent and should be afforded the best both parents can provide. Your logic is flawed here.. If they are not paying court enforce child support, What makes you think they would pay it without fear of reprisal.

Ok so i am a father of two great kids who i am required to pay child support for and i have never been locked up ever and i am behind tht doesnt make me a bad dad cause i am trying to pay but work isnt available so i think anyone tht wants to bad mouth a dad should know the entire story first cause both of my kids are in horible homes because the mother is more "FIT" than i the court is bogus my sons mom cheated on me with several different men i had no clue he was mine until months after he was born so thts why im so far behind and my beautiful daughter is living with a drug attic mom who just so hapens to be pregnant by my cousin wow what a life for a two yhear old mso cut us some slack the mother isnt always the best choice and as long as ur childs father is in the kids life thts all tht should matter im tired of all these shitty moms using there kids for paychecks

My son is handicapped. Not only does his sperm donor not help out he doesnt even come to visit. While there are people that dont pay child support if i had a sick child i would be wondering how he was doing to me that is worse than not helping financially. But he is the one missing out my son is such a blessing. i think if someone is a deadbeat parent that they should be sterlized so they cant go out and make more babies to not support. Mandatory.

See your situation is different, You should be trying to get your support reduced until you get your income back up to snuff... I was referring to the parents (and women do it to) that have the means but refuse to pay as they should.. You would be surprised at the number of people who choose to buy a couple of cases of beer a week and not pay the support.
