Family Court - protection from abusive parents

Almost 58,000 children a year are ordered to have unsupervised contact with an abusive parent in the United States....Family courts have embraced discredited psychiatric theories such as parental alienation syndrome, where one parent is blamed for a child’s strong negative feelings about the other parent to the point that abuse claims are not taken seriously, the study observed. DeAnn Salcido, a former family court judge in California, told SF Weekly in 2011,“I was basically told to be suspect of anyone claiming abuse. I had senior judges telling me,‘Be suspect. The dad probably has a new girlfriend, and the mom’s upset.’”....Salcido said that privately among court officials, the concept of parental alienation arose “all the time.”...In her speech at the mothers’ conference, Rosenthal offered a broader explanation for why family courts often dismiss a woman’s claim that she or her child is being abused.“The root of this is a view that women lie,” Rosenthal said.“It’s a deeply entrenched view in our culture that there is something about women that makes us not truthful, manipulative and scheming to get a leg up.”....a quote from an equal rights activist in the 1970s.“We are in for a very long haul. I am asking for everything you have to give. You will lose your youth, your sleep, your patience, your sense of humor and, occasionally, the understanding and support of the people you love very much. In return I have nothing to offer but your pride in being a woman and all the dreams you ever had for daughters and nieces and granddaughters, your future and a certain knowledge that at the end of your days, you will be able to look back and say that once in your life you gave everything you had for justice.”

Victims should know that the fathers rights' movement and Parental Alienation Syndrome (PAS) were created by a ring of judges to stir-up domestic litigation and use that litigation as a extortion/protection scheme against vulnerable women who are worried about the safety of their children. Abusive men are given "protection" in exchange for their cooperation in non-stop profitable litigation activity. Viewing the malicious court conduct by the judge a result of "bias" or "good-old-boy" local cronyism is a serious mistake which will prevent you from learning how to deal with the bad court professional and make them stop exploiting you. http://www.nafcj.net/indexofficialrecognition...
Divorce Corp. is related, but definitely has a Father's Rights spin (false claims about child support and alimony and bias for women that run counter to all studies and facts). The abuse may NOT always be sexual...it may simply be a mother's concern that there is mental, physical, psychological abuse going on or neglect - but the game is to get the "protective" mother (or sometimes a "protective" father) so concerned about the well being of a child that they will allow themselves to be fleeced by the courts (appointing specialists that are not needed, purposely dragging out litigation in order to get more money out of the parent trying to protect the child) http://www.nafcj.net/

The best estimate is that around one million children are affected by divorce each year, and in 72 percent of cases with a formal written agreement, mothers retain sole custody; fathers are awarded sole custody in 9 percent of cases, and joint custody is awarded in 17 percent. About one-third of children of divorced parents have no regular contact with their biological fathers; many non-custodial parents do not pay all the child support they owe, and many others have no formal obligation to pay support. Custodial mothers are 44 percent more likely to live in poverty than custodial fathers, and their earnings and standard of living tend to be significantly lower than those of non-custodial dads.
Most marriage and family experts agree that, whenever feasible, joint legal and physical custody -- which allows children to spend substantial time with both parents and permits both parents to be involved in decision making in their children's day-to-day lives -- is preferable to sole maternal custody with or without visitation, and the number of joint custody awards has increased over the last decade. But there is also a strong consensus among child advocates and researchers who've studied the effects of divorce on children that when court-ordered joint custody intensifies conflict between parents, it's less healthy for children than other custody alternatives. Many domestic violence experts also believe that forced joint custody in cases with a high degree of parental discord puts mothers at risk for physical abuse and emotional blackmail. Furthermore, a government-commissioned meta-analysis of recent studies on child custody, paternal involvement and children's well-being in the U.S. found existing research does not conclusively demonstrate that children in shared legal and physical custody are more well-adjusted or have better outcomes than those in other custody arrangements
(although several studies suggest that children living with a biological parent and step-parent often fare worse than those living in single parent households).
