Looking out for Mom

This question is related, but in a different direction of sorts. Do oil checks count as income for an individual who is in the nursing home and being supported by Medicaid?

Mom gets one check a year for appx.$50 or less from one company. From another company, Mom was getting appx.$35 a month for 10 or 12 months out of the year, and now, that company is paying a lesser amount about every 3 mos.

Mom needs that money no matter how small the check for daily living expenses that Medicaid does not pay, but I can't seem to understand the answers that I get when I call in to ask if that money is part of her income or not.

I think that I was even told that those mineral rights could be deeded over to me and spent on Mom, but I didn't understand it because I thought that it was illegal to dispose of Mom's property within 5 years of getting on Medicaid. In other words, if Mom was going to deed over her mineral rights, she would have had to do it 5 years before needing Medicaid and the nursing home.

If you know anything about mineral rights in regard to Medicaid, I would appreciate a response.

There are a few horizontal wells being drilled inside a 1/2mile from my house ! We have our mineral rights , so how or who do we contact to see if they went under our property? And if we would be getting something or nothing very curious???!!!? Bryan Tx

Not sure who to contact in your case but just because they drilled through your lease does mean they are producing from you. If they didn't perforate the casing inside your lease lines you won't be getting anything out of it. They might have just passed through to get to the lease on the other side. But is a legit question.

They can't cross through your land, or under your land without contacting you and making a deal. Those "landmen" as you call them are very professional unless you become beligerant and arrogant. They want to work with you, they want to make everyone happy, but they also have to get to that well and they will.

We just bought 5 acres in texas and we own the minerals. We were curiouse can they drill on 5 acres or do we have to have more than 5. Do they come and tell you they want to drill or can we ask them if they can check for oil.

What really burns me is that for all the drilling that is going on in the U,S right now Gas and Diesel are still $3-$4 a gallon.
Stop sending all the crude overseas and lower our pump prices.
If the greedy Bastards would do this maybe us land owners would be a little more tolerant.

How close to a residence can they drill? Bought property year ago and I do not own mineral rights. Im not looking at making any money we just have worked very hard to improve this land, for drilling to happen so close to my family. Will it affect my water well? If strangers start coming onto my property will they respect my livestock and keep fences, gates closed? "Land man" offers very little information and have been accessing my property. I am the land owner how do I find out who is mineral rights owner? Just concerned and confused.

it should show if you own the mineral rights on the deed to your land. It does on ours.
