The North Carolina Supreme Court ordered a new trial for one of the men convicted of killing a former Appalachian State student, according to the Associated Press.

I wonder if Charlie Byrd will be the prosecutor, or if someone else in that office is going to get a shot?? A new trial was ordered because the judge in the first trial screwed something up. These continual screw ups just cost all us taxpayers money and more money.

The Judge should have allowed a statement from a witness that named the prosecution's witness as the killer instead of Neil Sargeant. Because of this, the N.C. Supreme Court granted an appeal for a new trial.

NEIL SARGENT IS GUILTY- i know kyle did wrong and he is paying the consequenses but anyone who knows kyle knows just as well as i do that he would not have done that all by himself. i would about bet he was probably doin what he was told he had to do to not be in the trunk with that harrison boy, granted he should have never been mixed up with neil in the first place but we all make bad decisions. and if you know kyle you know he was easily influenced and just wanted to be accepted. and if you knew neil then you know how persuasive he could be and didnt give a damn to take advantage of someone like kyle who just wanted to be liked. neil will get his, this is a situation where we have to believe justice will be served. as for four eggers- yeah he would be a great DA he is kind, fair, and genuine. just like his brother braxton. charlie byrd needs to fly south for the winter and stay there.

I know the law is the law and sometimes it seems extremely ubfair and sometimes, it's wrong! I totally agree with ganga_baby, I do know Kyle, my nephew went to school with him, and in my heart, I'm sure he was pushed and talked into doing this. As for the D.A.'s Office, those I work with have tried to talk some in running against Jerry Wilson, but they say it's useless because of the hold they have on the position. And the Eggers's..........and excellent choice, but they may be dedicated to defending instead of prosecution. I see them in court all the time and they are terrific attorney's.

the reason for new trial is my brother didnt get to tell he side not sure if he will tell his side this time but i know deep down in my heart that neil sargent is only guitly of asserory after the fact and klye is not just a loveable guy he is thew monster of this if u remeber right he told the news he burn the body and they found ciaggarttes around the car my brother doesnt smoke so it wasnt him by the car kyle set the body on fire he say it his story has change like i change my underwear so how yall trust him any and people do change and new trial beacause his lawyers wasnt ready for trial they though he was going to take the deal and snitch on the others but us Sargents boys arent snitch the lawyers told us they wasnt ready for this type of trial

I hear you Eric Sargent. Sometimes people forget this is a lame azz cheap social networking forum on the interwebz. They seem to think that if you don't speak , or write as if you were raised by Socrates that nothing you say has any validity. I on the other hand, hear your plea. Im assuming the courts did also or this would not be an issue. Basically, People talk, and most have nothing to say. I know your brother was probably in to some things he shouldnt of been but, If he did not kill this person then he is not guilty of murder. Give him his day in court as the constitution has given him the right to have and we'll go from there.

As has been already mentioned, there was one too many discrepancies about the case - anyone with half a brain cell floating about can see that. Quite frankly disgusting that it was "done and dusted" so quickly in the first place.
As for Kyle "paying the consequences" - he should be damn thankful that he actually has a release date, and the fact that he was good enough to pass the buck to a friend. Still, he'll get his aswell.

Eric - thoughts will be with you, the family and Neil next week, here's hoping justice will be shown eventually.

I'm just thankful that the death penalty was taken off the table, as this could have been devestating.

Eric - Not everybody in this town thinks Kyle is an angel and Neil is guilty. The problem is that Kyle is a local boy and Neil is not, so naturally Neil had to take the fall. I am personally glad that Neil has gotten a new trail and I hope it goes well for him.

I know there is some truth to Eric's statement because I was in jail with Neil and when the other guys were smoking he was mainly acting as a lookout. As for jailhouse confessions,he admitted guilt to more than 1 person. Also,he was trying to prepare an escape route just in case of being convicted. His routine was going to the law library once a week at the local courthouse. Anyone & everyone has access to it so people used to leave tobacco in books for him so who's to say this time they don't leave a gun in 1. Yes they leave a deputy in there but how much attention do they actually pay. Esp. since they're not expecting anything. WAKE UP Watauga County b4 you get someone killed. I contacted the Watauga democrat anon. hoping they would run a story or contact someone but they did neither!!!!

We need a new Sheriff's Office period. The next murder investigation Watauga County faces will be an outright fiasco. Mark my words. It's not the deputies' fault either. It's some of those in leadership. The S.O. is lacking in this area. When an investigation is blown, the "lead" investigator will find a investigator or another deputy to blame and attempt to end their career. Watch out for the Investigations Captain. TROUBLE.

The Democrat sucks. They push whatever the Sheriff's office or police departments give them. They don't investigate anything for themselves. Heaven forbid that they step on someones toes.
