A federal judge ordered on Feb. 9 that a hate crimes count could be added to a lawsuit filed by an HIV-positive man, who alleged he was the victim of brutality by south suburban Blue Island police.

Demetrius Anderson, 25, is suing the City of Blue Island and two officers of the Blue Island Police Department. Anderson claimed he was physically and verbally assaulted when police responded to his attempted suicide in April of 2009.

Judge Charles P. Kocoras ruled that attorneys representing Anderson could file an amended complaint with the addition of a hate crimes count to the lawsuit filed in the United States District Court’s Northern District of Illinois.

Kocoras’ decision makes the complaint the first time in history that the Illinois hate crimes law has been used in a federal civil rights suit, according to Jon Erickson, an attorney at Erickson & Oppenheimer, P.C. and the Civil Rights Center P.C., the firm handling the case.

The Illinois hate crimes law allows for monetary restitution or a fine of up to $1,000 if the defendants are found liable of the alleged damages.

In the lawsuit, Anderson is seeking monetary damages, including “medical expenses, lost wages, and legal costs,” according to the complaint.

Laura Bautista, the lead attorney in the case, said that they don’t have an exact amount they are seeking in damages and that there’s “a question of what’s related to the suicide attempt and what [the defendants] did that exacerbated it,” she said.

Anderson, who is HIV-positive and had been suffering from clinical depression, stabbed himself in the chest on the morning of April 20, 2009. After EMTs responded to his sister’s 911 call, Anderson was led to an ambulance and panicked as they approached, saying that he did not want to go to the hospital without a family member present, according to the complaint.

In his panic, Anderson fled from the EMTs and was shot in back with a taser gun by a Blue Island police officer identified as Officer Benton. Anderson fell to the ground, where he alleged that while he was handcuffed, other officers stepped on his hands, feet, back and neck, causing him pain and bruising, according to the complaint.

After taken to the ambulance, an officer identified in the complaint as Officer Podbielniak, joined Anderson and verbally assaulted him, calling him an “animal,” among other insults. Anderson was treated and released from the hospital on April 25, and upon his release, was taken to the Blue Island police station for booking. There, Officer Podbielniak confronted him, according to the complaint.

Podbielniak then said the he wished “Anderson had picked up a rock so that he could have had an excuse to shoot him. He also said that, because of Mr. Anderson’s HIV status, he would have nightmares for the rest of his life and that next time he tries killing himself he should jump off of the 127th Street Bridge,” according to the complaint.

On Feb. 12, Anderson released a statement saying,“They were called to help, but I didn’t need help like that. He stepped on me like I was an insect on the ground.”

“A hate crime masquerading as police work is no less a hate crime,” said Erickson in a message.“And what makes hate crimes particularly egregious is that they’re designed to send a message of fear, hate and intimidation to a whole community.”

Blue Island Police officials did not respond to calls for comment.

Frank couldn't find his fat ass with two hands and he has the nerve to berate people. Blue Island Police should require their officers to pass a physical agility test annually. That way we can get rid of the lazy ones.

Not one of the officers can stand him. How can he be expected to be a leader when nobody wants to work with or for him. He's only gotten as far as he has through politics. If that's the future, hold on tight because the police department will not be what's needed by the community and if they police like he does the lawsuits will continue and increase.

Frank talks to everyone even his wife like dirt. The cable ppl hate him! I hate him! I hate cops that think they can beat and talk shit just because they wear a badge. The badge says to protect and serve... the ppl! They've taken those two words and turned it around to protecting them while serving up uncalled ass whoopins! Ive seen videos of officers who are suppose to be trained to take ppl down beat a man to the ground and continue to beat him! One officer beat him wit their stick until her broke the mans leg. Other ran in and while the man is lying on the floor u hear them say tazzer him tazzer him. WHAT FOR when the man is on the floor not moving??? I watched over 15 cops run through this video and attack ONE MAN! I tell my kids dont trust them! In Kankakee there is a 1.5 million dollar lawsuit going on an officer who walked in to the JR.High School and tazzed 9 boyz and 1 girl and none of which where white. One boy who has heart problems. They suspend the officer WITH PAY!!! We cant win for nothing bad government and horrible police!!!

Ive seen him train and he talks to the training officers like garbage and yells at them and insults them. He needs to jump on a tredmill!!! If no1 likes him and wants to work wit him then why isnt anyone saying anything? Thats the main problem. Frank walks around and does what he does cuz no1 is stoping him. He pays ppl off and others just turn heads. In order to fix the problem you need to speak up and kick his fat ass out the door!

everyone knows but no one cares. they couldnt get anyone to work for him they asked everyone and they all said no. so he has a couple of new guys that were afraid to say no.

Contreras Cornell and Podbielniak did more harm to the Police Department in the last year than can be imagined. Thier internal policitcs and schememing really created factions within the department All three are back stabbers

Both of them should worry about their own jobs....especially Jim. Word has it Bob Adams wants Jim Rial out so bad he's on his knees to Vargas to clip Rial.
