I Rochester when a baby dies of natural or medical cases, the RPD publicly point blame at the parents.

In Yates, a person can kill a baby and it's not in the news till she's arrested months later.??

I understand a what a Grand Jury indictment is. That doesn't mean they can't release the cause of death. They release details from grand jury indictments all the time; they will sometimes keep it sealed, but usually release the details after the GJ has made their indictment. Why not in this case? The Grand Jury only determines if there's enough evidence to proceed to a trial, but the defense does not state it's case at all; the entire proceeding only cites the prosecutions' evidence, and there's no reason to keep it sealed and out of the public after they have handed down their indictment, UNLESS they are trying to hide something (like a REALLY weak case).

With this said, I ask WHY CAN'T THEY RELEASE A CAUSE OF DEATH? What are they hiding? Overzealous prosecution trying to make a name for themselves from a weak case? It sure looks that way.

FYI: The Grand Jury simply hands down the indictment to proceed to a trial. The indictment is sometimes sealed, but is usually unsealed once the defendant is arrested or notified of the indictment by police. Here's some info:

A prosecutor must convince the grand jury, an impartial panel of ordinary citizens, that there exists reasonable suspicion, probable cause, or a prima facie case that a crime has been committed"

I've been doing some research, and, so far, can't find a case where someone was charged with Murder or Manslaughter but the cause of death was not released to the public. If anyone else can find one, please post it! With that, can anyone explain why they haven't released the cause of death in this case? I think when charging a mother of 3 with the death of an infant, that's kind of important, don't you? I guess the DA in Yates county doesn't believe in the public's right to know. THAT'S WHY I'M CALLING THEM OUT ON THIS. WHERE'S THE Medical Examiner's report? Why will they NOT tell the public the cause of death? What are they hiding? Why all the secrecy?

Mr Skeptical...I agree 100% release the cause of death. Stop trying to hide it and let the public know what really happened. How is Shari to get a fair trial when all people are doing is speculating.

Thank-you. That's all I'm asking for, and I'm hoping some public scrutiny to the DA's office might help. I also think News Team 10 should be asking the same question......WHY ISN'T THE DA's OFFICE RELEASING THE CAUSE OF DEATH?

As far as I can tell, their handling of this case so far is rather un-common. I want to know WHY.

What an accusation again such a wonderful, loving, caring person and not just because she is my cousin. Shari would never harm a fly much less a child. She has always loved children and now has three of her own. This whole thing is ridiculous! The fact that they are not saying the cause of death has me a little concerned. What are they hiding or is it really that they do not know anything. The truth will come out!!

Mr. Skeptical, you couldn't be more misinformed. First of all, you're barking up the wrong tree. Susan Lindenmuth is retiring from the DA's office at the end of her current term. You can yell all you want, but she'll be gone by the end of the year regardless. If you read ANY of the press reports, the ADA Jason Cook is in charge of this case. Second, the grand jury indictment is in the possession of both counsels at this point. It is not at all uncommon for both lawyers to withhold potentially damning evidence to avoid tainting the potential jury pool. If you're looking for a cause of death, perhaps you should give the defense attorney a call. His name is Thomas Splain of Rochester.

Please try to be more informed.

Sandy, We couldn't agree with you more! We've known Shari's entire family for years and our kids all went to school together. Although this is a tragic incident for the family that lost their child, we can't believe that Shari acted in a irresponsible manner whatsoever. We think that the Yate's DA has a pretty weak case and that the truth will come out and all concerned can get back to their normal lives, if that's possible after going through this whole ordeal. Although we're in Arizona, we're watching very closely.

Well unfortunately for you, the Yates County DA is not seeking re-election, so go ahead and call for her resignation. The cause of death is nobody's business but for those involved.

Once again, you should get your facts straight before you go running your mouth. Mr. Jason Cook, 1st Assistant DA is in charge of this case. Mrs. Lindermuth is NOT seeking re-election and will be gone at the end of the year.

The new District Attorney is Jason Cook. The investigator that took the statements is very dirty. He's known for submitting unsigned statements to the Grand Jury. A Notice of Claim was recently filed naming Investigator Mike Christensen. In the Notice of Claim Investigator Christensen is accused of striking a 20 year old male twice for refusing to sign a statement filled with lies.

Well, Shari was found not guilty - and justly so. If you read the Penn Yan paper, you will see that she was in no way the cause of that little boys' death and should never have been arrested in the first place! How can they have done this to her and her family?? Doesn't it scare anyone else that you could be arrested for something that you had no part in and it could take almost a year to clear your name?? You are pulled from your babies and husband and made to defend yourself for something you did not do! Absolutely frightening.
