Just want to make anyone on probation aware ofthe fact that Monroe Co probation officers are overstepping their authority. They do not have judicial authority, and cannot add anything to what the judge actually sentenced you to. This has been decided in so many court cases it is considered plain error. See US v James Kincaid Heath, and US v Nakayun Holsey (Holsey is very similar to events in Btown). I believe there may be people who have been charged with probation violations for not completing counseling- when it was not ordered by the Court, but ordered by probation officers. Probation officers do not have authority to orderanything, even if they mistakenly think they do. I am making people aware of this because it is very probable that probationers may have been wrongfully incarcerated due to the mistaken belief that probation officers have the authority to order counseling. Delegation of authority to a po would violate article 3 of the constitution. Even listing this as a condition on a standard probation form does not mean the Court has ordered this. Please look at what the Judge actually ordered at sentencing, nothing else can be added to it but the judge. Please make anyone you know that is on probation aware of this. Hopefully noone else will be wrongfully charged with a violation for not completing something that was not ordered by the Court. If anyone has been violated in the past for something that was not mentioned as part of their sentence but later at probation, please contact your attorney because you may have been wrongfully incarcerated.

I looked this up and you are right. I wonder how many people know this. Probation officers are notjudges,they cannot ADD anything to a sentence,no matter what they say. Unless the judge ordered a person to counseling,a person does not have to do this...even if it is listed under conditions of probation. I bet many people have been wrongfully incarcerated becauze a probation officer ordered them to go to counseling and they did not complete it and were violated....only a judges order (not a prob. Officer) can order anything. A few monroe co pro. Officers think they are as powerful as a judge,when they are glorified gophers......

Don't worry. They want to keep you forever after giving you a bunch of fake charges. No wonder over 2 million people are in prison and many more. The system is a money making scam.

Probation has you by the balls when you sign on the line. If you read through the paper work when you sign the papers. It basically says you'll do whatever they tell you to do and obey and confirm to all laws and rules of probation. If your probation officer says you need to complete a course in cooking you better damn well complete that course because you already said you would do whatever they told you to do.

The only thing a po can enforce is what a judge orders..look up james kincaid heath vs state....there are many other cases that prove this......monroe county counts on people not knowing this....and the court in bloomington violates this. It is about to be brought to the medias attention. Po that violate law should be held accountable

Ohhh yaaa druggies there could even be Hotel owners that own Apartments who have thier maintance workers at the Apartments keep track of druggies cars and plates that show up at the Apartment Complex and search the workers for the Apartment Complex search "inspect" the renters apartments when they know the renter(s) are not there, and the maintance worker could try getting numbers from the caller ID on the telephone, numbrrs lying around they might eben take a cellphone for a day or two, they could try taking when you sleep...THAT'S WHY, THEY DON'T PEOPLE HAVING METH.

Next time you try to get a script of painkillers, wear a shirt that says Ohio or Kentucky then let us know on topix if you were able to get a script and if it was easier.
