Yes, I was also Bono4President. THANK YOU for this post, THANK YOU for considering my point and considering what i'm saying and why I am saying it. You're right, a lot of people are attracted to it for a lot of different reasons, and maybe just for the sensationalism. Please don't ever think I was saying John deserved it, by no means did he deserve it. I was simply saying no one knows what happened that night except two people. For one moment and for the sake of argument let's "pretend" this was not pre-meditated and Michele actually knew nothing until after the incident. For all anyone knows Foley may not have even told her exactly what happened. In reality there MAY be only two people that know, and John can't tell his story. I can't imagine what it has been like for John's close family and friends. I have never pretended to fall into those categories. I had the distinct pleasure of knowing John and sharing in his joy of adopting JJ. I believe my last post summed up why I post and why I battle and defend certain points. I'm glad we can understand each other and that we have common ground in wanting Justice for John. Whats Relevant wrote: My most recent post was to BONO4President, but since you replied I'm guessing you're one in the same. Anyway, I get your point and I have considered what you're saying. I get that you want justice for John and I'm in complete agreement. However, when people say John asked for it because he wasn't "an angel" or that he possibly threw the first punch thus causing his own death, it pisses me off. John was the victim. I don't care if he was an ass to some people, he didn't deserve to die for it. If we could murder everyone who acted like an ass or pissed us off, the world would be a lot less inhabited. I agree there are tons of misconceptions and rumors with this case. Most of these postings are based on rumor or people thinking they know a lot more about the law and this case then they actually do. Let's face it, people are drawn to this case for a variety of reasons. I think a lot of people are just fascinated with the sensationalism of it. That's fine, but when you got the call that your friend was dead hours after they discovered his body it is tough to deal with some of the comments that dare to suggest this whole thing occurred do to the victim's supposed behavior. I could care less what most people's opinions of this case are. None are going to change the outcome that has yet to be decided and I'm sticking to my own opinions anyway. However, I want people to stop saying John may have asked for it. The whole truth will never come out. However, to suggest that this wasn't a purposeful murder just is not being realistic. The killer knew what could happen. No one knows you better than you know yourself. The killer knew himself. He knew that his hatred could possibly make him lose control yet he chose to show up at that house late at night with a knife. The killer (who I believe is Foley) put this whole thing in motion. I wish everyone would just quit suggesting that John somehow started this. I get that you wish everyone would tone down the hate talk and quit spreading every conceivable rumor about this case on this site. That won't happen, so no use getting so uptight about it. Just weed out the ridiculous posts and move on. Hopefully, the people involved in the actual trial will be intelligent enough to avoid the rumors. I thank you for you wanting justice for John that is all I really care about. <quoted text>

Foley submitted his denial to the civil suit. Good to see he is still sticking to Michele's script.

I don't think they had time to ask his age. When the gun shot off the one Trooper fell and the other Trooper thought this felon just shot his partner. I still don't think at that time he had a chance to ask this fleeing felons age. Here's a question for you - Why didn't his parents know where he was at? So I'm guessing they won the lawful death suite because the jury felt bad for the parents of 12 year old, not the state with deep pockets. You know what, I'll be back to this forum after the trial and civil suit to tell you I told you so and to stick it up your a$$! It's no wonder all the people with common sense quit posting on here because it really is scary living in a world where there are so many people like you out there. Are you actually trying to justify a cop shooting a 12yo in the back? Anyone who believes the "my gun went off accidentally" is really reaching. They got raged out and shot the kid cause he was going to get away. Make them look like fools back at the house. Stealing a car and running away is not cause for a bullet in the back from a trained law enforcement officer. That's the type of behavior you expect from a thug gangbanger. The kid's family won the wrongful death civil suit, BIG TIME. If the kid had been at boy scouts he wouldn't be dead. Just the same, he'd still be alive the cops didn't shoot him in the back. He was unarmed, simply trying to get away. Didn't have a chance to "ask the kid's age?" Moot point, there is no good reason to shoot anyone in the back, ever.

I guess a 12 year old can't be a thug gangbanger? I'm not saying the child deserved to die, but come now, he stole a car, that's an automatic felony, i'm sure he had never committed a crime prior to that? I bet you were there and know all the details too? idiot alert wrote: <quoted text> Are you actually trying to justify a cop shooting a 12yo in the back? God wrote: <quoted text>Ask Mary Ann Clark, she seems to think she knows. I wouldn't want to go against the word of God, but Mary Ann is just a name on a paper representing the estate of John Yelenic. If the civil suit goes to trial and the estate wins, she will receive no monetary benefit. She makes the decisions regarding the estate, so if she wanted to spend the money available now, she could do it. She is guilty of nothing but caring for John and his son. Focus on the real guilty parties.

OK...so she makes all of the decisions for the estate...correct? She chose who to sue then...correct?(she chose Tpr Bono) I understand this is about justice and not money. But when she publicly accused Tpr Bono of helping Foley, when she has no proof, she was out of line. Yes, let us focus on the guilty parties. And thank you for not going against my word!:-)

How do you know she has no proof? None of us are sure what the evidence is. That is why she gets a day in court to show what evidence and witnesses she has, right? You think she has some sort of vandetta against Bono and pulled his name out of her a$$? That makes no sense.

Good Point

That is a good point and something to think about. That would be extremely stupid for her to pull someones name out of a hat and accuse them. I would have to think that the attorney of the estate would have more brains than that. Jesus Twins wrote: How do you know she has no proof? None of us are sure what the evidence is. Jesus Twins wrote: How is Bono attached to Foley? Were they partners? The PSP do not have partners, unless they are on mid night shift and even then they are usually not the same partners. Tpr Bono coached Foley when he first started. They were colleages/friends (not good enough to know that he adopted a child, nor did he know Michelle) Tpr Bono was a fellow officer that would have died for Foley, but not kill (or help) for him. I find it interesting that Mary Ann Clark has evidence and witnesses against him that police/AG's office do not.

Is it possible that the same evidence and witnesses presented in different courts could have different outcomes? Especially when one is criminal and the other is civil? Interesting.

Currently, the lead investigator in this "ongoing case" is from the PSP. I'm still shocked that Foley was arrested. I guess when DNA proof comes back you actually have to do something.
