What Did the Grand Jury do with Union County Commissioners Lamar Paris Financial Reports?

O.C.G.A. 36-1-7 (2010)
36-1-7. Submission to grand jury of sworn returns of receipts and disbursements; approval or disapproval; appearance to explain errors; failure to make return

(a) The judges of the probate courts, county treasurers, clerks of the superior courts, and sheriffs of the various COUNTIES SHALL MAKE A RETURN, UNDER OATH, to the grand juries of their respective counties ON THE FIRST DAY OF EACH TERM of the superior court. The RETURN SHALL SET FORTH A JUST AND TRUE STATEMENTOF THE AMOUNT OF MONEY BELONGING TO THE COUNTY WHICH WAS RECEIVED BY THEM AND THE SOURCE FROM WHICH THE MONEY WAS RECEIVED, ALONG WITH THEIR EXPENDITURES. ACCOMPANIED BY A COPY OF THE MOST RECENT FINANCIAL STATEMENT OR ANNUAL AUDIT OF THE FINANCIAL AFFAIRS OF THE COUNTY OFFICE SUBJECT TO THIS CODE SECTION.

(b) When the returns provided for in subsection (a) of this Code section have been made, the grand jury shall examine the same. IF THE RETURNS ARE FOUND TO BE CORRECT, THE GRAND JURY SHALL ENDORSE ITS APPROVAL THEREON AND ATTACH THE SAME TO ITS GENERAL PRESENTMENTS, TO BE FILED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT. If the returns are found to be incorrect, the grand jury, through its foreman, shall return them to the officer making the same, shall plainly and distinctly set forth in writing the grounds of its disapproval, and shall require the officer to appear before the jury and explain the errors.

(c) Should any officer fail or refuse to make the return required by subsection (a) of this Code section, the foreman of the grand jury shall immediately notify the presiding judge of such failure. The judge shall issue an order requiring the delinquent officer to come forward and make the return required or, in default thereof, to be attached for contempt.

The ACOG reported a few days ago that in a Open Records Request we ask Lamar for a copy of this report.

Lamar gave the ACOG a copy of the County Proposed Budget for 2012 that was used in the Public Hearing December 6, 2011.

We knew this was not a Just and True Statement for the County Finances. There was no Just and True sources from which the county receives the money or for the expenditures. All we received was a PROPOSED BUDGET.

The ACOG went to the Office of the Clerk for the Superior Court to see what we could find. We found the Grand Jury Reports and we Found the Financial Reports for the Departments BUT NONE FOR LAMARS OFFICE.

The ACOG did some more research back through the years.

We found that in the First Year Couple of Years Lamar’s Office Provided the Grand Jury with great expense reports, Bank Statements with Beginning and Ending Balances even a road maintence report.(Book 6 pg 91-pg 152)

In January 2002 another good report of the Commissioners Office.(Book 6 pg. 398-448)

Book 7 pg 498-562 had the Commissioners Report the Audit was given.

ALL DOWN HILL AFTER This:

Book 8 pg 237 January 2003 Lamar’s report should have been there but was not.

Book 9 page 117 July 2003 Lamar’s report should have been there but was not.

Book 10 Page 433 July 2004 Lamar’s report should have been there but was not.

Book 11 pg 659 July 2005 Lamar has a report attached..

Book 12 pg 441 January 2006 Lamar’s report should have been there but was not.

Book 14 pg 112 Lamar has a report attached.

Book 15 pg 1 July 2007 Lamar’s report should have been there but was not.

Book 15 pg 531 January 2008 Lamar has a report attached.

Book 16 page 365 July 2008 Lamar has a report attached

Book 17 pg 420 July 2009 Lamar has a report attached

Book 18 & 19 Grand Jury did not have Lamar on the list to see his reports

The other Grand Jury Reports are not in a book as of today but can be found with the Clerk. The last 2 times the Grand Jury met there were no documents for Lamar.

The reports that are given by Lamar consist of graphs and Charts. Just how true and accurate are these reports of the County Finances?

Who is Responsible for Overseeing the Grand Jury and making sure all the reports are given to the Office of the Clerk of Superior once they are finished, endorsed its approval and attached the same to its general presentments?

ACOG met with District Attorney Jeff Langley today. We wanted to find out “Why are Lamar’s REPORTS MISSING From The Grand Jury Reports?”

It’s the law, they are to be attached and filed with the Clerk of Court.

I showed Langley the Open Records Request and what Lamar provided me. Langley agreed that the Budget report is not a document that could be used for the Grand Jury. He said that Lamar probably made a mistake and gave me the wrong thing. He asked if I would like him to get a copy of what was given to the Grand Jury from Lamar. I told him “NO” that Lamar already gave us this as being what he gave to the Grand Jury and we did not need Lamar to make up some more BS reports.

Langley said he was in the room when Lamar gave the Grand Jury the Reports but had no idea what happened to them. Langley said this was probably just a mistake on the part of the Grand Jury and he would talk to them in their next session.

Langley agreed the reports should have been attached.

I asked if all the past reports missing from the Commissioners Office was also just a mistake on the Grand Jury‘s part.

What is Lamar hiding that he does not want the Public to know about the County Finances?
Why are these reports missing?
Who is over seeing the Grand Jury to make sure they do their job?
What was the actual document the Grand Jury looked at?
Is this something else that will be tossed under the rug?

Union County if you want Justices , Transparency, Clean and Open Government you better open your eyes and see what is going on behind your backs. Things might look all rosy and Lamar can put on a good act but you need to face the reality. Things are not Rosy, and this is not Mayberry.
Where and how are your tax dollars being spent?

I sure DAMN WELL want to know, and I can tell you this, I won't be voting for Langley if he doesn't get his act together and start getting involved in investigating this issue. Why is he pussyfooting around Lamar?!

What did he say about all the other years of non compliance?! Mistakes my ass. This isnt Lamar's first year in office.

Th first Financial Reports Were Great That was when Lamar might have cared about the taxyers and the county.

After 2 years by the reports Lamar gets comfortable in his office and decides what is important Information to the taxpayers LIKE HOW MUCH MONEY this county has is no longer OUR CONCERN.

Lamar has to swear under oath. I guess he no longer wanted to swear under oath that even the audit was a correct financial document.

So what will Langley's Office do? Probably the samething the DA's Office has been doing in the past. "NOTHING"

Oh, I'm sorry, He did say he will talk to the Grand Jury next January.

Lamar does not have to obey the laws he makes his own laws and we have no one to enforce the laws.

If my memory serves me correct, I think that Judge Barrett was over the grand jury, Now no longer here I don't know. I wonder if enough people called the news media about Lamar's corrupt doings if that wouldn't peak their interest? Is it possible to find out who the names were on the Grand Jury? Who governs Langley?

Your memory is correct. The new Judge is Raymond George.

What is interesting about Book # 10 pg 433 July 2004, The Grand Jury writes their usual statement "A written report of the finances and operations of the Commissioner's Office was given to the Grand Jury by Lamar Paris, Commissioner of Union County pursuant to O.C.G.A. 36-1-7 (a) and found to be correct AND SAID REPORT IS ATTACHED HERETO."

Why would the Grand Jury write that if the report was not attached.

It really does not matter because the law say they are to be attached but with them adding this and the reports are not there it makes you wonder where did the reports disappear to.

The Grand Jury names are listed on every report.

This report from the Grand Jury was printed in the NGN on July 25, 2012 pg 16a

At the end of the reort in says: "We the Grand Jury recommend tat the presentments be published without ATTAHMENTS and SPREAD upon the minutes of the court."

Under that it says; "The within and foregoing presentments received and read in open ourt te same are ordered published as recommended and spread upon the minutes of he court.

Title 36, Chapter 1, Section 6 (36-1-6)
All boards of county commissioners, county commissioners, county managers, or other persons or bodies having charge of receipts and expenditures of county moneys shall publish a financial statementonce each calendar year in the paper in which sheriff's advertisements are published in their respective counties. A copy of this statement shall also be posted twice each year for a period of not less than 30 days on the bulletin boards of the various county courthouses. The statement shall set forth the source of all income and a summary of all expenditures in a plain and simple manner that can be easily understood by all taxpaying citizens. The statement shall also contain a report of all money owed by the county, current bills excepted, of the number of tax delinquents, and the total amount of tax delinquency.

We are waiting to see what Lamar gives in this open request. Did he publish these reports?

There is a time frame for those documents to be presented. Why don't you do you investigative work and find out what that time frame is.
It is easy to second guess what went on, but only facts will do.

It is interesting how easily one can find out information if they go about it the correct way. It is easy to find out ALL the information, not little pieces here and there. ACOG has to butt heads and threaten people to get only a part of the picture. ACOG will never get the whole picture and that makes ACOG look foolish.
Union County realizes this to be the truth.

The ACOG did go about it in the correct way. The ACOG asked for a copy of the report given to the Grand Jury in a open records request to Lamar Paris. Lamar gave us a copy of the BUDGET REPORT.

We might butt heads but where do you come up with the threats?

If we had a honest Commissioner running the Office we would not have to butt heads to get what we are asking for.

All we ask for is CLEAN and OPEN GOVERNMENT.

It simply amazes me that here you lay it all out for them, give them the blow by blow, follow the rules, get the meetings, meet with people of the county and yet they still tell you that you are wrong and you haven't done it right. AND they won't provide WHY you've done it wrong and prove it with their own documentation. I guess they got schooled by Lamar.

Or as UCL reminds us sometimes "it's all too complicated for us."
