Well I hope you never make a mistake and eat your words. I forgot we live in a world that people think money if a mistake is made. The facts are this is still an open investigation no fault has been decided. I pray for the Teague family daily and will continue to, but I will not bash our LE's, nor do I agree with the things they are saying, not just on the internet. I am not whinning about my choice, I sleep well at night because of it, and my actions showed my character, I did not have to defend it. As somebody said it will be an interesting court case, lots of eye witness's that have not even posted on here. I would choose not to drag my families name through the mud, at the end of the day the community is going to back their law enforcement. Don't worry though, if you call 911 they will put their life on the line for, not only chancing their life, but knowing if they make a mistake they can loose everything. Ambulance chancers make the world go around. Yes they have that right, does not mean that we have to support it. They have their freedom to state their thoughts, just like we all do.

It is not a matter of money for the law suit. It is a metter of helping pay for burial expenses and other expenses left behind.

For the ones who want to put down his daught and son for not being around their dad more, you do not know all their life story. You may only know one side, Donald's. His children are good kids and have always loved their dad. Just rough roads along the way.

All families have them, especially when parents are divorced. Please give them so credit and some greiving room. My sister (his ex-wife) even did all she could to help during this tragic time.

As Jolene stated, her heart and prayers go out to the officer as well. He and his family have a lot to deal with as well. I know I would have a horrific time overcoming taling another person's life.

For the one's who say the children should have been here while Donald was alive, stop judging them because they will beat themselves up over and over again for the lost time.

Everything is God's plan and works out to the good. Pray for their peace please.

Then I guess ther are suing for less then 20k since that is about the most this would have cost. I mean if the money does not matter and it is not about the money, it only makes sense. We will se if what you are saying is true by how much they go for.

Is it only ok for you to drag it back to the top. Every time it comes to the top, you post.

No the Troper has not had other accidents, no the Trooper has not been faulted with this one, and from what the Teagues are telling people they are going after a lot more then funeral cost, they are praying the trooper is charged, I pray he is not, so these idiots will leave him alone.

Keep posting information family and friends.
This information has been reviewed by the media.
I'm sure that the defense attorney is also aware of the forum and the information about the incident. When the family started posting, I lost interest. Grieving? If people are grieving that much, they wouldn't be on the freakin' internet. Trailer trash.

I hope the family loses their petty lawsuit and the officer is found not at fault.

That comment was rude and uncalled for. I have no clue who you are but it is evident you have am unsaved spirit.

As far as "family" posting, I was not his family. I was just trying to ask people to understand that nobody knows all the history between Donald and his children unless you were there the whole time they grew up. Nothing is ever black and white.

I honestly do not know much about the law suit, anount asked or anything. I do know the expense caught them off guard. As I said before, his ex-wife, the children's mother came to Blairsville to help the family out.

I have had my differences with Donald as well as good memories of him. I hated to see him go the way he did. For the record as well. I am really so sorry for the trooper as well. I would hate to live with the memory he will always have. Not to mention having to relive it all over again in court.

Everyone on here has stated strong opinions, likes and dislikes, Let's take time to remember that two families are hurting here.

As for the children posting, my neice only posted one time and it was to thank evryone for their kindness. My nephew only posted because he felt the need to defend his father. He is mourning and he was angry. He felt like venting. We all handle greif in many differnt ways.

But none of us deserve to be called trailer trash. That is way too mean. Please let go of the mean remarks.

State settles fatal trooper wreck
Georgia Supreme Court decision a factor

By Stephen Gurr sgurr@gainesvilletimes.com

POSTED: November 25, 2009 11:30 p.m.

The state of Georgia has reached an out-of-court settlement with the family of a motorcyclist killed in a 2008 collision with a state patrol car in Lumpkin County.

The settlement in the death of 57-year-old Donald Teague signals a change from the protection Georgia’s law enforcement officers have traditionally had from liability claims through sovereign immunity laws, the family’s attorney said.

Russ Willard, a spokesman for attorney general Thurbert Baker, this week confirmed that the case was settled during mediation between Teague’s family and Georgia’s Office of Administrative Affairs.

W. Newton Moore, the attorney for Jolene, Meagan and David Teague, said this week that while the exact financial terms were confidential, "we did very well in our settlement."

On Oct. 5, 2008, Trooper John Shannon Carroll was patrolling Ga. 11 in Lumpkin County near the Union County line when he made a U-turn in his patrol car order to pursue a speeding motorcyclist. Carroll turned his car into the path of Teague’s Harley-Davidson Low-Rider, which collided with the cruiser’s passenger-side door. Teague died at the scene.

In May, a Lumpkin County grand jury declined to indict the trooper on a misdemeanor charge of second-degree homicide by vehicle.

Teague’s family gave the Department of Public Safety notice they might file a wrongful death suit, but the case was settled without a lawsuit. Moore, the family’s attorney, pointed to a Georgia Supreme Court ruling in March as one reason he was able to reach a settlement with the state in Teague’s death.

This year, the state’s high court found that certain negligent law enforcement actions are no longer absolutely protected by sovereign immunity.

In a 5-2 decision, the court found that while the state is immune from liability for incidents that occur during the implementation of a policy, such as a police pursuit, it is not immune if an employee implements policy in a negligent manner.

Justice George Carley wrote in Department of Public Safety v. Davis, "It is undisputed that the Department of Public Safety has a policy of detecting and apprehending individuals who exceed the speed limit by use of radar and motor vehicles. Such a policy decision is not subject to an attack of negligence under [the Tort Claims] Act. This policy, however, obviously does not include directing the officer to strike any vehicle in his path in apprehending a speeder."

The high court’s decision was unrelated to Teague’s death but was applicable in the case and likely led to the relatively quick settlement, Moore said.

The Georgia Department of Public Safety, through a spokesman, had no comment.

I believe,if this is true it was Johnny Carrols son, this is not the first time he made an illegal u-turn and killed someone. The other incident happened on 515 a few years ago.

First of all lets get some things straight about Joleen and David Teague. They are both a bunch of lying pieces of shit and a couple of cons. For 3 years before Donald's accident, when he first found out about his cancer, he desperately tried to call and talk to Joleen on numerous occasions and she would not talk to him, cussed him and refused to let him talk to his granddaughter. Then she comes to Donald's funeral and her brother David, putting on a big show like she cared so much but in truth it was just the opposite. The fucking bitch and her brother didn't even care enough about their father to put a headstone on his grave. And as for the young lady that shot herself at the trailer park, yes there was a hole lot more to the story because I was there too. I just now found myself to read some of these posts about Donald Teague for his death had a horrendous impact on me. And as far as David and Joleen goes they are a piece of shit.

Wow.. it was pretty difficult to read most of this forum. I actually had to skip past most of it because of the brutal grammar inaccuracies, the ridicule and the selfish banter. I hope to make things clear.. I loved my father very much. Any accusations otherwise are false. It is as simple as that. The GSP was the one turning around to chase these "crotch rockets". My father was not chasing anything. The blood alcohol content was incorrect because the testing was done incorrectly. That was proven in the investigation. My father did have cancer and his prescription medication is what showed up on the toxicity testing/report. I let my daughter spend as much time possible with my father. It was difficult because we lived in Colorado and as you all know my father was a Blairsville resident. We did not "make ou"t in the case. The attorney certainly did. And any amount of money, which is a slap in the face, would be gladly given back to replace my father. I am deeply saddened by how easy it is for anyone to come to a website and trash anyone's name after a life is lost. And very happy that I didn't see this when I was grieving, which I will never stop, however I have now come to terms with learning to celebrate the life of Donald Teague and all he did to contribute. He was NEVER a terrible father. The sun and moon revolved around his children. And thank God I have those memories. PS.. He has a beautiful headstone.

That State Trooper is working in government still. He is not a State Trooper but he definitely was untouchable. He has a better job within the State now but with the State. If it had been anyone not affiliated with who he is affiliated with, they would have been out of employment and living in a homeless shelter. Donald's land is worth a fortune. The last time I checked, it had been subdivided off. What a shame.
