Mr. Mueller recommended government employees avoid lobbying for or against the SPLOST. While he said they can do so legally on their own time, but not on government time, he said perceptions can be a problem. He also advised local officials to not campaign for or against the vote for the same reason. He said the law regarding elected officials and campaigning on a SPLOST is not clear.

"Educate, don't promote," he said. "You get into promotion where you say 'we will raise your taxes if you don't vote for it.'"

He suggested getting private dollars to fund a campaign.-

SPLOST funds can only be used for the purposes described in the referendum and call for election and must be held in a dedicated account, not commingled with other funds prior to expenditure. Each annual audit must include a schedule for each project, including the estimated total amount of the SPLOST to be used for that project, the amount expended in prior years, the amount expended in the current year, and the estimated percentage of completion. The statute requires that records sufficient for these audit purposes be maintained for every project for which the SPLOST is used.

Can a county or municipality change its mind and not fund one or more of the SPLOST projects despite voter approvalin a referendum?

No. In a 1992 decision, the Georgia Supreme Court ruled that the governing authority was obliged to use proceeds from the SPLOST tax for the projects approved in the SPLOST referendum. The Court held that the governing authority

“…is bound by the SPLOST budgetand account reports to complete all projects listed therein unless circumstances arise which dictate that projects which initiallyseemed feasible are no longer so. In this regard, the governing authority has discretion to make adjustments in the plans for theseprojects, but may not abandon the projects altogether.”[

Dickey v. Storey

, 262 Ga. 452, 455 (1992)].

The Supreme Court, in the same ruling, recognized that the county could not use SPLOST funds for a project that had not been approved by the voters, noting that under O.C.G.A.§



48-8-121(a) proceeds from the SPLOST

“…shall be used exclusively for the purpose or

purposes specied in the resolution or ordinance calling for imposition of the tax.”

[Id.].While the Court has recognized that counties retain discretion to alter SPLOST projects, no such alterations may contravene the terms of the referendum.[Rothschild v. Columbus Consolidated Government, 291 Ga. App. 531(2008); Johnstone v. Thompson, 280 Ga. 611(2006)]

People you must pass the SPLOST vote. Where would the money come from to transfer from one account to another to hide thefts and misuse. Lamar would have to use his own funds to cover up and we cannot afford the interest that a loan shark charges. Now we could get a honest commissioner but then we might have to quit funding private clubs and the such and no one wants that. I saw a 90 year old widow lady on a fixed income at the cattle sale the other day trying to bid on a horse so she could ride down and see the horse arena. The owner wouldn't take the coupons she had sent hours cutting out though.

I want a SPLOST for me. It's just a penny per dollar. And since I've lived here 15 yrs, and do 99% of my purchases in other counties since I commute daily, I don't care. I will even give buy the commissioner and his friends new jet skis.

I want MY Splost!!! This cookie jar should feed MY hand too. I pay my county taxes, and don't have time to run for local office, since there are no local jobs. Union Co. needs to pony up, since I have no kids in school here, and my road is full of pot holes, and I don't like paying $4 for a tomato at the farmers market.

I will vote for it because any and all improvements in our community are appreciated and enjoyed.

So my taxes go up - that's life. I'm old and I really don't give a rat's ass as long as I can enjoy Union County, the golf course, Meeks Park, and all the improvements over the years I've witnessed.

We really got a lot of paving done in the last few years haven't we? All I see is p&p.(potholes & patches)That's one of the benefits we were going to get with our penny tax. I know he campaigned he had paved 100 miles of roads. I would like to see that list. I don't think you could line up all the patches, measure them and get 50 miles of paving. The only ones I saw paved were the ones the state paid for. I do notice, now he is paving two roads he claimed would never be county roads. You know the ones, The roads that improve Dick Bells property.

Whether you like, dislike, agree or disagree, if you are concerned enough to actually fact check for yourself it should be obvious Linda (ACOG) does a good job with her research and exposing improprieties within our local government, and posing legitimate inquiries that continue to be ignored by a Commissioner who refuses to be responsive to specific questions.

While specifics with regard to past SPLOST project expenditure have not been addressed adequately by the Commissioner during his 12 + year tenure in office he now unveils a NEW SPLOST, for a six year term.

Of course with a somewhat admitted devious twist.

The vote will be held this November along with this years vote for Mayor/Town Council.

The timing of course, is thought to be advantageous to those who wish to continue the tax and spend Motus Operandi.

By choosing a time frame in which they believe fewer voters will show up to vote, they believe they may slip it through. And should the SPLOST actually fail, as the Commissioner speculated, they would have another shot at the TAX again in the 2014 General Election.

Also, as amazing as it may be the Commissioner actually stated that he has yet to devise a list of the actual expenditures for which the money is actually needed!

It’s time for RESPONSIVE NEW LEADERSHIP, throw the bums out. Starting with the Mayor, and Town Council. Then VOTE NO SPLOST. And finally in his next election unseat the Commissioner. Twelve years was too long, sixteen years was foolish, and twenty years would be more than simply unwise, it could be potentially ruinous.

Disagree. I am old too, and never go to Meeks Park and I play golf but Butternut Golf Course is a poor excuse for a golf course and will never be any better since it does not have enough land to be decent. We are wasting out tax dollars on Butternut unless it can support itself, and it could but it does not and has to be supported by taxpayers..
I also appreciate the folks on here that have donated their time to expose seeming illegal actions by our Leaders in Union C.
The Horse Barn was a gift to Lamar's friends, the Farmers market is a glorified flea market that is losing money and is being supported by taxpayers and is competing with other local flea markets; this is wrong. The Community Center is nice but how many taxpayers use it and at what cost? I think not enough will ever use it to support its building, a waste of money.
I believe taxpayer money should be sacred and used only for really valid projects like Police, Fire, Roads, Etc. If Lamar is given more money, he will waste it again for special groups trying to get something for free. I will vote no.

A.I have also answered this question before, but if I did not think it was wise, we certainly would not be doing it. While the country has not been focusing on the jobs issue, I am. There is nothing more important than trying to boost our economy so that we can see job expansion in the very near future. An enhanced quality of life is critical to attracting jobs and industry to Union County, just as health care and education also play a major role. The new Community Center, when completed in October, will be only about jobs. By moving the Chamber of Commerce and our Economic Development offices to the new building and taking advantage of one of the most beautiful scenic vistas in Union County, overlooking the golf course and the Appalachian Mountains, can only help attract visitors, retail and commercial business and enhance our ability to attract industrial prospects, all of which create jobs.

Who establishes the revenue estimate and the project costs specified in the resolution and on
the ballot?

The COUNTY is RESPONSIBLE for ESTIMATING the SPLOST revenues expected to be collected over the life of the SPLOST as well as the costs of all projects to be financed. The county should also ensure that the sum of all project costs, including those submitted by any municipality, equals the estimated revenues12. Because all
approved projects must be funded as provided under Dickey, counties should be careful not to overestimate SPLOST revenues, thereby requiring the use of other county funds to make up any shortfalls.

The SPLOST I ran from 4/1/99 - 3/31/04

In the last SPLOST Lamar SOLD the voters that the County would collect $31,000,000 in revenue from the SPLOST.

On the County Budget Report for 2009 Lamar put on the report the County would collect $6,600,000 in Revenue from SPLOST that year.

From 1999 to 2013 THE HIGHEST AMOUNT EVER COLLECTED in one year was in 2006 and that year this county only collected $3,752,501.

How did Lamar come up with the $6,600,000?

How did the COMMISSIONER Lamar Paris come up with the $31 million dollars?
