What a waste of money. States have lost these suits every...single...time. This is political grandstanding at the expense of the taxpayers. The state will lose and the KKK will get its participation in the highway cleanup program. The state cannot deny participation because of the KKK's views. This is known as "viewpoint discrimination" or, more technically, as a "well-established violation of the First Amendment to the United States Constitution".
The KKK should demand legal fees for wasting the court's time and the Klan's money. This is settled law.

State and local governments cannot violate Federal Law. But even worse is the paper money it costs the State and Local taxpayers as a pathetic waste when stupid legal action is taken.

Though I don't agree with the Kkk at all I believe that they have the right to do so just as any other group has the right to do so
