All roads in the United States are defined as public lands by acts of congress 154 206 and 278. Notice these laws were passed before automobiles existed traffic is defined as persons. No one can be banned from public lands for any reason. title 43 chapter 1063 United States code. title 23 chapter 119 Public roads cannot be closed nor can tolls be charged for the use of public roads. Federal highway act nov. 9 1921. No one can write a law in conflict with federal law including the federal government. Recent lawsuits against the Amish have ruled preventing horses and wagons from using public roads is a violation of the religious freedom clause of the constitution nor are they required to use lights.
