This is complete bull. I am all for innocent until proven guilty and guess what. He was! The protective order didn't prove his innocence and there was a plethora of other evidence showing that he was the shooter. I effin hate technicalities like that.

What I like about this country is that there is some fairness in our legal system which provides protection to it's citizens. Too many innocent people have been railroaded because their rights were not protected...mostly minorities.

Prosecutor Rowland said the appeal hinged on how long the protective order was in place. She recommended during trial that it be lifted as soon as the witness testified. But according to the ruling, Almquist during trial denied a request to examine the witness's statement. __________ Almquist , Is this guy for real ? Why dont we just give out lolli pops to anyone who commits a violent crime instead of arresting them and having a trial ? Just think of all the money we would save and yet we would still have the same amount of criminals on the street at the rate Almquist lets em out . Ya wanna stop the violence on the streets oF Santa Cruz County ? GET ALMQUIST OFF THE BENCH !! That would be a first step !

This is the result you should expect when someone without trial experience become a judge. Almquist, like most of the candidates now running for judge, couldn't find the courthouse without a map before the governor appointed him. Without trial experience he's learning, and making mistakes, at the expense of public safety. Keep that in mind when you vote next June.

Anyone can make a mistake, but Judge Almquist is an amateur, a dilettante, and the worst Superior Court Judge in Santa Cruz County. He was appointed during the lame-duck phase of the Gray Davis administration. I voted for Gov. Davis and voted against his recall, but the worst actions of Gov. Davis occurred during the thirty days after the recall when newly-elected Gov. Schwarzenegger abdicated his own election. Also, to the best of my knowledge, Judge Almquist is the only local Superior Court Judge with a case record in the Superior Court's criminal database. He's up for re-election in June, 2012.

Although this mess is happening in the courts and has little to do with the Copper's job, it shows how the cop's hands are tied so many times. Often we know about crimes, but it takes jumping through a bunch of loops to take action effectively.

Well good bloody luck finding someone to run against him. There's some sort of unwritten code which is rarely broken. Kathleen Akao did and kicked newly appointed Kovacevich right off the bench. Word is that Atack will take retirement in 2010 opening up two seats for election. The sharks are already circling with five people already running. This will be an interesting election. I for one will NOT vote for anyone who is running for retirement. Judges are eligible for a full ride retirement at 62, even if they only served for a short period of time. So no, I won't be voting for anyone running for retirement! I want someone well versed in constitutional law and who will support the constitution. I'm planning on taking a good hard look at the younger candidates. I've heard Gallagher speak twice, he gave the exact same speech and even shed a few tears on cue. I threw up a little in my mouth the second time.

The appointment of Almquist was purely political and had nothing to do with his qualifications or merit. The same holds true for Mark Stone who was appointed to Almquist's newly vacant Supervisorial position. These appointments of ineffective puppets is the root cause of most of the problems we see today in the County of Santa Cruz. It's widespread and common, encompassing judgeships, supervisors, water boards and nonprofits.

She is 46 years old and a constitutional lawyer and will be a good judge for a long time.
