There's nothing "sneaky" about filing a nominating petition just before the deadline (as many candidates do). Election law is there for a reason. I think just it's sour grapes from someone who missed out on a couple of months of mud-slinging!

Prosecutor candidate says civil judgment a ˜non-issue’

REED CITY - A debt nearly a decade old could soon be repaid by a candidate for the Osceola County prosecutor’s position.

On June 12, Osceola Judge Ron Nichols renewed a $17,075 civil judgment against James Sims II. The debt is owed to Consumer Portfolio Services, which is the original lender on a car loan on Sept. 24, 1996.

"The original case, I was never served," Sims said. "I didn’t know about the case until 2004. I assumed it was paid off when I willfully surrendered the vehicle in 1997."

At that time, Sims worked at Evart Products. After losing his job, he decided to surrender the vehicle.

Yet the company sold the vehicle for $3,350, leaving an unpaid deficiency of more than $6,000.

CPS sent a process server to notify Sims of the loan. According to court records, Sims was served on Nov. 22, 1998.

By then, Sims said he had moved and the notice was given to someone else.

In 2004, while looking at his credit report, Sims said he noticed the debt. After contacting CPS’s attorney, Sims said he was notified the loan was old, so it would be reviewed and they would make contact with him soon.

That was the last contact concerning the loan until this year, when CPS filed to renew the judgment in 77th District Court. Sims contested the renewal and lost as Judge Susan Grant ruled on July 7 to not accept Sims’ motion for relief.

"Because I was never served, I thought it was a good case to review by the court," he said. "I lost, pure and simple. The judge thought I was the person served even though I didn’t live at the address at that time."

The next step is paying the debt, which has already been negotiated with CPS’s attorney.

If Sims is elected, he does not believe the civil judgment is an issue that will affect his ability to prosecute criminal cases or fiscally manage the prosecutor’s office, which has its spending overseen by the Osceola County Board of Commissioners.

"This is civil, I’ll be in the criminal arena," Sims said. "It’s not a big deal, it doesn’t affect the ability to prosecute cases. It’s a non-issue."

Sims is one of three candidates seeking the Republican nomination in Tuesday’s primary election. Also running are incumbent Sandra Marvin and attorney Cameron Harwell.

Well, I guess the voters agreed that someone new would be the better choice...the election wasn't even close. Congrats to Jim Sims....hopefully you will not become corrupt like the previous incumbant.

first of all, the bridge card comment is hillarius!! No they do not, but kudos to Jim for bettering himself and bringing himself from the bridge card to the county prosecutor. There are not very many people in this county who ca say that they did what it took to get away from that life. That says something about the man. It shows his determination to make the world a better place and I think that Osceola County is lucky to have a man like him for a prosecutor. And to answer the last question posed, to the best of my knowledge there isnt anybody running against him in the november election, but yes, we must vote again.
