My daughter, my granddaughter and I went to the Lee County Flea Market at approximately 10:00 am (CST). We parked across the street from the flea market in an area that looked like a parking area. Other cars were also parked there. No signs were posted saying private property or no parking.

At approximately 11:00 am we were leaving the flea market and noticed that my car was being towed. I approached the tow truck driver (Rodger Dykes) and asked him to wait and let me pay him. He told me it would be $125. I told him I did not have that much cash that I could write him a check. He would not take the check. I questioned him as to the law for towing. He told me the owner of the house called and asked him to tow all the cars. I asked him to allow me to call the police so I could be sure he was not towing my car illegally. My daughter called the police at 11:28 am. He told his driver to leave with my car.

My daughter and I stood in front and in back of the truck so they could not leave before the police officer got there. The driver of the truck tried to run over my daughter and one of the other employees pushed her. She is 8 ½ months pregnant. My granddaughter is 6.

When the police officer (Officer Worley) arrived she told us that he had a right to tow my car but that they had tried to get the people that own the house to post signs. The police officer told us that she could call a taxi for us or take us to get the car. I didn’t have the money to get the car…just a check. She suggested we walk.

Later we were told by someone that the tow company and the owner of the house split the money from the towing every weekend. We asked Mr. Dykes if he would wait because we didn’t have a way to get to the car if we got the money. He told us we would just have to walk. He was very arrogant and nasty.

I called my friend Lee and asked if he could loan me the money. When he arrived, over an hour later, he called Dykes and asked for directions. When we got there we were told that the bill was now $265. When we paid Mr. Dykes for the towing he asked for proof of ownership of my car. He followed Lee to the car to make sure the key fit. They had put “Abandoned Vehicle” on the windshield of my car.

There was another woman there getting her car and she was only being charged $125. She is consulting an attorney.

As we were leaving one of the employees was standing in the door taking pictures of Lee’s car.

I am sure there is more to this story.

I have known Mr. Dykes for a very long time. He will go out of his way to help anyone he can. He helps the elderly people, the community, and others that have needed help. He volunteers his time and trucks.

People who act the way you did by putting your self, pregnant daughter and grandchild in front of a big truck are not to smart. I am sure Mr. Dykes took precautions so no one would get hurt. He watches out for others and the safety of life. That is probably why your cost went up. Waiting on the police to get there, keeps his business from running.

Bottom line is DYKES TOWING IS WONDERFUL!!

Seems like Dykes Towing ran into a bad apple.

u know the law is always twisted in some way. I have seen all these tow companies pick up the wrong cars and argue up and down that that is the one they are suppose to pick up. I had a similiar incident where they picked up the wrong car mine argued up and down took the dang thing anyway. Finally the police called them back sure enough the wrong car they did not get a full description. So what di they do they take it way back out 431 drop it off in wat the city deems a hazard. Calls me a couple of hours later says sorry wrong car we dropped off in the vecinity we picked it up and left the key on the tire by this time it is 11pm have to find a ride back out there just to find the car gone. Finally the next day another towing company had picked it up because the first one dropped it off in the wrong place and picked up the wrong car wat a screwed up world but do u think anyone did anything no. But God watches over us and we might not see it today r tomorrow but these crooks will have to answer for what they do

and as to the person that thinks he is so wonderful no one ever knows someone that well beleive me their are two sides to every person. And waiting on the police is not a bad idea because the companies make mistakes to 15 to 20 minutes is not that long please we need to have more common courtesy to each other. What a sweet deal for the peson that lives in that house because u can not tell that is part of their yard it looks like it belongs to the service station I will find out their name and post it here for u maybe we can put a sign up for the crooks our onselfs since they will not and then they cant collect anymore money lol

I wouldn't divulge anyone's personal information at this time, nor would I trespass further, if you are trying to build a case against anyone... possible backfire could happen... I am still willing to help, by the way...

I'm not sure why topix is stating that I'm from different locations, but I have a law practice in Smiths Station, and am eager to pursue this...

I'm the one who lives in the house, across the street from the flea market. It's not my fault that some people are just plain stupid and park in my yard. I don't have signs up, because the flea market would not buy them, and I'm not coming out of pocket to guard against other people's stupidity. This is the flea market's problem, not mine. They create a shitload of traffic out here, and sometimes I nearly get hit trying to leave my house, because I can't see around cars parked on the side of the road.

This is to the dumbass who started this post: you, yourself said you parked across the street from the flea market, which is NOT at the flea market, so you knowingly trespassed, because there were no signs stating that it WAS for flea market parking. You've made false accusations that Rodger and/or Me is a scammer... to that I say this, does that make you and all of the rest of the people who park in my yard scammers as well? What I mean by that,(and I'll type real slow, so you can understand) is that I pay the rent here, and you use my land for your personal gains(to get the "bargains" at the flea market) and don't even have the consideration to even offer to pay anything to park here, and when it's all said and done, I'm still stuck with the bill. But I'm a scammer? Next, you say me and him are splitting the money, yet another false accusation, I call him to come get the moron's cars from my yard. I told him from the beginning that I didn't want any money from the towing, I just wanted these IDIOTS to stop parking in my yard, and if the county and/or sheriff's dept. won't stop people from parking here, I'll just have them towed. I'm also within my full rights to do so, as I've consulted legal counsel, and have had the sheriff's dept. here numerous times before I started having them towed myself. If you morons want signs up so bad, petition the flea market to do so, or go to a county comissioner's meeting, and see if the county will put some up. By the way, there is a sign down there, it's nailed to the tree closest to the road, and it looks to have been there for a number of years.
This is to the rest who says that I'm breaking the law, am a scammer, etc... Read the laws for Alabama, before you start spewing your mouth off. In Alabama, there is a "No Trespassing" law, whereas noone has to post it, it's the law. As far as me being a scammer, I don't stand beside the road and direct people over to park at my house, and then have them towed away. These morons voluntarily park here, against my wishes, so I have them towed.
For the idiot who posted it was entrapment and extortion.... what can I say that would make sense to you? I'll try this, go get a dictionary and find out what those two words mean before you show your stupidity again. Entrapment is the act of coersiing someone into doing something wrong, and then having them prosecuted in some way, whether it be criminal, or civil. Extortion is the act of depriving someone of their property, in lieu of going to authorities, etc. for something they've done wrong, with the intention, "if they don't pay up, they're through".
Again, I don't entice these MORONS to park here, and never will, because that IS wrong, but I'll have every sumbitch towed away that does park here, because this is MY FUCKING PROPERTY!!! So unless you're here to visit, stay out of MY FUCKING YARD!!
IDIOTS!!!!
