Is is known whether Mosley was armed, or told Freeman he was? The victims here sound scarier than the shooter. A 19 year-old in Berkeley would have access to a weapon, and might well be carrying if he'd been threatened. Obviously Freeman made bad choices, but I"d like to know more about what went on that day, and the during the previous altercation.

I've heard that Freeman's family and friends had to be escorted out of the Bay Area by the police or they would have been killed by gang members...
how come this isn't mentioned anywhere in the news!

from what I know of Berkeley, these kids have to carry guns or risk getting shot..
something is right when young men think masculinity is found in a gun.

Nathaniel has been working with young children at the Episcopial church and is doing after school programs with children. He is not a bad young man. Unfortunately so many of our children feel they have to have guns to defend themselves or to prove their manhood. What really happened that afternoon? What is the other side of the story and how can our society get guns out of the hands of our children and young people.

Why are so many NY readers weighin in here trying to sound like experts on the streets of Berkeley? Family members of the suspect, perhaps? The suspect may not have been the shooter, but from those who witnessed his activity in the last few years, his involvement in this incident was not the first time he used bad judgement. He traveled with a dangerous crowd.

THERE IS ABSOLUTLY NO EXCUSE FOR MURDERING A FATHER OF THREE. Anger management would be the solution not brandishing weapons and murdering a guy that I have known for years and never ever had a bad encounter with. Besides my personal connection with the victim, let's not forget the value of having our black men home with their families. He has three sons who will be just three more fatherless black males who may not have the benefit of ever learning how to make good and sound judgement.I have had many disagreements and somehow murder has never been an option. Something is seriously wrong with this individual. None of the witnesses say anything about any physical contact, so a mere argument provokes you? I understand why the family moved because maceo was loved and cherished by so many. But his greatest fear shouldn't be death.Death is easy. Killing is a cowards way out. Unable to face real life situations that we have all managed to deal with. No, what he should fear is his pitiful soul burning in hell. He'll never be half the man maceo was and even death won't change that. So if you want to sit at your computer and speak on the behalf of a heathen- Join him in hell and burn with him. Flame-on

Marcus Mosley a gang If Marcus Mosley is a gang member then Al Capone was a Model citizen. You ask where they armed...the answer is of course not. they are up town berkeley (Police evrywhere) confronting a kid! There was no Justification for that young man to open fire. Marcus MOsley mad ea wrong decision by getting back up for a situation that could have been talked out betwen the two off them. But Maceo Smith was a good man with a big heart! He was a basket ball, baseball and foot ball coach, youth mentor and best of all a great father to his three sons! Sure he might have had a few brushes with the law in the past but nobody is perfect. So for all the misconceptions Maceo Smith was not a gang member!!!! It is sad that we have one dead, one facing life in person and three black males that now have lost a great father!

Why is it the victim is such a upstanding citizen but he was there to back up his former brother in law in intimdating a 19 yr old kid? 20 mins of harassment 2 on one. Hum. What made Nathaniel feel that he had no choice.... did he see they had a gun? The family swisked out of town. Great now who is there for Nathaniel at court? These victims are still running people out of town with their gang affiliations. Anyone think this might have been self defense?

Many people "Confuse" self defense with actually killing people. LOL! But self-defense actually means doing everything possible to AVOID fighting someone. Self-defense is all about using your smarts (which Mosley was doing... communicating) not weapons.

Does anyone know what Mosley was actually doing? I'm stunned that so little has been written about him. Its possible that both Smith and Freeman were as their supporters have said, okay guys tragically brought together by Marcus Mosley. Who is he and what was he doing there?????

marcus mosley is a coward...first of all he was the one that was arguing with the assailant. He then got his brother-in-law involved, got shot at, got his brother-in-law killed. Basically, left he brother-in-law there to die and drove off to the hospital by himself. If he was communicating right, there would be no arguments and he didn't need to get his family involved. COWARD.

Honestly you should be gone not mace. Trippin with this kid he told you he didnt want it. How could you leave the scene like that and let mace bleed to death coward.

Thank you for giving a reality check to some of these arm chair critics/media stooges. It's pathetic to even dream that somebody would seek any sort of justification for an unnecessary homicide, especially of a city employee with 3 kids. As far as being "scary", the main victim (yes, the deceased, NOT the murderer, believe it or not) didn't initiate the conflict according to public reports, the other victim did. He was looking to help out a friend as many of us would do, and please know the entire story as far as who was there, what happened, etc, before you look to pass judgment. Smith was unarmed nor has he ever had a violent conviction (despite any suspicions). This Freeman loser decided that instead of leaving or walking away, instead of conceding physical inferiority, or even instead of manning up and settling your differences through a quick scrap and take a whoopin, he decided to take a life and TRY to take another. What's "scarier" than that? I live in Berkeley and never HAD to carry a gun. That's pathetic. So called "gang members" are the ones who people need to defend against and they are the ones who carry guns. Smith had no Gun. Freeman did. Do the math! Idiots.

ripmaceo - I agree that Maceo Smith is the victim, but my question is whether he was the "target" or just in the wrong place at the wrong time. All I can say to you is that Freeman's friends are as stunned as Smith's... and I agree we don't know everything -- what is the story with Marcus Mosley?
