Court overturns conviction in Craigslist sex sting
A panel of appellate court justices ruled there is “substantial evidence of entrapment” in Gregory Ruiz Aguirre’s case.
By VIK JOLLY / THE ORANGE COUNTY REGISTER
SANTA ANA – An appellate court has overturned the conviction of a man for responding to a bogus Craigslist ad by a Huntington Beach police officer posing as a 13-year-old girl.
The justices ruled there is "substantial evidence of entrapment" in the Aguirre case.
He was one of six men who responded to the Craigslist.org ad – part of an undercover sting operation targeting Internet child predators – by police posing as a 13-year-old girl saying she was looking to make $100.
In May 2010, an officer posted a message in the "Casual Encounters" section of the website. The title of the post read: "Hi wanta play with me 2nite — w4m (hb)," the appellate court's narrative of the incident says.
The body of the message stated: "I want to have fun and mke new friends." The term "w4m (hb)" was intended by the officer to convey the poster was a woman looking for a man in Huntington Beach. More than 100 people, including Aguirre, responded.
DID NOT BELIEVE SHE WAS 13
Aguirre admitted to officers "the female he was meeting had told him she was 13, he had agreed to pay her for sex, and he had brought condoms with him," but he also said "at least once during his interview that he did not think the woman in the photograph sent to him was really 13 years old."
The defendant denied having ever contacted other minors for sex. Police searches of Aguirre's computer and efforts to find other victims did not yield any child pornography, the justices said.
"The police lured defendant into an electronic conversation with Jess without providing any indication at the outset that she was underage ... The police quickly disclosed Jess was 13 years old once defendant contacted her, but in response to defendant's request for a picture of Jess, the police selected a photograph of an attractive and mature female body," the justices said.
"Jess" was first to use sexually explicit comments in responses to their first exchange and following the initial contact, she initiated electronic communication with Aguirre on four separate occasions, they said.
LACK OF ENTRAPMENT INSTRUCTION
In March 2011, jurors at the West Justice Center in Westminster deliberated a couple of hours before finding Aguirre guilty of three felonies, including going to meet a minor for a lewd purpose. He also was convicted of attempted lewd conduct with a minor under 14 and communicating with a minor for a lewd purpose.
Jensen sentenced Aguirre to five years formal probation with the condition a violation would automatically send him to four years in state prison. Aguirre was also ordered to register as a sex offender for life.
"Our analysis suggests the government should not be in the business of testing the will of law-abiding citizens with elaborate (if improbable) fantasies of sensuous teenagers desperate to engage in sexual acts with random middle-aged men," wrote appellate Justice Raymond Ikola, with Justices William Rylaarsdam and Richard Fybel concurring.
The lack of an entrapment instruction "was not harmless, as a more favorable result for defendant was reasonably probable" if it had been provided, the panel said.
"Entrapment is about the actions of the police, not the guilt of defendant," the ruling said.
"Our review of the record suggests a reasonable jury could find that the police conduct would illegitimately ensnare normally law-abiding individuals in an illegal conversation they would not have otherwise pursued," the justices said. "In sum, the jury might have believed the conduct of the police was likely to induce a normally law-abiding person to commit some or all of the charged crimes. We therefore reverse the judgment."

I know one can watch the clips on Youtube, among other sources, but it is going to be special watching Wolin smash those shades on TV again.
try/set this for your area http://www.tvguide.com/Listings/
because they alter the name slightly. i tried to look it up on MSNBC and it doesnt seem to be there.

did you videotape the episode? I sure as hell did, along with almost all the other episodes but my videotapes are unmarked.
Just type in "Predator Raw: The Unseen Tapes" on youtube, there is plenty. FULL EPISODES.

LITTLE STORY: a notorious guy in high school was in a group home for 'sexually molesting his sister'(this was the early 1990's) and still in a group home then living with his grandma. he still remained a pervert till the end. then he dropped out and ended up being found on facebook years later. I GUESS HIS FAMILY DISOWNED HIM but he ended up on the high school facebook page, and now he is married TO AN UGLY WOMAN and has 2 daughters. Wonder if he will molest them or does his wife know about his past?

NOW WHY ARENT YOU HYPOCRIPTS MARKING THE LONG OTHER POSTINGS BEFORE MINE WITH A "SPAM", "NUTS", "CLUELESS" MARKINGS? YOU ARE DUMB!!! I GET MARKED BUT THE OTHERS DO NOT!!!

i point out something and it works, you dont get it. There is a lot of repeated things that have been said before on here, such as about his wife ect...

Penal Code section 31.

being present, have advised and encouraged its commission, and all
persons counseling, advising, or encouraging children under the age

another to commit any crime, are principals in any crime so
committed.
For some backgound, this section of the chat is after Wolin did not show up at the sting house, and so Xavier Von Erck intiates recontact. If you see any aiding and abetting, or any advising and encouraging, or any coerciion, then Von Erk is a principal to the crime of attempted child molestation. That would mean he is as guilty of atempted child molestation as Wolin was.

I talked to someone that observed the trial. The evidence regarding the email/IM discussions between the Defendant and the undercover officer was apparently much different than the truncated version released by law enforcement in the probable cause affidavits. The undercover agent was making posts on a regular dating site, and only revealed the age of the virtual girl after the guy thought he was talking to an above age girl. Also the photos that law enforcement sent to this guy were apparently of some 25 year old hardbody chick. Way much more of an entrapment scenario than I first envisioned. The jury was probably put off by law enforcementoverly encouraging this guy to act.
That was standard procedure.

This is the absolute best way to tell if you are talking to a cop or decoy that is trying to set you up to get arrested (i.e entrapment):

If you meet this "teenage girl" in a chat room and you start communicating with "her", you should make up a second user name/screen name and then contact this "teenage girl" and introduce and identify yourself as a teenage boy of the same age. A real teenage girl would rather chat with a boy of the same age and not an older man. If you identify yourself as a teenage boy and the other person writes back "You're too young" or "I only like older guys" or "Guys my age are stupid/retarded" then I guarantee that you are talking to an undercover cop/decoy that is trying to set you up. STOP chatting with and DO NOT communicate with this person anymore. Find another person, preferrably someone with a web camera who can prove their identity to you and who you can see in real time. Cops and decoys always send fake pictures to guys when they chat with "potential sexual predators." Don't be another victim of police entrapment. Good luck.

Decoys are not the police. Does not apply.
All the guy had to do was say "Send me a naked picture of yourself and then I will meet you for sex." Cops and decoys NEVER send naked pictures to "potential sexual predators" because that is 100% entrapment right there. Had Aguirre done this, he would have known that he was talking to a cop and that he was the victim or a set-up.

Also, you MUST be at least 18 years old to post an ad on Craigslist. Anyone who posts and ad on CL and claims to be under the age of 18 is definitely a cop trying to set men up to get arrested or is a prankster playing a joke on everyone. DO NOT answer ads on CL by a person claiming to be under 18 years old and is looking for a boyfriend or sex. These ads are posted by police in order to entrap adult men.

Wolin had worked for a long time and paid into the system so he is entitled to collect disability if he can't work or find another job. Applying for and getting approved for SS disability has never been easier than it is now. He just has to see a therapist who can write up a convincing report on his behalf. At any rate, Wolin probably still has a lot more money than your sorry, worthless, pathetic ass ever will. He probably carries more money in his wallet than you have saved up in the bank.

So... in other words, he can get a doctor to lie for him -- subjecting both to charges of fraud.

What's it to you how much money he has? I don't care how much money anybody has. You fail to understand, sir. It doesn't matter what you have in your wallet so much as it matters what you have in your heart.
