On Aug. 31, 2012, the board and Robert Jacob Hernandez, M.D., entered into a mediated agreed order requiring Dr. Hernandez to pass within one year and within three attempts the Medical Jurisprudence Exam, have his practice monitored by another physician for eight monitoring cycles, complete within one year the medical record-keeping course offered by the University of California San Diego Physician Assessment and Clinical Education (PACE) program, maintain a logbook of all prescriptions written for controlled substances or dangerous drugs and pay an administrative penalty of $3,000 within 60 days. The board found Dr. Hernandez failed to meet the standard of care, nontherapeutically prescribed and violated board rules regarding maintenance of adequate medical records and the treatment of pain. The Order resolves a formal complaint filed against Dr. Hernandez at the State Office of Administrative Hearings.

Does anyone know if it's legal for Dr. Hernandez to charge $10 for a written Rx? If it is legal why is it they only let you pay cash for it. They don't let you use a debit or credit card and offer no receipt. Most people like receipts to keep track of their medical expenses.

It is legal many do it (according to web search) Hi office mgr. said it was to vover the cost of the triplicate pads. Odd though
that he only accepts cash. Sounds like a way to make money under the table. He does have back property taxes and a couple of divorces to pay for. Not to mention the DUI and fines from the Medical board. Notice that he is banned from prescibing pain meds. Was told that he was just trying to get back to a general practice. Bull crap. He lost his liscense for that no longer in the pain mgt biz. he thought is would try the facial skin treatments. I overheard the company that provides the products.(It's like a franchise biz) tell him he wouldn't have to do anything but it would be advertized as under a doctors care. Remember when he had his office help doing the meso therapy shots that were suppose to be done by him. dozens of shots in the belly and scalp. One for melting away fat and the other for hair growth. Total scam. Ever hear of sleep therapy just another way to bill insurance for something you really don't need.

Anyone can see these sanctions and magnify them. And take this Doctors flaws and magnify them to make themselves feel better. However, I have to ask myself this... Have these people had a patient/Doctor relationship with Doctor Hernandez like Josh and I do? And if so, how long? I have been seeing him for a few years now. These sanctions prove he is human. Yes, they are public because he is a Doctor. And they have to be. But how would you feel if your flaws were brought to a forum your name bashed like Dr. Hernandez' has been done here? Let me tell you about MY experiences with Doc. Josh, I have to agree with your review of his care for his patients. I get a hug when he walks into the door of my room, before I leave, as well as "God Bless You." when he walks me to the door. He takes his time to get to know you, and lets you get to know him. He takes time to make sure you understand what is wrong with you where you understand it, and doesnt act like he is better than you because he has a medical degree. I have seen him write off someone's total bill because they couldnt pay it. I also have to ask ... were you denied a receipt for your triplicate? Because I have NEVER been denied one when I ask for one. Also, common sense tells me if he was trying to make money UNDER THE TABLE with charging for it, it wouldnt be posted in the window he was charging for it. He is a wonderful doctor, and he truly cares about his patients. This man has helped save my life with his medical knowledge. I highly recommend him!

Dr. Hernandez is the biggest scam artists I have ever had the "joy" to know. I went to his office and sat for 3 hours and he never came to the room so I left. I went in for a routine exam and he did a urine drug test... I have zero clue as to why since I was only in for a routine exam! As stated before he NEVER came into my room so I left after waiting for 3 hours! I later checked my explanation of benefits of what he sent to my insurance, he billed for $2400 in "lab" fees. I went to his office today to get a copy of my statement so I could make a payment on the outrageous bill, and the office informed me that they couldn't provide me with a copy. I guess they don't want their $2000... HUGE mistake going to him, he seems like a nice man but the billing in absurd and the fact he allows the insurance fraud to happen proves what others have said.

The reason for your urine drug screen that you are complaining about was because you were there to get on the weight loss program which consists of taking Adipex which is an amphetamine or you were there to get on ADHD medication. Dr. Hernandez treats patients who are overweight, have opiate addictions & patients who have ADD or ADHD. The medications need to be regulated to make sure the patient is actually taking them, so he does drug screens before & during treatment. Too bad you're bashing the Dr. & not admitting the real reason you were there...either to loose weight, get off opiates or manage ADD. Those would be the only reasons you would have been screened!!

just to be clear, employers hands are tied because he is giving legal Rx's, they give regular UA's but this all is through a Dr. It is just that this Dr. should not be practicing medicine. This is how addictions start and grow and destroy lives. No one is safe if they go to him because he has no regard for patients care.
