Would like to know if someone came to your house and grabbed you, what would you do? would you just lose it and slap them or would you try to calm them down not knowing what they were gonna do next.it's not family so it's not domestic violence.

Yeah? Well that happened to me and I got arrested and now getting sued!So NEVER TeLL THE TRUTH, I was always taught that honesty is the best policy, NOT! Not all the time anywayThey took the person to the hospital so I got assault. Minimum fine but still can't understand their way of thinking.Guess I was suppose to let him hurt me and then strike back, by the way I am a woman.

You give us no details. How did the person grab you? Was it just placing a hand on your arm or shoulder or was it meant to take control of you? If the latter, why didn't you file charges of assault and battery? Did you tell the person to stop touching you? What did you do to him that sent him to the hospital? Was he a stranger, a salesman or other solicitor, a religious missionary, an ex-lover, a neighbor? Maybe you should have gotten legal advice before admitting anything to law enforcement. If you had good reason to think the person intended to cause you serious bodily harm you have a right to self-defense. When you called 911 to request help, it would have been well to say how the person assaulted you and what you did in response. Shooting a Bible thumper is probably a bit of overkill.

Now is that what we taught you here at URU? I don't think so! Just from what little info there was posted I am going to assume that there was no time to grab a firearm. So you're stupid little theory just flew out the window. Why is it that you so called "gun people" think that shoot first ask questions later is always the best solution? I don't think most of you would have the guts to even pull the gun in the first place let alone pull the trigger. You just think by saying things like this it makes you macho. The others just like waving the flag around and screaming they have the right to bear arms while they are hiding in a closet. But I am with everyone else on this, there isn't enough info to draw any conclusions one way or another.

Ok here goes he was a friend of a relative of mine, he had been told he was no longer welcome in my house, I pay house payment, I pay for everything here, he came in and I told him that I had told him he wasn't welcome here, I told him he was a user, he grabbed hold of my turtleneck sweater and drew his other arm back as if he was going to hit me, I knocked him out the door, he started to come back in so I pushed again, he fell and broke a hip. I believe he was drunk or on something.No, he was not a lover of mine ,I figured he was gonna hit me and I have had enough of that from men so I hit him after he threw his arm back, I think any body would have done the same. I am not in Logan co.I am gonna have a jury trial I hope!

Well, after reading that in my opinion you had every right to defend yourself and home. What kind of cop would arrest you? He deserved what he got. If he wasn't drunk and say a little more aggressive who knows what could of happened to you? Why didn't he get charged with B & E?

Assuming they are in my home (uninvited)
Assuming they grab me in a violent manor.
Well the rest of you can just assume what I would do next.
Firearms are always within reach of at least one of my family members.

I don't have any guns in my house, maybe I should tho. The cop was a young know it all from Urbana, he didn't get charged with anything, and I am the one that called the cops. Yes, he did have it coming to him.He didn't break and enter, he just came in after my family member came in, but they knew also that he wasn't welcome.Yeah, he scared me pretty bad but if anyone grabs me and throws an arm back I will let them hit me first I guess. I'm not a big woman and he isn't a big man, I should say he's not a man at all!Anyway I'm glad you see things the way I do, hopefully I will have a jury that has some sense!At least one.

It sounds like you were well within the limits of your rights.

No jury in the world would convict you of anything.

Make sure and tell them that you were scared for your life, which you probably were.

Also, get a gun and learn how to use it.

Heather, I believe you were within your rights to push your attacker out the door after what he did. His broken hip was the fault of his own intoxication, not your defensive action. He should pay his own damned hospital bills too. Demand a jury trial. Do not tell the court or anyone else it was an accident. If you claim you accidentally injured him, he can sue you for damages even though it was his own fault. Also, do not pay a fine, as that is the same as pleading guilty. If the judge doesn't throw the case out at arraignment and you have to go to trial, you should get a lawyer. My guess is the case will be thrown out if you refuse to plead guilty to anything. Maybe you should consider filing chargers against your assailant for your own protection? You may need to get a restraining order from the court so he can't come around anymore.

It had nothing to do with sex Lou!And Molly high its too late, this happened last Nov. and I had to go to court the next day and I pleaded no contest, I didn't really want to get an attorney, cause I thought when the judge heard my story she would find me not guilty, I thought no contest meant the judge would decide whether I was guilty or not.I know now that if you pled no contest that means you're pleading guilty, I have a mediation next month and I did tell the attorney that I want to pay him nothing! I'm sure they are on welfare anyway and my att. said his hosp.bill is already paid.By the way My insurance company hire the attorney and I heard they work real hard at not paying, which is Good!My sister told me the same thing, that there is no jury gonna find me guilty, and believe me it shocked me when they arrested me.

As you found out, Heather, pleading no contest is essentially pleading guilty since you are saying you will not contest the charges filed against you. You are automatically ruled quilty and must pay fines and serve imprisonment if sentenced. The only thing you gain by pleading no contest is you are not admitting any fault, so that can't be used as an admission in a subsequent trial, say a civil lawsuit. If you plead not guilty, then you have to go back to court at a later date for the trial. Many people do just what you did so as to avoid going to trial, getting a lawyer and losing a lot of time and money. But it does count as a conviction, and that can have further legal repercussions.

If I'm not mistaken, you can plead not guilty at arraignment, get a court date and defend yourself (no attorney) at trial. That is what you could have done if you hoped the judge would throw out the case. In this situation there is a good chance she would have tossed the case out, though it is by no means certain. Having a lawyer represent you increases the odds you will be acquitted. If what you were found guilty of was a misdemeanor of "domestic violence," you may be permanently inelligible to own, possess or even touch a firearm. That also bars you from working in law enforcement. Some people have had luck (with a lawyer's help) in getting domestic violence convictions annulled so they can again exercise their constitutional right to keep and bear arms.

I have already gone to court as I told you, she fined me75.00.I now have to go to a mediation next month, I was only arrested for assault not domestic violence.They caught him in lies when we had to go to the courthouse. His attorney and mine were both there , his asking me questions and vice-versa. He told a whole different story.Thank you all for answering my questions, You've told me basically the same thing the lawyer told me.
