By the way, how's life as a jailer for Shelby County S/O. Last time we talked it wasn't going so well. I wish Barnet was running for Sheriff but they would just find another reason to disqualify him. A race for the Logan County Sheriff’s seat may not appear on the November ballot if the Logan County Election Board agrees with current Sheriff Andrew Smith that his challenger lacks the experience to run for office.

Sheriff Smith’s wife, Rebecca Marker Smith, filed an eight-page legal challenge Friday to Jeffrey Smalley’s candidacy and the local election board will have an official hearing on the matter at 1 p.m. Thursday.

Ohio law requires that the person filing the document be registered to vote in the same party as the candidate being questioned, which is why Sheriff Smith, a Republican, could not file the appeal himself. Mrs. Smith states in a letter accompanying the appeal that she is a registered Democrat.

The appeal focuses on whether or not Mr. Smalley has worked as a full-time peace officer or law enforcement officer within the past four years, which is one of the requirements set forth in state law to run as a candidate for sheriff.

According to the documents, within the past four years, Mr. Smalley lists experience with the Waynesfield Police Department and the Shelby County Sheriff’s Office, but both positions are in the auxiliary.

The lawsuit claims Mr. Smalley never worked at all while listed as a Waynesfield auxiliary officer from March 23 to July 21 of this year and that he had only volunteered for a total of 54 hours for Shelby County while employed there from April 4 to Oct. 21 of this year.

Further, the filing states, an “auxiliary” position is not a “full-time” position as stated by the law, attorney David Riepenhoff wrote in the formal protest.

He concludes by writing,“Allowing Applicant’s qualifications to constitute ‘full-time’ peace officer experience would reduce the statute to an overlytechnical scavenger hunt for qualifications, ignoring the need for real experience.”

“In Ohio, the sheriff is the chief law enforcement officer of each county and the Ohio Revised Code has specific requirements about who can hold that position,” Sheriff Smith said in a telephone interview.“It became a concern to me when Mr. Smalley’s experience in the last five years is that he has volunteered at the Shelby County Sheriff’s Office for 54 hours.”

Mr. Smalley said in an email that his oath to uphold the law around the clock qualifies him as a full-time officer and said he believes voters deserve a choice in the election.

“The Logan County Board of Elections must adhere to the law; the law does not give the right for the Logan County Board of Elections to determine what the definition of full-time is,” he wrote.

“I have always been a fulltime officer and know I am qualified to be a candidate for sheriff of Logan County. In my opinion, this protest hearing is a way to get rid of the competition and take away voters’ right to choose. I have always believed nothing this important comes easy and without a fight; I am willing to take this fight and challenge for the citizens of Logan County.”

He criticized the lack of change at the sheriff’s office in the past four years as the reason he believes voters need a choice in this election.

“Is being qualified requiring me to make poor budgetary decisions, continue to allow deputies of proven misconduct to continue to serve the citizens of Logan County, and being of questionable character by adding a former local police chief that was under investigation at the time?” Mr. Smalley wrote.“If those standards are needed to be qualified as a candidate for Logan County Sheriff, then I will not pursue the office.”

It is very similar to a case in Champaign County in which the election board there on Monday denied candidate Chad Burroughs an opportunity to run against Sheriff Brent Emmons.

Although Mr. Burroughs worked as an auxiliary officer with West Liberty Police Department from 2009 until July of this year and is currently an auxiliary officer with Washington Township Police Department in Logan County, he admitted he does not work a set 40-hour week and that, the board of elections said, does not qualify as full-time employment.

The decision of local election boards can be taken to the court of appeals for further review.

Here's what I have to ask myself. Is Sheriff Smith so scared about winning against Smalley that he has to have his wife file an objection? I was thinking kind thoughts about Smith until this. Now if Smalley is disqualified, I'll write someone in before I vote for Smith. Its the wife thing that gets me. What is Smith scared of?

I am glad this person was challenged on this. Apparently he don't even know the difference between part time, full time and volunteer work and he wants to run a county? This person has to be a bit egotistical to call himself a full time officer. He carries a badge and he is a full time officer...24/7...LMAO!!! What a joke! He needs to go get himself a "real" full time position in law enforcement and start out just like everyone else in the biz. Even Barney Fife knew the law a whole lot better than I bet this wanna-be does.

Smith uses the O.R.C. to back his argument and the new boy just "knows" he is qualified.

I would like to see Sheriff Smith have an opponent, but this guy isn't qualified to wash his jock strap.

Shouldn't a Sheriff have served at least some time as a deputy of the Department he is wanting to lead?

The ink isn't even dry on his Criminal Law Degree from Rhodes State. He is running on the "anybody but GOB" platform.

I have been following this and am wondering the same thing myself. The move by Sheriff Smith(and wife)has made him look a lot like the one he replaced 4 years ago....but then, Henry used to be a good leader also. Smith tutored under him for a lot of years. KEY WORDS: USED TO BE.

I don't think he's scared at all. I think he is pointing the finger at a potential law breaker. Smith is doing a fine job and should not be compared to the past imo. Standley worked under kunze, does that make him bad too? No.

Why would the "wife thing" bother you? You think women are second class citizens or something? Maybe they shouldn't have the right to vote? Becky is an intelligent, classy woman. I'm sure she was completely able to file this on her own, without Andy "having her do it for him". She filed the objection because it had to be a registered democrat to file it, and Andy is registered republican. And she is probably concerned about this county. They were probably afraid that the Smalley guy has enough rednecks in this county who would vote for him just because he is "the type of guy they would like to have a beer with" that he might get elected, no matter how unqualified he might be.

The budget of the Sheriff's Office was $5,152,000 in 2008 and is $4,129,000 this year with another cut in 2012. Seems to me it would be some trick to add people to the Employment of the county without raising taxes on the citizens.

I find it funny that someone accuses Sheriff Smith of overlooking bad behavior by a deputy, yet that person supports a candidate who will have a former drug head for his chief deputy. Barnett is not a good example if you're trying to sell the public on a decent, honest person. On the other hand, if you're wanting to give people the benefit of the doubt and a second chance, sounds like Andy deserves one, too.

So if you were running for office and the person you were running against did not meet the legal requirements to run for that office, you would not raise any objection?
