Good. Buster Morgan has had his day coming for quite awhile. Karma is a b*tch, as they say. Hopefully this can bring Jeff Gates' family closer to some peace and resolution.

HE said she said BLABLABLAh. Give it time. And yes it takes plenty of time. Buster is being charged with a couple of felonys, the passenger is being charged also. There is no screw up. Only all these bad rumors that get spread on here. Buster is in deep sh@#. It will all come out when all charges are reviewed and all tests from all parties are in. Yes they were crossing the road intoxicated and not in a cross walk. Plays a small role in the charges but is not going to keep buster or his passenger out of prison. I know it is hard to stand by but believe me buster will get his sentence.

Blah Blah is right. Buster will get his due for his crimes, but he isn't the only one at fault. The two pedestrians were drunk and walked right in front of an oncoming vehicle. Under Ohio law, pedestrians must yield to oncoming vehicles. The pedestrians didn't even see the oncoming car and walked right in front of it.

It's kind of ironic. Scott Gates has been convicted of DUI three times. How many lives has he put at risk? How many times could he have killed innocents? He was only caught driving under the influence three times which means he has done it dozens if not hundreds of times and not got caught.

Its a tragedy that he was injured and his father killed, but he doesn't deserve any sympathy when he has put so many lives at risk.

kronos wrote that all pedestrians must yield to all oncoming vehicles, I always thought it was the other way around. vehicles are suppose to yield to pedestrians. Maybe the law is a special one for where the pedestrians were walking, or because it was nite time or some other kind of thing. where can I check that out? thanks and please, don't get your panties in a bunch about this.

Ohio Revised Code 4511.48. Right of way yielded by pedestrian

(A) Every pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right of way to all vehicles, trackless trolleys, or streetcars upon the roadway.

(B) Any pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right of way to all traffic upon the roadway.

(C) Between adjacent intersections at which traffic control signals are in operation, pedestrians shall not cross at any place except in a marked crosswalk.

(D) No pedestrian shall cross a roadway intersection diagonally unless authorized by official traffic control devices; and, when authorized to cross diagonally, pedestrians shall cross only in accordance with the official traffic control devices pertaining to such crossing movements.

(E) This section does not relieve the operator of a vehicle, streetcar, or trackless trolley from exercising due care to avoid colliding with any pedestrian upon any roadway.

(F) Except as otherwise provided in this division, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.

Here's what I predict: One or both of the felonies (F3,F5) will be dropped. The 1st degree misdemeanor for involuntary manslaughter (M1) will probably hold up, but he will only serve about 90 days in county jail, if that, for that. If charged with one of the felonies, he will probably just get community control for X amount of years. Probably lose his license for awhile. Years ago some woman 'round here driving while nodding out on heroin mowed down an elderly woman in her vehicle killing her. She only got 90 days in county jail .... for a M1 of involuntary manslaughter. Plus, I think Buster is a fav with many at the jail; when he used to be a frequent flyer in there not that long ago, he was always made a trustee, and always seemed to come out of all his troubles smelling like a rose. I hope I am wrong. IMO, the Gates family needs to sue him.

Doesn't deserve any sympathy?? NYY, I would love to see you in a situation where your layed up in a hospital for weeks, and you have lost a family member, and NO ONE gives you sympathy. YOU are not perfect and neither is Scott. That does not mean he deserves this. I am sure this has been a huge awakening for him and I am sure his old ways will change. What Buster did was wrong and he needs to pay, and people like YOU need to put yourselves in this situation before you open your trap.
