2 charged after escaping car to avoid oncoming freight train --...

A Des Plaines man was charged with drunken driving after he and a passenger escaped from a car early Tuesday shortly before it was hit by a freight train in Wheeling.

What kind of an insane law is it that a passenger is required (without formal training or a breathalyzer on hand) to determine that his driver is drunk and assault the driver to prevent him from driving. Lady Di should posthumously be charged under that way of thinking. What if your asleep in the car when your "drunk" pal starts driving? The whole thing is control freak oriented. The people commiting the crime should be punished while a bystander (although has options to intervene) should not.

Well, I think you'd be able to tell if a driver was under the influence somewhere around the time THEY HIT A FREAKING TRAIN!
It's not too hard to tell when a driver is intoxicated.
I don't think the passenger would normally be prosecuted, but considering he ran from the scene with the guy, I think he deserves it.
