MSU LOSES National Accreditation for ...
Class Action Suit

Springfield, VA

#173 Apr 2, 2011
You can get a class action suit if you have 30 people. How about starting a thread asking who is willing to hit MSU with a lawsuit similar to the one brought by students against the University of Phoenix. Those students received settlements and Phoenix now has to give people total refunds if they withdraw by a certain time without penalty (longer than is average at most colleges).

It's not just the nursing students who have class action suits. Foreign students were recruited sometimes for degrees that did not exist or were on probation and they were not informed. And, it seems like there might be a class action suit over the brown boxing of MSU employees because of the maliciousness of the termination of people (even those who are being laid off due to the loss of accreditation for nursin). And, that number is way past 30.

Pardon me, I didn't read about this in the Charleston Gazette, but I remembered reading it on the front page of the Register-Herald last fall...

Listen, the State Board is NOT the same as NLN. That is what you read in the newspaper last fall.

"Too far. I graduate this year."

That sucks!!!!! Did the school tell you about this before seeing it on here? I wonder what the next plan is and how many students this has an impact on. Best of luck to you.

Students have been aware of accredidation problems for past year or so, the problem is once your in you're stuck. Credits do not transfer, and a lot of time and money has been invested. I know I was a student, luckily I graduated before it was lost. But I spent the last year wondering if I would graduate with accredidation.

What extra stress! I just cannot understand how our local school could drop the ball on their accreditdation. Especially a program such as nursing. How do things like that happen? It makes no sense. My prayers go out to the students who are stuck with an unaccredited program right now. Best wishes to you as you move on from here and start your new career.

"I heard there was an attorney that already had a bunch of students a while ago. Anyone have a name or number? If people are banding up, don't forget about other campuses other than the main one! I would get in on a class action and know a few other on my campus who would too."

Maybe you could contact this reporter. There are a couple of students named there. Maybe he knows something that could help. His phone number is listed at the end.

I've found some references to two students filing lawsuits against MSU's nursing school, a couple of years ago.

March 24, 2009
Woman claims nursing school improperly threw her out

The complaint from this resident of Poca, in Putnam County, states that she relied on certain representations made by MSU before enrolling.

Shannon L. Hambrick vs. Mountain State University, Inc.
PA - David K. Hendrickson; J - Zakaib

* The plaintiff, a resident of Nitro, is suing the defendant for placing her on academic probation from its nurse anesthesia program on Jan. 15 despite previously informing her that her grades were satisfactory. She is seeking unspecified damages, court costs attorney fees and interest. Kanawha Circuit Court Case number: 09-C-1369

Intersting. However that program is seperate from the nursing program that just lost accreditdation. Good work though. Keep it up! This just serves as another example to the dysfunction of the school.....

Yes, I realized that neither of those suits involved the baccalaureate program. I was seeking something about a possible class action suit and came across that. I'm so disgusted and disheartened in reading how dysfunctional this institution is, and just hate it for everyone involved.

Just making sure. LOL Makes me wonder now how many suits have been brought against the school. Law suits as I see it are a waste of the money these students have paid to this school over the years. How many of these issues could have been avoided?

With the number of problems and the reputation in the community, it wouldn't be hard to find an attorney that would represent a class action suit against msu. The only problem that you may have is finding one that msu hasn't hired to represent them. With the number of lawsuits they have experienced they would have used most of the large firms in charleston, beckley, etc.

You may want to look outside of that area. I am not in the nursing program but feel everyone's pain. Everyone needs to hit them and hit them hard. Make sure that you include all of the off campus and branch campuses. You should easily find the 30 students or vastly more.

Good luck!!!!

"Looks like the so called ex-employees know what they are talking about. My trust is now with the disgruntled ex- employees who were probably fired for knowing the crookedness of this school. Now they are the people who where trying to look out for our best interest. The program as of yesterday is not accredited." Nursing Student Post #171

Not just `knowing the crookedness of this school,' but terminated for speaking out, particularly to warn students that the senior administration did not have the interests of the students as their priority.

Some students at MSU have $80,000 in loans to pay back. That is the cost of a home. Students have to think of their education from a consumer perspective because it is real money they will be paying back and the value of their education and reputation of the program they completed is directly related to their value in the employment arena.

Polk runs MSU like a business. Students should think like consumers. When you sour on the product or lose faith in the performance of a product, you move on. A lot of students are better educated and all the more wiser in the next selection of a school, either to finish undergraduate or go to graduate school because of this experience.

Former faculty know the signs that a school has problems. One, is perpetual one year contracts for everyone (faculty) with zero encouragement of scholarship. Two, stay away from places where a living, current university president has a statue of himself in the foyer of the main building on campus! Three, compare catalogs from a university that are about five years apart so you can get a good idea of the turnover/attrition rate among faculty. Finally, take the time to see what the Faculty Senate does and whether it has real shared governance.

Take care. I hope the best for all of MSU's students, dedicated staff, and faculty members worried about being brownboxed.
