WILLIAMSON, W.Va.(WSAZ)-- The Mingo County man who pleaded guilty to his role in a crash that killed a passenger in his SUV has learned his jail sentence.
Thursday, a judge sentenced Joshua Miller to one year in jail with credit for time served, including home confinement. As a result Miller should be released in about six months.
The fatal crash happened along Corridor G near Borderland in October 2011. Twenty-one-year-old Adam York was killed and two other passengers were injured.
In September, a jury convicted Miller of felony reckless DUI causing death and misdemeanor DUI causing death.
But during Millerís sentencing hearing, Judge Michael Thornsbury threw out the conviction due to problems with a juror, poor evidence collecting and possible procedural error.
Last month, Miller pleaded guilty to the lesser charge of DUI causing death.
Prosecutor Michael Sparks tells WSAZ.com that everyone in the SUV at the time of the crash was intoxicated. He also said each person willingly and voluntarily got into the vehicle.

He didnt kill anyone. The crash did. Which is why he wasn't charged with murder.
