Either way, he should be charged with involuntary vehicular manslaughter. SP enforce our laws, at what they claim "a high standard" and should be held to the same standard when a wrong has been done, accident or not. I feel for everyone involved. Obviously you DO NOT feel for everyone involved if that is your comment. Put yourself in the police officer's shoes, or better yet, what if that was you driving down the road in your normal car and didn't even see this child until you had already hit him? don't you think that living with that mistake knowing what the childs family is feeling FOR THE REST OF YOUR LIFE would be punishment enough? or how about walking down the street and knowing that people are looking at you thinking "isn't that the guy who killed that kid?" It is certainly difficult to be on either side of this terrible incident, but, justice is not being served if this officer is charged with a crime when one was not committed. But I guess you have never made a mistake right?

In fact his own brother said the boy was bent over to pick up his skate board in the road. "YES" Maybe if it was you who had been in the accident ,and driving you would be in the SRJ ,because of your "attitude "on this subject along with your comments on the other forums .Sure hope you stop ,and think before you open your mouth !!!!!!!!!!

Even though I have friends who are in Law enforcement, I am not one to come to the defense of a cop. Especially from around Beckley, but I know from experience it is real easy to sit back and judge someone, and say what you would or would not do. Fact is you will never know exactly what happened; even the cop probably is still running it through his mind. And you have no idea what you would do in the same situation until you are there. So don't say you would take a chance with your own life to keep from doing something to someone. Sure you would like to think and say you would, but self survival kicks in, and you can't always overcome it. So give the cop a break. If you want to think what you would do; think about what he is going through. This is a bad thing for all involved, but place the blame where it should be. DEAR OLD MOM

In 1968 my Grandmother was struck and killed right above where the accident happened. I was 2 when this happened. I have been told bits and pieces of what happened. She had one more step to go before she was off the road but yet the driver who hit her, wouldnt stop. I have heard so many stories about this since people found out who my Grandmother was. Ive even heard it was a police chiefs wife who was drunk. Who knows. All I know is, Ive never had the chance to know my Grandmother due to this tragedy. This was never fully investigated neither. My Grandmothers glasses are still missing after all these years. They think they were caught on the fender. They found her purse not far from her. My Grandmother was going home from evening worship. So I do know how this family feels. I feel for this family. I worked with the childs Aunt and Grandfather. The State Trooper will have to live with this forever. I feel for him also. Just a sad day for all who knew everybody involved.

Why don't you people let this story rest? All parties involved have been through enough and will go through it the rest of their lives and they don't need our opinions about the situation. They have enough to deal with without any of us putting in our two cents where it doesn't belong. Instead of blowing this hot air and saying who is right and who is wrong, why don't we each take time out to say a pray for EVERYONE involved. You never know when the shoe is going to be on the other foot.

When I was young I had to be in at 10 pm. Now days kids get 4 or 5 hours sleep at night and try to go to school half asleep. Did someone say this happened at midnight? That would be the last thing I would be expecting to dart out in the road at that time of night. That said , it wouldn't surprise me if the police car was going a bit fast. Who is going to make them slow down? Bottom line is blame could be on both sides. I am sure the mother is grieving and the policemans worst nightmare. Nobody is a winner here.

I don't remember where I got this idea, but I thought there was a law, written or unwritten, I don't know, that when there was a fatality, a citation was in order, and if no one was hurt, no citations are given. Maybe policemen are exenpt. perhaps this policy only applies when they see fit. People have been given citations no matter how bad they felt.

That was the message I was trying to convey to begin with. A civilian would be charged and cited No Questions Asked!! I have had friends that were involved in a wreck, conditions were wet, car would not stop and hit another car. They were cited with failure to maintain control even though the real problem were the wet conditions. The other point I was trying to make was that we pay outrageous taxes to support the training that the officers receive to avoid these kind of situations. Because of this, they should be held to a higher standard. Only makes logical sense. In the court of law, feeling bad about something does not replace the facts.

Wow, with first hand knowledge of the investigation, I guess you simply forgot to mention that the child was "bending over in the road to pick up his toy". Not running through the street, not shooting across the intersection on his skateboard, but standing still, in the road bending over to pick something up. I never said I could do a better job. I wouldn't want that job in the first place simply because I don't think its worth the little amount of compensation a trooper is given to put his/her life on the line. I simply said that they should be held to a higher standard than the rest of the public because of the training they receive aimed at preventing these kind of situations. As for calling me a moron and stupid??? Why the name calling, I never called you anything. I never said anything about you to take it to a personal level. This is just my perception of what happened. Everyone has different minds that allow us all to evaluate situations from a different perspective. Weather my perception is right or wrong, its still my perception.
