Simple Harvey. He didn't commit any "war crimes".
Here's a bit of enlightenment. Just because some commentator on MSNBC uses the words "war crimes" doesn't make it true. They are trying to rile people like you into hating a good man and it works, because you do not take the time to reason. If we are attacked on our soil, anything we do in retaliation to protect ouselves from future attacks is legal.

Al Qaeda didn't have time to set up training camps in Iraq. But was AQ in Iraq by 2003? You bet your a&& they were.
Al Qaeda members not killed or captured in Afghanistan by Coalition forces began to enter and set up shop in Iraq (and Somolia, and Yemen, etc.)

AQ was designed and created by ObL to be a force of fundimentalist islam, not to be defined in any way shape or form by national or geographic boundaries. Today 11+ years after 9/11, that philosophy remains intact. Today all throughout the world AQ persists in small cells of varying levels of strength.
