This is exactly why District Judge (District Magistrate) system should be abandoned and go to 67 Court of Common Pleas with 24 hours per day 365 days per week coverage of law school trained and Pennsylvania Bar member judges.

This system of squire magistrates needs to be eliminated once and for all in Pennsylvania.

There is a reason that all decisions levied by a DJ are automatically considered for appeal to the Court of Common Pleas within 30 days.

The DJ system does assist with the case burden and works well for arraignments. But like the rest of our justice system there are some blatant flaws.

I have met some DJs who are more than qualified for a bench position within the Court of Common Pleas.

That is the problem, "SOME", not "ALL". At least all Judges qualify for Court of Common Pleas by 1) Law school trained, 2) Member of Bar, 3) Elected by Public.

This is not the case of ALL District Magistrates who in criminal cases are first line of review. This case truly shows the error problem of what truly is the most important stage of a criminal prosecution. I would argue this stage is more important than the trial stage for any defendant and his defense attorney.

I just heard the results of a district Magistrate's election in SV district. Two or three people were running that hadn't taken the DJ test and stated they could take it after they won the election. Talk about the reincarnation of judge Roy Bean. The lawyer that had the test won the election. This was unusual for this part of PA. I think some people were paying attention.
