Like I said... this will never go to trial.

Once the prosecutor sees the photos... it's all but over.

LOL, that is what you are basing your defense on! You are going to state jail. You should plead now and throw yourself on the mercy of the court to get probation. If you plead not guilty they will send you to prison.

Judges tend to frown on career criminals who want to "Make s scene" in court. They will offer you a very nice plea bargain to go away. You should take it and run.

I think the replacement cost of the cabinets could easily reach 20k, not saying the cabinets were worth 20k. but to have them replaced with all associated cost (labor, estimates, fixtures, permitting, materials, time, etc) could get up there quickly.

If they have estimates to back up there replacement cost, you should definitely plea out. If they dont have anything to back it up (which would be foolish on there part), then you should fight it.

You forget... the initial police report claimed the value of the cabinets was $30,000.

Then... after they found out I had photographs... it was changed to $20,000.

The report itemized the value of missing items and was very specific.

LPPD has changed their story no less than three times already... jury's don't like inconsistencies.

If that was all the evidence I had... I still might be worried with their lies... but that is just the tip of the iceberg.

No, when I get certain individuals on the stand... they will have no choice but to lie or tell the truth... either way... I will have them nailed to a cross.

I am a little surprised how ignorant you are of the process. You were charged with theft, 20,000 to 100,000. That is the designation of a third-degree felony, greater than state jail felony.

Or did they change the Value to 20k because they now have estimates to back that up? I'm no legal guru, but it seems like they will have to justify the value from a third party (or anyone could say any amount)? Then they would adjust the charges to match what they can prove.

If you had a 100k retainer, Rusty Hardin would get you some pictures and have a long list of witnesses to be grilled; otherwise, you are going to have the DA and your court-appointed attorney both trying to pressure you to take a plea.

If you fail to take a deal, they are going to threaten you with five to ten years. You are in trouble--plain and simple. Personally, I don't want you to go to prison because Elaine likes to fill your roll in your absence; she really, really sucks.

Regardless... they changed their story... and anyone can see those are not $20,000 cabinets... much less $30,000.

How many $20,000 cabinets do you think are in the houses around La Porte?

These were supposed to be in a $500 a month rent house?

A house and entire property that was for sale at $90,000?

I welcome going to trial on these charges.

In fact... I am looking forward to it.

I was very disappointed in November when the FBI told me the charges had been dropped.

Yep, that is a minimum of 2 years in Prison.

Felony of the Third Degree Theft
Theft is a felony of the third degree in Texas if the value of the property or services stolen is $20,000 or more but less than $100,000, or of the property is of a specific type, such as certain livestock valued at less than $100,000.(§ 31.03(e)(5).) Just trying to bring things to your attention so that you are aware of them. I know cabinets in both of my houses were well over 20k and one of them is a rent house worth less than 100k.
