That is a General term, to make it a crime there has to be Public Endangerment Of (Ad term here), also intent has to be proven. I doubt that the brainless twit that dumped the ashes had any intent except to empty ashes. This moron probably won't get a littering ticket.

This is the back of my parent's home. My heart is breaking right now. I can't believe someone would dump their hot ashes along a road-especially with 35mph wind gusts.
