My neighbor lives in a glass house. Come summertime, our neighborhood is filled with a public pool/karaoke bar atmosphere. Complete with outside surround sound speakers, atv's with illegal exhaust systems, and obnoxious behavior. All on less than an acre of ground. This paticular neighbor is one reason for an enforeable noise ordinance. Period. Good neighbors keep their noise to themselves.

What is Martinsburg coming to? Between Martinsburg's City Counsel, Mayor and the Representative making new laws and bills, what ever happen to for the people. I don't believe I was asked about the gun law Martinsburg tried to put though (which the Senate smacked there hands for)and now a noise control bill.
Oh I all most for got about the 64 homes on Back Creek the Commissioner approves for the 64 homes with airplane hanger for the planes, gee I wonder how much noise that is going to make, oh yes there are exempt from the niose bill, dagum how dumb of me.
Seems to me they do not want to be reelected next term.

The law sounds great on paper but what can you do when the neighbor that plays the rap music using all type 4 letter words including the "F" word sits on their pool deck and turns it down when they see the officer arrive and as soon as the officer departs the music is turned back up full blast.
I am talking about the volume being set high enough to drown out the noise of the chain saw while it is being used.
Would love any suggestions

I have been down the road ur on with the music being played. When the commissioners wrote this ordinance it left out two simple words. "plainly audio" from propery line. With this phrase it would have warranted the officers to write citations. In plain English if the officer cans hear the nuisance they can write a legitimate ticket. Enough tickets the noise maker will stop. But unfortunately our county cannot think ahead. Jefferson county has this phrase in their ordinance and have no problem. They decribe decibel noise as loud music, parties, etc which constitutes a citation. The only option is to take ur neighbor to small claims court. Thats what the commissioners said publicly.. The decibel level the officers use can only b operated by themselves and just like u said the violators turn it down for the time being. I feel for ya. Nobody should have to deal with someone else's noise especially in their own home. They only other thing u can do is to bring this problem up at the Berkeley County Commissioners public meetings Have them amend the noise ordinance to included writing an ENFORCEABLE CITATION. Otherwise u are just beating ur head up a gainst the wall. Been there done that. Would love to see the journal editors report on the number of citations written while using the decibel meters. I bet they can't name one resident that was fined for noise. The only thing u can measure is a continuous barking dog. It's funny u can get a ticket in Berkeley County for dog barking WITHOUT a decibel meter but they can't quiet ur neighbor from being a nuisance. Unbelievable!!!

I got pulled over twice today in the city of Martinsburg for listening to music with my windows down. It was just loud enough to where I could hear it over my running car and traffic. I was issued a citation for noise control and searched. I was then followed by another officer who then pulled me over a quarter mile later. He came up to my car and said " oh did you turn your radio back up?" I told him I haven't changed my volume since I was pulled over the first time while I was talking to the officer. Twenty minutes later I was issued another noise control citation. He told me I should just drive home with no music at all since even if it's not loud his microphone picks it up. Which then he could pull me over and offer me another citation. Are police allowed to tell what I can or can't do in my own vehicle? Is music really hurting people at 5 O'clock on a Sunday?

Ryan, when u go to court tell them to show u the decibel readings at the time u were pulled over. If he cant produce this reading u are in the clear....They must have a decibel meter reading. Case closed. Print off a copy of the noise ordiance online it will tell u. An officer cannot use the human ear as a tool to noise it must be read by the meter.....for a citation to be issued.
FYI, I am not against loud music I love it. But when u have to listen to inconciderate neighbors whom have no respect for others it really blows...
Good neighbor who have respect for each other keep there noise to themselves.....
