Asking tenant to reapply?I'm a new building manager. I am doing research on this subject but would like some other opinions on the matter. I am in Washington state.
I have a tenant in my building who has lived here since early '08. She was originally on a 6 month lease that lapsed into month-to-month and has been that way since. The previous manager let her move from unit-to-unit several times and didn't update any of the paperwork.(No new leases or changes in her file) She got married last year and it came to the building owners attention that not only was her husband not on the lease and they were no longer in the unit listed in the paperwork but the woman's original application was never sent to the office and checked.
She would like me to get fresh applications from both tenants so we can set them up with a new lease.
I want to make sure that everything I do is above board.
Is there anything about this situation that is legally inaccurate? Are we well within our rights to ask this of our tenants?
I just need to double check, as my boss is a nice lady but doesn't always seem to have a solid grasp of landlord/tenant law. ;)
I'm not worried about the new lease as much as I am worried about requiring a new application for the woman and her husband.
The husband makes sense, as he is a new tenant and should fill one out for sure. She had filled one out in '08, but it was never sent to the office for processing and therefore her credit was never actually checked.(The previous manager was a bit shady and let anyone with cash live in the building without proper paperwork but filled it out and put it in the file to appear as if he had.)
As a side note: The woman is not an exemplary tenant. Rent is always late and they cause a lot of strange, unnecessary drama with other tenants. They are toeing the line for eviction but that is neither here-nor-there. My main question is whether or not it is legal to ask for them to reapply BEFORE starting a new lease in this particular situation.
