TheTimesTribune.com , Corbin, KY November 10, 2008 Murderer seeks DNA testing Partin seeks new testing methods on Tremco Plant murder evidence By Carl Keith Greene / Staff Writer Knox County Circuit Court is considering a motion filed by Delmar Partin in the 15-year-old murder of a coworker seeking DNA testing of evidence. Partin, then a laboratory technician at what was the Tremco Plant in Barbourville, seeks state payment for DNA testing of hair found as evidence in the murder of Betty Carnes. Carnes’ body was found Sept. 23, 1993, in a 55-gallon barrel at the plant. She was also a technician in the laboratory with Partin. Partin filed the “pro se” motion on his own without aide of counsel. The motion claims that since Partin’s conviction in 1994 he has learned that new methods of DNA extraction can now allow accurate DNA testing on the hair. Partin asked in his Sept. 17 motion that since he could not afford an attorney he is entitled to the same protection as a defendant with funds to have the hair tested for DNA. The hair in question was said to have been found in a trash can at the home of Partin. Partin said in his motion that the hair found in the trash was the only reason he was convicted. According to reports, Carnes’ body found in the barrel was badly beaten and decapitated and an autopsy showed evidence of blunt force trauma. According to a source in the court system, the law on which Partin has based his request is for those who have been sentenced to death. Partin was not sentenced to death. He said the motion would probably be denied if Partin is relying on that. And, the source said since the hair as evidence is not newly discovered, the motion would probably also be denied. Partin can become eligible for parole in about 10 years. |

==========According to Corbin Times Tribune,Delmar Partin can become eligible for parole in 10 years. Frome the date of sentenceing. Not wanting an argument, but it came straight from the News Paper. I am not siding with anyone or anyones comments, I just looked up the facts. |

Judged: 1 You know really this has been a hard case to understand. Betty was a really liked person and so was Delmer. I'm close in the family and it made enemies to some in my family. There are still a lot of things that are not 100% but the court has to play the hand that's dealt .If he is guilty he is getting what he deserves, and if he's not that is a terrible tragedy and ever who did it is free !! |

Judged: 1 ===I totally agree with you. I didn't make my post to upset anyone, I was just curious myself, and found it in one of Corbin Times papers online, I was just telling what they said. I have no say as to what or what does not take place. But I do agree that some things are still not 100% and prolly will never be. |

I was very young when this happened. What was the evidence that Delmer done it? I have heard a lot of opinions though the years but I am curious to know the story.

Judged: 1 To make it short Delmer was supposedly seen going in tremco on a sunday ,on his day off carrying in a bag with a newspaper or book in it. Staying about 15 minutes then left. It would be very hard to do what they said in that amount of time. There was not any blood of forensics found of him at the scene. However there was one of betty carnes hairs found in a waste can at delmers house they said. Also she was decapitated gator style and delmer had just gotten back from a gator hunting trip in florida where he used a knife cut some gators heads off. the time frame was also odd. he left his mother&laws house for about 45 minutes and when he got back he sat in the floor and played with patty,s kids very calmly i might add. betty c. had had some alleged affairs with different men at tremco and also had had a fling with delmer at about the time she got killed. thats about all i can remember but i will say that it was very very bad and no woman deserved what they did to her but did they get her killer or is he walking free ?? i think that question has not been answered. |

Where the other men she allegedly had flings with questiomed? This sounds interesting. You can get the tape at Greg heltons office and watch the whole trial.

I am pretty sure that no one came forward and admitted to any affairs. Even his character witnesses backed out on him if i remember it right. I did go to the trial and did watch all of it .You should watch it yourself and make your own opinions about it.. |

Just go to "kool" Kentucky online offender lookup . On may 15 2006 he recieved a 144 month deferment, if my math is correct then he goes back up for parole in may ( depending on where he is at the time cause different prisons go up at different times "odd & even" ) of 2018 , not before or not after . Trust me I have been there. Guilty or innocent I do not know , but this I do know. |

can you tell me how you go about getting a copy of this.My wife worked there but didnt attend the trial but would like to watch it.Our minds still wonder if they got the right person that killed her. |

Yes and what is with that?? The man who killed him just as vilantly a piece of his brain was found on his four wheeler and very bloody clothes in the garbage and he gets 20 yrs and gets out. Even if Delmar did kill the woman and I am not saying he did cause they had no solid evidence except a hair that they are afraid to DNA test because it would free Delmar and prove them to be wrong..he does not deserve to be kept in prison forever unless they are going to keep each and every person who murders there. It is way past time to let Delmar free for a crime he did not commit and if he did show us the DNA evidence!! |

About the hair it did not say it was Betty C hair it said it was consistant with her hair which I take to mean blonde. His wife was a blonde. Your hair might be consistant with mine but you and me are two different people see what I mean. They also found some love letters to Betty but his wife was also named Betty so that to me did not prove anything! Only this misterous hair which I bet will just as misterously disappear before it can be tested but I hope not. Why don't they just test the hair and have done with it. |
