If you need a job and you don't mind working some strange hours, the pay is "ok" especially if your wife is working. They have so many employees that they don't really care if you are there or not, someone will fill your seat if you leave or get fired. With that said, if you enjoy working for a company that will not lay you off (because the railroad works 365 days a year) and keep you working, then it is not so bad. Some of the Branch Managers are real JERKS but they don't last long. Hey, give it a try for a few months and see what you think, can't hurt and it is nothing like any job you have (probably) ever had. ALL jobs have good and bad to them, this one is no different. Who knows, you might really enjoy it and be there for the next 10 or 15 years.

If we all work in the same department at tbe same location, who has more seniority. A) the yard cab driver who was laid off the placed OTR on-call OR B) the less senior druver who was hired later for MPV?

1) Can the laid off yard driver make a seniority move? How?
2) And can a more senior yard driver make a senoirity more into the MPV shift with or without being on that MPV shift?
Example, can a more senior yard driver take a less senior MPV or OTR drivers shift?
3) Can the laid off senior yard driver be transferred?
4) so at any new job bid, the more senior x yard driver gets the MPV shift over the less senior MOV originally hired driver.
Example, does job title in the same department or location take over hired date/seniority?
Seniority is defined as date hired and job title dyv, on-call otr or mpv.
Is the such thing as seniority by job title?
I have never seen seniirity by job title at PTI..
We are all doing the same job, DRIVING.

1. At PTI, seniority goes by your HIRE DATE, not the job you do.
2. What is MPV??
3. How do you get laid off of a yard job? I would think they either eliminate the job completely (shift, van etc.) or you have been placed on a Code 5 or asked to leave the yard. I guess you need to do some explaining in more detail here.
4. If you are laid off of a yard job, you should have gone back to over the road automatically. When and if (THAT) yard job becomes available again, since you HAD the job and were laid off, you should have first "right of refusal" (stay OTR or take that yard job again or bid on another yard job that becomes available)
5. I will also check with our drivers from Toledo that worked in Minot as contingency drivers as they know more about that branch than most other people AND they were there for almost a year.

First of all, there IS a lawsuit going and any driver (yard and road, as I understand it) is entitled to get in on the class action lawsuit. Contact Eron for more information.
Secondly, seniority is seniority and unless you have done something to get moved out of a yard job (pissed off a Train or Yard Master) and been thrown off the property, which means you can NOT drive for that railroad even on the road, then yes, someone else can bid on that job.
Thirdly, the Branch Manager in Minot was Pat who was one of the contingency drivers from Toledo when PTI took over Minot from Coach America and she is now your Regional Manager. I suggest you call her to get answers since you obviously are not either addressing these issues with your BM or not getting the correct information from your BM. Pat can help and she is not a bad lady to deal with on these matters.

Are vebal reprimand write ups suppose to have a union stewart present?
Do I have to sign a reprimand that is not fully truthful?
If I refuse to sign a reprimand, am I fired?

If you are being written up, you MAY ask your Steward to be present before you sign it. That is totally up to you.
Part of having your Steward there is to see what is written and to check the facts as management sees it, and if it is not correct, then the Steward will advise you as to whether or not you should sign it and to file a grievance based upon his/her decision.
I have no idea what the :"CBA" is...can you explain further please.

This is supposedly to reduce deer strikes. One of our drivers van was struck by a deer. PTI and DriveCam said he was in the clear but due to the fact he was going 54 mph in a 55 zone, he was considered speeding and given three days on the street.

I believe its grievance time!!!

Oh HELL YEAH it is grievance time!!!! If the driver was driving the speed limit or below and had an accident, and in this case a deer hit, had on his seat belt, was not smoking or on the cell phone talking or texting, then there is no reason he should be on the street for 3 days. Get on it or tell the driver to get a hold of your Steward and start the process,(**immediately**). By the time it is resolved, he will be back to work, but he will get the pay for the 3 days off AND (**make sure**) the suspension is erased from the permanent file because if it isn't, in the end, you get three strikes and this is strike one unless you get it off the record. Make SURE the Steward understands this and does not allow it to remain once the driver is vindicated but should be part of the grievance.

Same thing happened here. A new-hire got fired, for going the speed limit when hit by a deer at midnight. However, I've never been told a hard and fast rule that we must go five miles under the speed limit at night.

The unions are the reason so many companies have and continue to move overseas. Americans think they deserve $50 an hour for tightening a bolt. Maybe this country needs to collapse in order for greedy union workers to understand they're not worth their salaries. Look at American auto makers, making junk ass autos that fall apart. That's why people buy foreign autos because their made better and last longer.

I am the steward. Have already discussed with the union BA. Will let you know the outcome.
