everyone who owns a home has the right to self defense and to protect his /her home and family. noone should be punish for protecting one's own home.

That is what is known as the Castle Doctrine and came over with us from English Law. It predates our Constitution. Every man's home is his castle.

But in these days of no knock warrants, it is a matter of degree, rather than an absolute.
