This is the Ky3 article from when Wall's case was dismissed for those of you asking what happened, it had nothing to do with viewing the tapes--goodforyoushutit. Do you know your facts? Also, hiring Dee Wampler does not get you a free walk on murder--how about Daniel Stewart?

To GoodForYouShutIt: If she has tried a criminal case please provide proof. What was the name of the case?

As for the starting rumors---I saw her in the shirt that said "Bite Me". No rumor. And that is not sophisticated, it is in poor, poor taste.

To Lets Make a Deal: no experience does not mean less apt to put up with this town's bull crap----it means that when it comes time for her to represent the taxpayers of this county and prosecute a criminal that she has NO EXPERIENCE!!!!

Look at the ad in the paper that Karen herself put in there. It plainly states that she only has experience in family law. NOT CRIMINAL LAW! As a prosecutor she needs to have experience in all fields of the law not just family law. Also as others have posted, why would you want someone that does not even change her shirt when she goes in the public eye, and let alone the shirt say "bite me". What is she 12 years old or is she in her forties. Come on. Act you age is what I would say to her. If you can't act your age then why would we elect you as prosecutor.

We as citizens elect the prosecutor here in Douglas County the same as anywhere else. If you would pay attention , you would realize that The "BIG" discussion here is about Bates-crouch vs. Wall and their experience in Law. No different than any other election in the USA. So No we dont make our justice, We elect it!!!! Obviously, she has not enough experience to be making Douglas County's Justice. Most cases to be dealt with will be criminal and not Civil. What is her experience in Criminal Law?

either way Douglas county is screwed put a CHOMO "child molester" in office or a lady that nobody has ever heard of personally i think we all should go to the Missouri Bar and ask them for a list of new lawyers that just passed bar and start calling them to see if they would like to run for PA here as for Wall i find it funny he is "no deals " but i bet he got a deal for his porn charges if he get office Douglas county might as well paint the town with a big red target for Child Molesters cause they all talk just like the druggies and they all will move in

I don't know where you got your information, but the tapes were of a 14 year old and the one shows Roger jacking off over her head while shelay on the couch sleeping! The story about her and her bouyfriend was started by walls to tr and convince people around here he wasn't a FREAK! Her mother was NOT hiding the tapes a friend or Roger had then in her closet! Go to pacer.gov and select eighth circuit, and type in Walls, Roger and read all about it!

For his Complaint against the Defendants, Larry D. Shepherd, the Plaintiff herein, states:
Introduction
1. This is a civil action in three counts, two of which are based on the Court’s federal
question jurisdiction under 28 U.S.C.§ 1331, with pendent jurisdiction over a count under Missouri
state law. It seeks actual and punitive damages for violations of (1) the Racketeer Influenced and
Corrupt Organizations Act (“RICO”), 18 U.S.C.§ 1961 et seq.; (2) the Civil Rights Act, 42 U.S.C.
§ 1983; and the Missouri common law of malicious prosecution. It arises out of the Defendants’
attempt to control the process of law enforcement in Wright County, Missouri, and the 44th Judicial
Circuit of Missouri for their unlawful personal purposes, to protect themselves from investigation and
prosecution, and to discredit and injure the law enforcement officials who opposed them, including
Plaintiff Larry D. Shepherd, who was formerly a police officer in Mountain Grove, Missouri.

Parties, Jurisdiction and Venue
2. Plaintiff Larry D. Shepherd is an individual currently residing in the State of Louisiana,
who was formerly a resident of Missouri, a licensed police officer in the State of Missouri, and an
officer of the municipal police department of the City of Mountain Grove, Missouri, a city which is
located primarily in Wright County, Missouri, within the 44th Judicial Circuit of Missouri.
3. Defendant Tommy Gaddis (“Gaddis”) is an individual residing in Wright County, Missouri,
who from approximately April 1989 to November 2004 served as the elected Chief of the municipal
police department of the City of Mountain Grove, Missouri, in which capacity he exercised
supervisory authority over Plaintiff.
4. Defendant Roger Wall (“Wall”) is an individual residing in Douglas County, Missouri, an
attorney at law licensed to practice in the State of Missouri, and was the elected Associate Circuit
Judge of Douglas County, Missouri, within the 44th Judicial Circuit of Missouri, from 1987 until he
resigned on or about February 18, 2005.
5. Defendant Cynthia O. MacPherson (“Cynthia”) is an individual residing in Wright County,
Missouri, an attorney at law licensed to practice in the State of Missouri, and at all times referenced
herein practiced law within the 44th Judicial Circuit of Missouri as a member of the law firm known
as the MacPherson Law Center, L.L.C.
6. Defendant Jason W. MacPherson (“Jason”) is an individual residing in Wright County,
Missouri, an attorney at law licensed to practice in the State of Missouri, and at all times referenced
herein practiced law within the 44th Judicial Circuit of Missouri as a member of the law firm known
as the MacPherson Law Center, L.L.C. Jason is the son of Cynthia.

General Allegations
9. The 44th Judicial Circuit of Missouri comprises the counties of Douglas, Ozark and
Wright. Each of those counties has an elected Associate Circuit Judge. There is one elected Circuit
Judge for the entire Circuit.
10. The City of Mountain Grove, Missouri, is a city of the fourth class pursuant to Missouri
law, located primarily within Wright County, Missouri, and partially within Texas County, Missouri.
11. John G. Moody (“Moody”) is an individual residing in Wright County, Missouri, an
attorney at law licensed to practice in the State of Missouri, and at all times referenced herein was
the elected Circuit Judge of the 44th Judicial Circuit of Missouri.
12. In the late 1990s Wall obtained the placement of a juvenile girl, who had come under the
jurisdiction of the Circuit Court for the 44th Judicial Circuit, into his own home. Rumors circulated
that Wall had become involved with the girl for improper sexual purposes. The Missouri Highway
Patrol began an investigation of the matter. The local Prosecuting Attorneys within the 44th Judicial

Circuit recused themselves from that investigation. A special prosecutor appointed by Moody
brought no charges at that time.
13. Since 2002 many other disputes have arisen among the judges, prosecutors, law
enforcement officers and lawyers of the 44th Judicial Circuit, including disputes regarding Wall’s role
in the creation and administration of a Drug Court for Douglas County which obtained substantial
Federal funding. Rumors circulated that Wall and certain lawyers and law enforcement officers
friendly toward him, including Gaddis, Cynthia and Jason, were personally involved with drug usage
and drug traffickers. There were charges and countercharges of favoritism and misconduct in both
criminal and civil cases throughout the circuit.
14. In the course of the disputes within the 44th Judicial Circuit, Plaintiff was perceived as
being aligned against Wall, as were the circuit’s three elected prosecutors who served during the
period from 2002 to 2006--Larry Tyrrell (“Tyrrell”) of Wright County, Christopher Swatosh
(“Swatosh”) of Douglas County and Thomas Cline of Ozark County--and two other lawyers named
Carl Smith (“Smith”) and John Bruffett (“Bruffett”), who were former elected Prosecuting Attorneys
in Douglas County and also served as special prosecutors in various matters within the Circuit.
15. Wall’s perceived supporters in the disputes included his attorneys, Cynthia and Jason;
another lawyer named Dan Wade (“Wade”), who had represented Wall in the earlier investigation;
Gaddis; Moody; and the Associate Circuit Judge for Wright County, Lynette Veenstra (“Veenstra”).
16. Beginning on or about April 2, 2002, Gaddis, in his capacity as Chief of Police of the City
of Mountain Grove, hired or permitted an individual named John E. Wilson (“Wilson”) to serve as
a police officer for the City of Mountain Grove, although Wilson did not, at that time and through
October 2, 2002, possess the legal certification required to serve as a police officer in Missouri.

17. Between December 2002 and April 2003, Plaintiff and another Wright County police
officer named Leslie Wayne Coltrane informed Tyrrell of evidence indicating that Wilson was not a
legally certified police officer at the time Wilson was hired by the City of Mountain Grove and began
to serve as a police officer there.
18. Tyrrell recused himself from investigations of Wilson and Gaddis, and requested the
appointment of Bruffett as a special prosecuting attorney for those investigations, which was
approved by Moody as Judge of the Circuit Court.
19. On or about July 30, 2003, Bruffett, in his capacity as Special Prosecuting Attorney,
brought misdemeanor charges in the Associate Division of the Circuit Court of Wright County against
Wilson and Gaddis, arising out of the unlawful hiring and service of the non-certified police officer.
20. While Plaintiff was acting in his capacity as a police officer of the City of Mountain
Grove, Plaintiff had arrested a suspect named Joshua Wilson Howerton on a felony arrest warrant
and seized a switchblade knife from the suspect in the course of the arrest, on September 19, 2002,
and then carried out a search warrant and seized two Bell South hand-held radios from a storage unit
maintained by Howerton, on September 21, 2002.
21. After Gaddis was charged with illegally hiring Wilson, Gaddis claimed that Plaintiff had
stolen the knife and radios from Howerton, but Tyrrell declined to request appointment of a special
prosecutor and to bring state law charges against Plaintiff, believing that Gaddis’s accusations were
unfounded and constituted improper retaliation against Plaintiff because Plaintiff had accused Gaddis
of unlawfully employing a non-certified police officer.
22. Gaddis then sought to present his accusations against Plaintiff as charges of municipal
misdemeanor stealing offenses in the City of Mountain Grove. Although Tyrrell was also serving at

that time as the City Attorney (and, as such, the prosecuting attorney) of the City of Mountain Grove,
Gaddis sought to have Tyrrell discharged from those positions, resulting in Tyrrell’s resignation as
City Attorney on September 17, 2003.
23. Immediately upon Tyrrell’s resignation, the City of Mountain Grove hired Jason as its
City Attorney, and on September 19, 2003, Jason filed an information in the Municipal Court of the
City of Mountain Grove, a division of the Circuit Court for the 44th Judicial Circuit, charging Plaintiff
with two municipal offenses of misdemeanor stealing. Jason continued to prosecute Plaintiff for those
offenses until October 26, 2006, when Plaintiff was acquitted of the charges, after trial, by a jury.
24. On or about December 9, 2003, photocopies of an anonymous, hand-printed letter,
bearing a fictitious return address, were sent through the mail to various persons within the 44th
Judicial Circuit. The text of the letter was as follows:

The letter enclosed a copy of a document which appeared to be a Highway Patrol investigative report
on Wall’s involvement with the juvenile girl.
25. On January 12, 2004, Moody sent a letter and documents by the United States Mail to
the Office of Chief Disciplinary Counsel of Missouri (“OCDC”), discussing a variety of matters in the
44th Judicial Circuit. The letter requested that the OCDC “stay informed of this situation, make your
own investigation of these activities, determine who is behind them, and take appropriate action.”
It referred to various aspects of the ongoing controversy, including the allegations of sexual
misconduct and drug use against Wall, which Moody implied were unfounded; Smith’s conviction
for driving while intoxicated on a night when he got into a “violent confrontation with his girlfriend”
because Wall had “gone out with” her; Bruffett’s involvement as special prosecutor in the Wright
County misdemeanor case against Gaddis for employing a non-certified police officer, as described
in Paragraphs 17 through 19 of this Complaint; Bruffett’s involvement in controversies with Wall and
Moody over the Drug Court; a letter Bruffett had sent to Moody on September 23, 2003; the
anonymous letter of December 2003, for which Moody said he suspected Bruffett was responsible,
based in part on the supposed timing of events in a criminal case; alleged threats by Bruffett to
publicize accusations against Wall; and the statement:“I believe that Mr. Bruffett and others are

engaged in a smear campaign against Judge Wall and myself.” The letter also stated that “I have
appointed the Attorney General as special prosecutor to investigate the sending of the letter of
December 12, 2003 as a violation of Missouri’s criminal statute against harassing or intimidating a
judicial officer.” Moody had issued a purported order making that appointment of the Attorney
General as special prosecutor on December 18, 2003, although the order was never filed of record.
26. Tyrrell, Swatosh, Smith and Bruffett each filed complaints against Wall with the Missouri
Commission on Retirement, Removal and Discipline (“Judicial Commission”), on January 21, 22 and
23, 2004. The Judicial Commission’s subsequent investigation of those complaints resulted in its
filing an Information against Wall in the Supreme Court of Missouri. Wall resigned from office as
Associate Circuit Judge of Douglas County on or about February 18, 2005, during the pendency of
the Judicial Commission’s proceedings against him.
27. On November 12, 2004, Wall filed a civil defamation lawsuit, Case No. CV504-517CC
in the Circuit Court of Wright County (later transferred to the Circuit Court of Phelps County as Case
No. CV305-0300CC), through his counsel, Cynthia and Jason, against Tyrrell, Swatosh, Smith and
Bruffett. Wall, Cynthia and Jason alleged in the defamation lawsuit that from November 2003
through November 2004, Tyrrell, Swatosh, Smith and Bruffett “entered into a conspiracy to malign,
liable [sic], and slander Plaintiff Roger Wall in order to deprive him of his publicly held position of
Associate Circuit Judge of Douglas County, Missouri.” After Wall’s resignation from judicial office,
and his indictment on federal child pornography charges, as alleged in Paragraphs 26 and 33 of this
Complaint, Wall, Cynthia and Jason dismissed the defamation lawsuit on or about April 19, 2005.
28. Also on November 12, 2004, Cynthia, Jason and Wall filed affidavits and requests to the
Attorney General of Missouri under Section 106.230, R.S.Mo., seeking to remove Tyrrell and

Swatosh from their offices as Prosecuting Attorneys of Wright County and Douglas County
respectively. They listed approximately fifty purported offenses by Tyrrell and Swatosh, including
accusations that Tyrrell had illegally sought Bruffett’s appointment as special prosecuting attorney
against Gaddis, had refused to prosecute Plaintiff for stealing, and had perjured himself in a deposition
taken by Jason in the City of Mountain Grove’s criminal case against Plaintiff, in order to protect
Plaintiff because Plaintiff was a witness in the criminal case Tyrrell was prosecuting against Gaddis.
The Office of the Attorney General of Missouri eventually declined to take action to remove Tyrrell
and Swatosh from office.
29. On December 29, 2004, Cynthia and Jason also filed four purported “Probable Cause
Statements,” seeking criminal charges against Smith and Bruffett as well as Plaintiff and Swatosh,
because the two elected prosecutors had paid Smith and Bruffett out of official discretionary funds
for their service in certain cases as special prosecutors, including the Gaddis case.
30. In late 2004 and early 2005, Cynthia and Jason and their clients and allies sent multiple
complaints to the OCDC against Tyrrell and Swatosh through the United States Mail.
31. In connection with the Judicial Commission’s proceedings against Wall, Cynthia and
Jason took the depositions of Tyrrell and Bruffett on February 12, 2005, as well as deposing Swatosh
and Smith on February 19, 2005, without disclosing before the latter depositions that Wall had
already resigned or declared the intention to resign from his office as Associate Circuit Judge.
32. Since the beginning of 2005 a large-scale Federal criminal investigation of drug-related
crimes, corruption and other offenses, known as “Operation Vera Cruz,” has been in progress, and
has been known to the public, in the 44th Judicial Circuit. The name “Vera Cruz” refers to the area
of Douglas County where Wall resides.
