Former Indiana man gets 10 years for solicitation

Saturday, May 10, 2008

A federal judge Friday sentenced a former Indiana man to 10 years in prison for seeking to have sex with an underage boy through an online message board at Craigslist.org .

Brian L. Nestor, 44, received the prison term for one count of coercion and enticement of a minor to engage in illegal sexual activity. U.S. District Judge Donetta Ambrose also sentenced Nestor to 46 months for one count of possessing material depicting the sexual exploitation of a minor. The sentences will run concurrently.

"Your actions in enticing an individual to bring an adolescent into an harmful relationship is a danger to the public, and the public needs to be protected," Ambrose told Nestor, who has been incarcerated since September.

Court records show Nestor engaged in dialogue over the Internet with an undercover Greensburg police officer who posted a message which read, "Anybody into family fun? Bring your son and hang out with us."

A series of messages followed from Nestor, sent from his work computer at The Art Institute, Downtown.

"I'm just looking to get with a boy discreetly," Nestor wrote, according to an affidavit.

In addition to wanting to have sex with the man's supposed 14-year-old stepson, Nestor expressed interest in receiving child pornography, the affidavit stated.

Court records also state that Nestor boasted online about molesting a 12-year-old boy and being attracted to a 5-year-old in his neighborhood. The FBI investigated Nestor in 2005 and found more than 3,000 child pornography images that he'd tried to delete from his home computer. No charges were filed.

"If I could see into the future and see what my actions would bring to my family and my life, I wouldn't have gotten drunk ... and gotten on the computer and done the things I did," Nestor told the judge. "I've lost everything a man can lose, and I've never been sorrier for anything in my life."

Nestor will spend 10 years on supervised release and be required to register as a sex offender, Ambrose ruled.
