A Byron man was arrested after a neighbor says he killed her family's puppy. The dog's owner is in fear for her life, and the lives of her two children.
"He came back with a gun in his hand and aimed it at her and looked at me and said you had this coming and he shot her twice in the head," Toni Smission, dog owner.
Jason Allman has been accused of first beating Toni Smission's dog with a hammer and then shooting it because it was on his property.
He was charged because of his own security camera footage. It shows Allman with an automatic pistol and silencer.
Chief of Police Cannon said the man "fired 14 shots". He is charged with Felony Aggravated Cruelty to Animals and Discharging a Weapon in a Residential Area. This carries a one to 5 year jail sentence.
The ATF should investigate why this man has a silencer and is using it in a neighborhood?
The Attorney for Mt. Allmon is Mr. Michael Chidester and he said "Mr. Allmon shot a nuisance animal on his own property. It wouldn't be a crime if he'd shot a raccoon or a possum. We don't see why this animal is anything but a nuisance animal... In our view, Ms. Smisson is just as guilty of animal cruelty as Mr. Allmon is."
Hmm... It would still be a crime to discharge a firearm in the city limits and it would still be a Felony to commit Aggravated Animal Cruelty.
At least he admits Jason Allman is guilty.
Chief Cannon with the Byron City Police department has yet to turn over video tapes that Mr. Allman made of himself shooting the puppy. Mr. Woody the Peach County DA has only seen a partial copy of the video.
What is going on here? Evidence tampering?
Mr. Michael Chidester is also on the Byron City Council in Peach County Georgia.

Mr Michael Chidester is on the byron city council, but he only moved into the city of byron after he was elected to his 2nd term. I thought you had to live in byron city to be elected to byron city council? Not only does he advocate killing puppies who are wagging their tails at you, but he advocates doing it with a silencer and firing 14 shots, cause you know, not everyone is a marksman. Also According to the code of byron ga, a mayor pro tem position must be rotated. Mr michael chidester has had that position 2 terms concurrently. What's is going on up there in byron?

Why did Michael chidester issue 2 totally different statements? Trying to get his story straight? He told 13 wmaz:
In an e-mail, Allmon's attorney Michael Chidester said Allmon acted to protect his children, including his wheelchair bound son who was in the yard at the time of the incident.

then 1 day later he changed it in an answer to FOX 5 ATLANTA
Michael Chidester, a lawyer representing Allmon said, "Mr. Allmon shot a nuisance animal on his own property. It wouldn't be a crime if he'd shot a raccoon or a possum. We don't see why this animal is anything but a nuisance animal. In our view, Ms. Smisson is just as guilty of animal cruelty as Mr. Allmon is."

Puppy Killer's Court Date Set for November 5, 2007 in Peach County
Jason Allmon, was arrested after he killed a neighbor’s family puppy by shooting her 12 times with two different weapons and a silencer. He was charged with Felony Aggravated Cruelty to Animals and Discharging a Weapon in a Residential Area after his own security camera footage showed Allmon with an automatic pistol and silencer. To her horror, the owner witnessed the killing directly in front of her. The Attorney for Mr. Allmon is Mr. Michael Chidester and he said "Mr. Allmon shot a nuisance animal on his own property. It wouldn't be a crime if he'd shot a raccoon or a possum. We don't see why this animal is anything but a nuisance animal. Mr Michael Chidester is on the Byron city council and moved into the city of Byron after he was elected to his 2nd term. The trial is scheduled for November 5th in the Peach County Court House in Fort Valley, Ga.

Let's see...I have read the code and charter in Byron, and nothing in it says a mayor pro tem position is rotated. It is nominated and elected by other members of council. That rotated crap is some Sandra Walker BS. Chidester has lived in Byron sine 1997. Elected in 2000. So how is it he just moved there after being elected to second term? A question for you posters, the Smisson family. If the dog had been run over on Highway 49 on one of its MANY trips out of the yard, would you want the driver strung up? Would you be after his license? Or would you be telling Ms. Smisson she should have seen to it the dog stayed in the yard? I know the answer, and you won't admit it, but you could have the decency to be consistent in your reasoning. It's the same thing. Ms. Smisson is guilty for exposing the dog to danger by allowing its repeated escapes. Oh, yeah, Byron has a leash law, and if she won't obey it (even using a scanner to avoid police detection...yeah Toni, we know) then what kind of city councilman would SHE make?

Michael CHidester has never obeyed the leash law. He let his little dog "ricky" run all over downtown Byron. So if that is the barometer for how good a council man, i guess he doesn't make a good one either.

+1 it's unfortunate that many people believe animals have a HIGER value than human life.. animal and idol worshipers.. been around for thousands of years. I hope THAT one stays in Canada.

Yeah, the animal rescue nuts get carried away sometimes. They forget that while they like animals, the real motivation for all the public gesturing and bumper sticker campaigning is to call attention to themselves and their "unselfishness." So transparent.

So what happened to the trial? When did it become legal to shoot a person's puppy in their body seven times, remove the silencer and shoot the dog in the head when the owner came to see what the commotion was about? I am not understanding why this is not a crime with the criminal serving jail time for the horrible offensive crime he committed. PETA needs to be all over this situation, but then that would give Chidester the media attention he wants to make more money as a lawyer in the state of Georgia. Chidester is not permitted to carry a concealed weapon in the state he practices law in.

What a tangled web we weave when once we practice to decieve.

so the killer is free what a bunch of crap is because altman is related to the judge or what altman pull the dog in to is yard ad start hit,,him with a hammer continue to shoot with is what ever then took the silencer out and shoot the pup 2 times in the headin the front of all the kids real nice guy idespicable ,a heinous act human race is mostly a disgrace in memorey of zoei,,, now karma do your job!

i can,t get over this country, they called free ,yes it,s free, peoples like altman,, for all the one how are corrupted, subhumana country of very dangerous imbecile like the 2 how killed the dog from the seal in texas her name was daisi,,but the are going to jail not for enough time ,,but i hope they get hurt,,, like that they will be in pains like they did to the poor dog, brutal barbaric ,,they are such a bunch of cowerd,,all of them..killers,,and then we have those judge how think they are above god and they are such low class individuals,this country is no good of course ,they dont like to ear the truth but you are going to pay all the horrible thinks you are doing,,

and when he shoots someone in your family next how will you feel. If an unwanted dog is on your property there are legal ways of handling it(animal control for example) and animal abuse is not one of them
