After three days of trial and almost two days in deliberation, a jury returned a guilty verdict on one sex crime and wasn’t able to return a verdict on another.
Former Lea County Sheriff ’s deputy Danny Surratt was taken into custody and transported to the Lea County Detention Center after Judge Steven Bell of Roswell read the guilty verdict of criminal sexual penetration in the second degree of a child 13 to 18 years old.
The other count, criminal sexual penetration of a child under 13 years old in the first degree, was ruled as a mistrial due to jury disagreement.
“I do not want any show of emotion, no noise made, nothing,” Bell told a room full of spectators before the verdict was read.“You all have been perfectly well behaved during this trial.”
During the trial and verdict reading, the Lovington courthouse was patrolled and secured by New Mexico State Police agents.
The girls in this case are the defendant’s 11- and 18-year-old stepgrandaughters, who both testified they had been allegedly molested multiple times by their “papa.”
“The girls now have freedom,” said the 11-year-old victim as she was leaving the courthouse with her family.
Spectators were separately escorted out of the courthouse.
“I am glad after two years justice had prevailed,” said the 11-year-old’s father, Vincent Sanchez.“They have continuously blamed other people and sometimes you have to take responsibility of your actions,” said the girls’ mother, Tanya Sanchez.“I am glad the jury saw through the smoke screen.”
The 18-year-old victim said she wanted to thank everyone who had stood by her family.
“This was definitely an act of God,” she said as she hugged her younger sister.“I want to thank my little sister she is my hero.”
During the trial, the 18-yearold testified her little sister had told her on May 15, 010, that her papa had touched her in inappropriate places.
Brenda Surratt Nyberg, the defendant’s cousin, said there were no winners.“Today was for all the victims of the past and all of the wouldbe victims,” she said before leaving the courthouse.“I would like to thank the state police for all of their security and patrolling.”
Prisella Hodge, the victim’s cousin, said they would be praying for both sides.
Other spectators in the courtroom supporting the defendant declined to comment.
Judge Bell said a sentencing hearing will be scheduled within the next 30 days.
According to assistant district attorney Courtney Hewes of Alamogordo, the maximum sentence is 15 years with a $12,500 fine. She said three years are mandatory minimum.
Originally, the 60 year-old defendant was charged with one count of criminal sexual penetration of a child under the age of 13 in the first degree, one count of criminal sexual penetration of a child under the age of 13 in the second degree, one count of criminal sexual penetration of a child 13 to 18 years old in the third degree and one count of criminal sexual penetration of a child 13 to 18 years old but counts two and four on that list were dismissed by the judge during the second day of trial.
New Mexico Department of Public Safety forensic DNA analyst Jennifer Otto took the stand
Wednesday and testified DNA from the defendant and the 11 year-old girl were found on her
underwear.
Rose Surratt, the defendant’s wife and the girls’ grandmother, also took the stand the second day of trial and testified she was shocked when her granddaughter told her about the incident.
Trying to hold back tears, Rose told the court the situation has
torn her family apart said she hadn’t reported the allegations because she was confused.
The defendant took the stand Wednesday and testified he had never committed the crimes
alleged.
“No I did not. I loved my granddaughters,” he said sobbing.“I love my granddaughters ... I feel that they have been pushed into this.

Rushville man accused in sex case

A 63-year-old Rushville man was arrested last week for allegedly having sexual contact with a 13-year-old girl, the Schuyler County Sheriff’s Office said.

James R. Surratt was arrested after deputies were contacted by the Illinois Department of Children and Family Services on Thursday.

Surratt allegedly had sexual contact with the teen on different occasions over the past eight years, with one incident occurring within the last week.

Surratt was in the Schuyler County Jail on a $250,000 bond on Monday.

If these allegations are true, as I believe they are, and this young girl is now 13, she would have been 5 at the time he began molesting her.

I hope that any other family members or friends that have young girls that have been around Mr. Surratt, will talk with them and make sure they too haven't been hurt.

To the family of the victim,

I pray that you believe your daughter, granddaughter, niece, friend, or neighbor.(Whichever one of those fit your relationship with her)

She needs your love, support and strength right now more than ever. I'm praying for you all. I know how important it is to the Surratt family to be loyal to each other. I'm a Surratt too. But in situations like these, we have to do what is right, and be loyal, and protective to the little ones.

They cannot protect themselves. I know it isn't easy to go against someone you love and have loved all your life. Believe me, I really do understand that.

But the cycle must be broken, and these children must be protected and nurtured so they can begin to heal.

I don't know who the child is Tanya. I just hope her parents are as strong as you and Vincent are and are standing beside her and fighting for her.

I believe she is a family member. I can't imagine him having access to any other young girl for so long. One of the articles reported she is 13, and has alleged the abuse has gone on for around 8 yrs. That would mean she was around 5 when it started.

I'm praying for her.

I assume that his wife is supporting him considering she is the one that posted $25,000 for his bail to get him out. Unbelievable how many women do that. I would let my husband rot in prison till the day he died.

He is been charged with 21 separate counts. The young girl is receiving the full support of her parents!(Thank God!!)

This is unreal!! 21 counts! I agree SimplySue, the chain needs to be broken! I'm with you, I hope an pray, the victim/victims in this case get ALL the support they need! I will keep them an the families in my prayers.

Yes 21 counts.:'( It's all so sad and such a mess. It has to stop. That is why I'm so vocal now that I know these men have been molesting girls all these years.

And now one of Danny's daughters is married to a convicted child molester and violent criminal. So it's continuing. I just cannot get over the fact that MOST of the extended Surratt families are defending these men. I'm the one they hate and attack. I don't get it.

But, hate me or not, I'm not going to back down. I can't.

No sis, I don't know who the victim is. I've been getting what little information that I have directly from the DA's office. And of course they cannot tell me the victim's name or information because she is a minor. And I don't ask, because I do know that.

The last time I spoke with The DA that is in charge of the case, I asked her if she had given the parents my contact info as I had requested of her and she told me she had. They have chosen not to contact me, and of course I respect their privacy.

Today I did ask the person I spoke to if she could tell me if the child's parents were standing beside her and supporting her. She put me on hold, and when she returned, she assured me they were.

I was so worried about that cos you know how the Surratt family is refusing to admit these men are capable of such acts. It's sad for the victim's and their families.

I do intend on attending the trial if I am well enough and not needed to watch the boys when it happens. LeAnn will be back in college by that time. So I don't know. But whatever happens, I will be there for the verdict and sentencing.

I've also told the DA I would help her in any way she needs me to.

I can understand why your so vocal, an have been. I know about one of Dannys daughters being married to a convicted child molester and violent criminal,I heard that they live separtatly because of her having kids, and his conviction. That there is very sad! How would anyone be involved with a convicted child molester,and knowing this information, and still get married to him? With or without kids, who in their right mind would even consider this? Its almost like Dannys daughter thinks its normal. Im sure that are really gonna hate me too, when my true name is reveal, and thats okay! I feel strong about all of this, and will help you in anyway I can. I will continue to pray for all involved in both cases!

RightasRain, thank you so much for your support and honesty. You're more than likely correct in saying that once people know who you are, many will hate you.

It's not always easy doing the right thing. I know a lot of people, including my own relatives, hate me since I told on the Surratt brothers.
