It doesn't matter if she wanted it or not, she is a minor, and he is held to higher standards due to he is a Teacher, who is supposed to teach and guide our children in the right direction. Plus, due to his past job history, he knew the laws involving these types of situations. There is no excuse for it...

I agree, I was just surprised they took down a news article. People from the church or his friends were basically saying the girl is 18 now, so it was all ok. I guess, with their logic, if he raped a girl when she was 5 and it wasn't discovered until she was 18, it was all good. Sickening.

Do you folks in WV have a completely messed up court system or what? I have not read anything from a single one of you about it, even though it was in the Gallipois Paper. Here it is:

WHY would there be a need to turn everything over to a grand jury IF HE CONFESSED IN WRITING? He was already arrested, charged and CONFESSED! Now, he waives his right to a preliminary hearing; therefore, the grand jury decides if there is enough evidence to proceed? HUH? This means a man that has confessed to a crime for which he has been charged could WALK FREE if the grand jury decides there isn't enough EVIDENCE? Did I mention he CONFESSED? Is our justice system so fouled up that a person can confess to a law enforcement officer in writing pand then walk free?

That would be so messed up. I hope that he gets prosecuted to the fullest. Being a teacher and fooling aournd with a student, he needs to be prosecuted to the fullest.

No, the fact he waived his right to a preliminary hearing means that the initial court hearing to determine if there is enough information to proceed is waived. This is not uncommon in many court cases. To be honest, most prosecutors use the grand jury just to get out of prosecuting cases. While the grand jury hands down indictments, prosecutors can also prosecute without a grand jury indictment.

I'm sure his lawyer is doing his best to figure out a way to throw out the confession.

Let's hope that his lawyer doesn't succeed. He needs to be held responsible for what he did.
