He was obviously not in danger if he were able to enter his home, get a gun, go back outside and shoot the dog. Every right to protect himself is one thing, but what was he in danger of if he made it safely inside his home?

Seriously? Was the dog gonna pick the lock with its claw and come inside and attack him?

They were reported. His name is Fred Swan on Robin Lynn Drive who killed our dog.

A sad day for the dog owner, so sorry. Unfortunately, if the dog was not shot while on your property or under your control, it is unlikely Mr. Swann can be charged with anything...unless discharging a firearm within the city limits. I'd personally like to boil him in oil, but that is not the law. If there is any justice to be had in this incident, I suppose it is nice to know the type of man Mr. Swann is. Does he work at Merrill Lynch? Is he a financial advisor type? If I had an investment account or 401k or IRA at Merrill Lynch, I'd move the money elsewhere and notify the NY office that I was doing so, and why.

I was a mess and begged him to please tell me if he saw anything or had any idea what could have happened. With a SICK SICK smirk on his face he said, "yeah, I shot your dog." I don't remember what else he said to me because my first priority was to try to save Miles. Miles only made it about thirty minutes after we got to the vet. I will never forget the look of Miles and him still wagging his tail at me while he was dying. I will also never forget the smirk on Fred's face when he told me what he did. Miles did not deserve this. My three year old did not deserve to see Miles in that condition. NO ONE deserves this. Nothing will bring our Bubby back. All that I can ask is that anyone who knows anyone will make some calls. Call your local animal group, call city commisioners or the mayor. The case is still open with the APD and we're not sure how they're going to proceed with our neighbor but from what I've heard so far they can only charge him with discharging a firearm within the city limit which is only a misdemeanor. We have two small children and are scared to even walk out the door for our safety. People that do these things should be held accountable whether it's a dog or a human. It's not safe to have someone like this in our neighbor. That bullet could have very easily passed through Miles and a person or child. We need to make people aware that this is not acceptable. According to our lawyer the best thing we can do at this point is a call a city commissioner and let them know how you feel. This is far from over and we are going to be doing everything we can to make sure something like this can't happen again. If anyone has any numbers or suggestions please let us know.
I am so sorry for your loss. I know this dog was a member of your family and you deserve some justice. I would say take him to small claims court and sue him for your vet bills and for the cost of the animal. I know it won't be any consolation but maybe it will help towards the purchase of a new member. In the meantime, I would find every way possible to get his name out there saying he is an animal killer and a danger to the entire neighborhood. God bless you and your family

This story is VERY real...I've known them for over 15yrs and have met there dog which was very sweet and lovable...no animal deserves to suffer like that and he should be held accountable on some level...my mom said she saw something on the news tonight as well,didn't know if it was about miles but this should be made aware of In Ashland!!!

No,no.... I knew exactly what she means when she says merrill lynch van. This is that nut job that invested money with a coke head Merrill lynch rep and when he lost all his money he posted his disgust on his van and parked in front of the Merrill lynch office. A real determined nut job. You might just want to sell your house. Get away from that guy.

I just want to clear some things up that i've seen on the net that have been incorrectly posted. The police were called the night of the incident and as of today are still looking into the matter. The best thing to do at this point is contact a city commissioner or the mayor and voice your concern. Until then we will just have to wait and see what the APD is going to do on their end.

Two really good points have been made here.

1) Mr. Swann was in no danger once he entered his house to get a gun. In fact, the legal and proper course of action would have been to call animal control.

2) Mr. Swann's previous nutty behavior in re: the Merrill Lynch van. Perhaps someone should paint a message on a van and park it in front of Mr. Swann's property. Sweet irony.

I do hope the APD can and will file charges and Mr. Swann is required to compensate. As others have said, this will do little to ease the loss.

Doesn't the family who owned "Miles", the choc lab, have small children? Preposterous to think they'd harbor an aggressive dog.

Well, Mr. Swann is becoming quite well known here and on facebook. Hope I meet him one day so I can spit on him.

the story was told to me today, and it was very sad.. the man had a problem with the dogs.. the owners put up a tall fence.. the man still hated the dogs.. so he shot the one.. this is only one reason why i live in the country..

If you all knew anything about the law the final decision on this situation will be with the prosecuter office in the Catlettsburg Courthouse. The police did not see it happen and they have to look into this. And they have to wait on the prosecuter to tell them if he is going to do something. It is not all the way in the police hands! Hate what happen but get your information right.
