SUE, SUE, SUE, SUE, SUE, SUE, SUE, SUE..........
Do not pay any attention to the idots who work in loss prevention at Wal Mart. They have no legal authority to detain you or touch you in any shape or form. These idots are pathetic.

One of my good friends was detained by loss prevention security because they thought he was his brother who has warrants for not turning himself. my friend is 6 inches taller than his brother. they called 911 and the cops had to verify it wasnt him(after an hour and a half in handcuffs). all my friend was doing was shopping and these rental cops put an innocent man through so much. my friend has filed a complaint for the securty's lack of stupidity. at the end they never even apologized to him.

Yes, loss prevention has the authority to detain you until the police arrive.
And the courts might have the time and money to deal with actual criminals if people weren't so overly litigious in frivilous matters.

A peace officer, security agent of a mercantile establishment, merchant or merchant's employee who has probable cause for believing that goods held for sale by the merchant have been unlawfully taken by a person may take the person into custody and detain him in a reasonable manner for a reasonable length of time, on the premises of the mercantile establishment or off the premises of the mercantile establishment, if the persons enumerated in this section are in fresh pursuit, for any or all of the following purposes:
(a) To request identification;
(b) To verify such identification;
(c) To make reasonable inquiry as to whether such person has in his possession unpurchased merchandise, and to make reasonable investigation of the ownership of such merchandise;

Retail establishments do not fully understand the chance of having one of these "untrained" security members cost their establishment a lawsuit.
While attempting to detain someone if the alleged victim were to have a heart attack, stroke, or such the business could be held liable.
To me thats not worth someone stealing a CD????

Hey runnywater, why don't you keep your nose up KDMC's ass where it belongs. Your supposed to be bashing AK and singing the praises of KDMC - not providing legal counsel against WalMart!

How did they get her for shoplifting if the cashier put the merchandise in the bag? Seems like you are leaving out some details and adding some candy coating to manipulate what actually happened. Your version of the story just doesn't make sense.

Also, if the aunt passed out and hurt herself, how is that Walmart's fault? As far as her laying there for 10 minutes, my question is was she unconcious during the duration of the full 10 minutes? Was an ambulance called? Seems to me that living in a sue happy society is getting extreme. If you choose to take that route, I'm sure instead of getting a big fat check from Walmart a suggestion of paying for your merchandise to avoid all this BS would be a wise decision in the future.

All of us would pay cheaper prices for everything if all of the shop-lifters were obliterated...loss prevention does have the right to detain you...I wish more of you were detained...at least once a month I see some idiot shove something down his/her pants in full view of a stop loss person; when confronted the idiot who shoved the stuff down their pants in front of me, the stop loss person, and other shoppers says..."I didn't do nothin'"...idiot...

The woman told the cashier to check the price of Dr. Scholl's insoles. The cashier did and put them in the bag. She never rang the insoles up. How is that shoplifting when the woman told the cashier she did not want them because they were like $50.00? The cashier put them in the bag, the customer did not know. Also, along with her purchase that day, she purchased a Wii,$100.00 gift card and over $100.00 in groceries and a few other items between her and the aunt. When the woman got to the door, with her elderly aunt, loss prevention nabbed her, stole the receipts from the aunt and detained her for shoplifting!! The poor elderly aunt passed out from scared to death. The loss prevention guys had NO compassion for her. They left the poor woman lay there. She is an elder, you know with a bad hip and a bad back, how was she able to get up? Also, she hit her head, so yeah, she probably was unconscious for a minute.
You have no idea what happened. Why would someone steal a stupid pair of Dr. Scholl's insoles anyways?????

For your information i was there that day as well she was trying on clothes at the fitting room and when the girl at the fitting room took her clothing to put her into a room the insoles fell out she then proceded to put them under the WII she bought and tried on the clothing. when finished she came out and walked around in the ladies department and then she took the insoles out of the package and put them on NOW mind you this is ALL on camera for the loss prevention to use against her when she " tries " to sue. So i say bring it on SHOPLIFTER see what you can do. Oh and by the way the stupid guy she was with is a total pussy he ran when he saw the cop car pulling into the store after he came back to "TRY" to be the big man and bully our loss prevention. Hey guy we are not scared we've seen plenty of shoplifters who always threaten but never deliver. If you don't want to see lp don't come into the store and steal simple as that.
