Our founders created this, and now we must live with it. A living constitution makes sense in light of our dynamic history; in fact, a constitutional congress should probably be convened periodically to review and update out basic tenets.
The Constitution ideally is a philosophical and not a legal document; it is a travesty that nine lawyers are its guardians.
Scalia should advocate for a system of checks and balances upon the court itself, something sadly lacking constitutionally.
And if Justice Scalia were a true originalist, he should appear in the court in his white powdered wig.
Peter Gentling, you are an idiot. The Constitution is law of the land and can only be change via the Amendment process. In that regard it is a living document but it has to go through so many hoops. That's the real checks and balances. But in your messed up head, it should be changed via fiat either through the USC or congress. The Constitution is ABOVE the government. Not beneath it to be changed to suit the will of mobs. Or to be violated whenever the government "feels" it's warranted. Nor is the USC tasked with writing laws but that's exactly what's happening these days.
