St. Louis judge orders stop to city's red light camera enforcement

THEREFORE, IT IS ORDERED AND DECREED THAT RESPONDENTS' MOTIONS TO DISMISS ARE DENIED. THE COURT DECLARES THE RED LGIHT CAMERA TICKET ORDIANCE, NO. 66868, CODIFIED AT 17.07.010 ET SEQ., TO BE INVALID. PETITIONERS' PETITION FOR A PRELIMINARY AND PERMANENT INJUCTION IS HEREBY GRANTED. RESPONDENT CITY OF ST. That depends....how many more billable hours can be justified by our illustrious city attorney? He already gave the nod to the hapless lemming-like city council to continue issuing tickets and accepting money from those willing to pay fines for something other municipalities have stopped due to the Eastern District ruling! Just whose best interest is being represented here?

Arnold has suspended enforcement of the red light tickets, have they not?

No, they have stopped PROSECUTION of red light camera tickets, which they never really did to begin with. They are still issuing the tickets, mailing them to vehicle owners, still accepting payments for those willing to pay. On traffic court 1/27 they asked who wanted to plead guilty and pay their fines and sent them to the window out in the hall to pay. Others who wished to plead not guilty were lined up so they couldn't hear what was being said by the person in front of them and if they pleaded not guilty, the case was dismissed. That in my opinion, was patently dishonest and violated a judge's order. They should have made an announcement to ALL who were there for red light camera tickets, explained the situation and dismissed the ALL.

They have not even stopped prosecutions. While they may dismiss them prior to adjudication, under Missouri Law, the prosecution begins before the individual arrives to the kangaroo court. The issuance of the information signed by the prosecutor electronically that which generates the citation is the first step in prosecution. Under no standard have they ceased, and they are clearly violating the Eastern District Ruling in Brunner, if not Federal Mail Fraud and Section 1983 violations.
