PASADENA — A Superior Court judge on Monday upheld the murder charge against Ara Grigoryan, the man charged in the July 2007 hit-and-run death of Elizabeth Sandoval.
Grigoryan’s defense team had sought to reduce the murder charge before going to trial, arguing that prosecutors made certain assumptions about the incident and had overblown the 20-year-old’s prior driving infractions to infer a “wanton disregard” for human life — a key finding for murder.
But on Monday, Pasadena Superior Court Judge Dorothy Shubin let the murder charge stand, saying the prosecution’s case was strong enough to go to a jury trial.
“I’m looking at the totality of what occurred here,” she said.
Authorities arrested Grigoryan in Mexico City while en route to Spain almost two weeks after he hit Sandoval, 24, on July 10 with his mother’s Mercedes-Benz sedan as Sandoval crossed South Glendale Avenue just south of East Windsor Road at about 9:40 p.m. She died at the scene.
In the days leading up to his arrest in Mexico, authorities had engaged in a massive manhunt, publicly calling on Mercedes-Benz of North America Inc. to activate the sedan’s global positioning system unit as they tried to track down Grigoryan and the car.
The sedan was found in Van Nuys with recent body work to its front end and grill, police said.
Grigoryan has been in custody since his extradition in July 2007. He pleaded not guilty to the murder charge, felony hit-and-run and vehicular manslaughter in December.
Deputy Dist. Atty. Robert Knowles focused in the preliminary hearing on Grigoryan’s prior driving infractions and a noninjury accident to bolster the argument that, combined with an alleged speed of 60 mph, he exhibited a reckless disregard for human life and should be tried for murder.
Grigoryan’s attorneys have never disputed their client was the driver, but have argued against the murder charge as too punitive. Christopher Pfau, who took over as Grigoryan’s defense attorney in February, said his client’s previous accident was at 5 mph, and no one was injured.
And testimony during the preliminary hearing that Grigoryan received a letter from the Department of Motor Vehicles deeming him a “poor driver” couldn’t be substantiated, nor could assertions that he understood or was even present for portions of driving school that centered on the dangers of reckless driving, Pfau said.
While he acknowledged that Sandoval’s death was unfortunate, Pfau said authorities had assumed witness testimony was accurate in “guesstimating” Grigoryan’s speed, and that combined with the overblown driving record, it seemed as if prosecutors were using the threat of a murder trial to get the defense to acquiesce to a more reasonable manslaughter charge.
“My fear here is that may be the case,” Pfau said.
But Shubin denied his motion, and set a pretrial hearing for June 23 in which attorneys are expected to agree on when to start the murder trial, possibly as soon as July — nearly a year after Sandoval was killed.
The case has been mired in delays as both sides undertook a lengthy, detailed analysis of the hit-and-run scene, and to allow for Grigoryan’s new defense team to review and catch up with the file.
“It’s been going for a long time,” said Christina Granillo, Sandoval’s sister.“We have to wait. We have to be patient.”
The long wait has also had an impact on Grigoryan and his family, who were visibly upset Monday over Shubin’s ruling.
“It’s hard on him, but he’s dong well,” Pfau said outside the courtroom.
He declined to comment on Shubin’s ruling but said he was still open to a resolution that would avoid a trial, although he would not elaborate on any possible deal.
Knowles said the ruling was expected, and that convincing a jury would be much more difficult. He, too, has left open the possibility of a plea agreement.

I don't believe that multiple speeding offenses make this 'an accident.' I don't care if he is Armenian or German...he was speeding & he didn't offer assistance...I have a real life...I am simply asking a question...last I heard it was free speech, and this is a blog for conversation...please...change my mind! Don't throw threats or race...please have a discussion with me...he had been speeding and was cited on several previous occasions, and even had a prior accident...if he was sorry he wouldn't have been speeding in the first place, or if he had, why didn't he stop?...offer assistance?...why did he run?...why did he flee to Mexico?...he won't be subjected to the DP because Mexico would not have sent him back if there was a chance of the DP...anyone up for a discussion? Please...change my mind!!! I think he is guilty of pre-meditated MURDER!!!

Good thing the guy out of Pismo Beach isn't a lawyer. This country would go down in flames. First degree murder requires that you plan the murder as a prerequisite, and display reckless and wanton regard for human life. Speeding down a street and hitting someone doesn't sound like a plan and consequentially doesn't comply with all the requirements for first degree murder. I suggest you go study some case law before you open your mouth again.

Besides, the defendant is being charged with second degree murder by the court because they can't prove first degree murder.

Isn't the fact that he had prior speeding tickets be used against him regarding 'not caring'? I have seen other cases where Judges have held someone responsible even though they didn't do or mean to do something?...I remember a case that a guy who had STD's, but didn't get himself checked, got busted because although there was no STD's the Judge felt that since he was a hooker, he could spread diesaes(sp) and since he wasn't testing himself, he was putting others in jeapordy. I think the guy from Pismo may be on to something.

He may very well be onto something but the fact remains that the person in question was charged, in a court of law with second degree murder. Not first. Not caring cannot be substituted for premeditation which is a primary prerequisite for 1st degree murder.

I am actually in Montana...don't know why it says LA. I liven in Glendale 2 years ago. Is there any new news to this Ara hit & run? What is trhe latest?

Ara will face the karma he deserves. He fled the scene. No excuses for running away. The jurors will not buy excuses such as scared, afraid, panic or whatever.

He has been in Los Angeles County jail for over a year now. I am sure he suffers daily.

His next court date is August 22, 2008 in Pasadena Supreme Court, Pasadena, CA. Let's hope that the justice will be served. This coward murderer deserves to be charged second degree murder, plus civil suit from the family of the victim.

I personally do not like Armenian people due to past experience I had when I worked in Los Angeles, CA. I had visited Glendale, CA often enough. The place is not even safe for non Armenian to walk around. Too many arrogant drivers, too many crooks, too many fake wanna be Armenian women. In my opinion, Armenian people are the racist ethnic group we have in this country. They do not want to mingle with other races.

Anybody does not like my post and get angry... come to Dallas, Texas. I will show what being Texan is all about.

WTF! How was this asshole even able to get a license?

This only furthers the argument that Glendale Armos refuse to utilize common sense and common courtesy. It doesn't take a supergenius to know that you don't speed like an asshole in a residential area, run lights, flee the scene of a crimme, etc. But then again, Glendale Armos have managed to elevate the "douchebag foreigner" stereotype into an art form. Not surprising.

Ara Grigoryan, the Court of Decency and Justice finds you Guilty on all charges. You are hereby sentenced to life imprisonment in a small dark cage. Case closed. Take him away.

Even if it was an accident, the guy had already been warned numerous times. Now he got what was coming to him. It's too bad someone had to die in order for him to learn his lesson. All the Armos is Glendale think they're the sh*t with their leased benzs and bmws, and yet they still live at home with all their grandparents, parents, and cousins in a cramped apartment building. Plus, if it was an accident, then he should have stopped. Instead, he ran away to freakin' Mexico to fly back to his country. Good going there, buddy. He needs to face the consequences of his stupidity. The family of that girl is never going to see her again. So, in my opinion, Ara can rot in jail for being dumb and reckless. He deserves it.

I think he was very scared, its not an easy thing to see a body on your windshield, its not a daily average day, now about him leaving the country, yes it didnt show good faith, but that too i dont believe was his personal opinion, however, there is an innocent girl dead, and a young guy almost dead, we should all pray for both families, Liz's dad came on national t.v and said he had no grudge against armenians, I honestly dont know where race got into this, but please dont wish death on any one, I mean you siad why isnt death penalty an option for Ara, would that really make you happy, I think that Ara has and will learn his lesson for what happened that night, but no one deserves to die not Ara and Liz didn't either.

Could it not be stated that with the number of tickets Ara had in his possession (I think the number I heard was 6 or 7) that he would have learned his lesson already?
