I find it outrageous that D.A. Gerald Stout is taking it upon himself to play God here and decide whether this selfish woman should be punished, rather than letting a jury of her peers decide, as the law stipulates! Among the excuses Stout cites in his decision are as follows:

"The wishes expressed by the victim's immediate and extended family."

Well, DOH, who WOULD want their mother, wife, sister, daughter, aunt, etc., sent to prison for criminally negligent homocide?!

"The absence of intent as an element of any crime."

Uh, isn't that where the NEGLIGENCE part comes in?!

"Lynn Brol's self-imposed punishment."

OIC, so I kill my baby as a result of my selfish, self-centered, thoughtless, money-and-status-grasping greed, and then cry about it afterwards to avoid prosecution.

"The lack of deterrence if prosecution were to commence."

Sorry, I disagree here. If people knew there'd be REAL consequences for their selfish actions, we'd probably see a lot less of this kind of thing.

"The criminal justice system is ill-equiped to adequately deal with this [...]"

Yeah, our criminal justice system isn't perfect, but it's all we have! This is a REALLY lame excuse!

But finally, this next excuse is the one that someone in the press needs to examine, and I hope a reporter will check into this, because there is something here we're not being told about this Lynn Brol:

"The special circumstances of Lynn Brol's life which dictate a term of state prison if convicted of criminally negligent homocide."

WHAT SPECIAL CIRCUMSTANCES?! Has this woman been convicted of child abuse in the past, or is she on parole or probation for something that would cause this prison term? What's the real secret behind this excuse by Stout?

If it seems I'm being hard on this woman, well, I'm sorry, I just don't see how the average, caring mother could go an entire day and not think about her baby even one time! Even one thought of him would have produced that "uh oh" feeling that might have saved this baby's life! Good mothers just don't "forget" about their babies for whole days at a time.

Absolutely absurd. She only had the kid for 5 months!! HTF can you forget about your kid after only 5 months??? So now she can put this all behind her, and her and her husband can have a romantic dinner friday night, get some wine, and work on making their next child.

PS: Save your "she has to live with this for the rest of her life" nonsense. She'll forget about this whole episode in, ohh I don't know, five months maybe?

Also, I wonder how many misdemeanor marijuana possession cases the DA's office has on their docket that they'll be prosecuting to the fullest extent of the law?

I can't believe nobody cares about this! A reporter from the Democrat and Chronicle discovered what the "special circumstances of Lynn Brol's life" were: SHE HAS PREVIOUS FELONY CONVICTIONS!

Why is D.A. Gerald Stout protecting this woman?! Have you EVER heard of a D.A. refusing to file charges because the person might go to jail?! She's a selfish witch who has been convicted of drunk driving and other alcohol related offenses SEVERAL TIMES. She not only endangered her own baby's life, she endangered yours! Speak up, people, what's wrong with everyone? Why is everyone letting Stout play God? This case should go to a jury of her peers!

Agreed. This sends an awful message, especially if she has engaged in reckless, dangerous behavior in the past. To treat this as an innocent mistake is ludicrous. A mistake is forgetting a birthday or anniversary, or picking up a gallon of milk on the way home from work. A big, inexcusable mistake is forgetting to pick your kid up from daycare; this is manslaughter. Maybe this spring I'll make a mistake and forget to file my taxes. Think I'll get a pass??

From today's Rochester Democrat and Chronicle:

"According to records from the state Department of Motor Vehicles, Lynn Brol, 32, of Arcade was convicted of driving while intoxicated on April 2003 after an incident on March 21, 2002, in Cattaraugus County.

She was fined $500 and given probation.

She also had alcohol-related convictions in 2000 and 2001, and had her license revoked in 2001 and 2003. It was reinstated in 2005."

Nice. Real responsible person. I had a brother die from a drunk driver. If I didn't have much sympathy for her before, now I really don't. Obviously she didn't get help or it wouldn't have happened again and again.

When are social workers, cps, district attorneys, etc. going to realize that educated parents, in a nice home, with all the material trappings does not equal a good parent???

Stout also said "special circumstances of Lynn Brol's life" would dictate a state prison term if she was convicted of criminally negligent homicide. Stout would not elaborate Monday (what a wimp), but a person with a felony conviction would face mandatory prison time if convicted of criminally negligent homicide.

How was she not negligent???

my heart breaks over this storybut I try to look at this from a different point of view. Not all mothers have that natural instink. Maybe she really did forget, she was so used to dropping him off that it sliped her mind. It is a very tragic heart breaking event. All of you that are condeming her...I am sure you are all perfect! I am not saying this is a normal everyday mistake, it had the most sever consiquence. This mother must be torn apart, she will live every day knowing that it was her carelessness that caused her babies death. I don't think she did it on purpose, and she shouldn't be harrasses for her mistake.

I will cast the first stone as I would NEVER EVER do something as STUPID and CARELESS and ILLEGAL as this.

She belongs in prison, she's trash and of no use to society.

I'm not perfect, however I never killed one of my children, whether it be through negligence or malice. I don't think that one of the criteria for perfection is not killing your 5 month old. As far as her living every day knowing that she killed her child, I think we have sufficient evidence to deduce that her limited memory will prevent that situation. Also you should realize that we have laws that say that what she did was a crime. However, you are correct in one aspect, she certainly does have natural "in-stink" (e.g. she roasted her baby in a car for 8 hours), I wonder if she also has "out-stink."

That's the law's priorities nowadays, "screw the kids, we need the time to prosecute pot users". How ridiculous !!!

I find it very disturbing that 19 other babies have died in the same way as Brayden. I know life can get busy, but your children, especially a helpless 5 month old, should be your first priority.

It's open season on children. All you stressed out parents can kill off one or two of them burdens and get away with it. Just leave them in the car, or send them to a neighbor's pool (your own will do nicely too, but a neighbor's pool will take the spotlight off of you better), and my personal favorite, leave an open flame in your child's room. All of these are proven to work, you will walk away with no criminal charges.
