Can a deadbeat dad get reduced child support if he works under the table and can

My daughter's dad owes $5,564 in arrears (no payment since 6/10) for child support and another $2,500 for his half of medical expenses that I paid. Court was Friday and he told the judge he can't afford to pay it and has no money. The judge asked him how he supported himself. He replied that he lives with family (he lives in his sister's garage) and has "just enough" to take care of our daughter when she visits him which is every other Friday night only. He also hasn't had a NYS driver's license in over 10 years and then tells the judge he can't get a job with no license from the support. That is odd to me since they suspended his already suspended license just this past December. His original suspended license was already in place and had nothing to do with support. The judge told him he is facing incarceration and appointed him an attorney. The judge said he didn't want to incarcerate him without him being fairly represented by an attorney. Court is now 9/8/11. Now we must wait an additional 2 months for what? I am just wondering if anyone can answer these questions, they will be greatly appreciated!
1. With his appointed attorney, can he file for reduced support while he lies and says he has no job meanwhile does in fact work under the table to avoid support? I loved walking past him after court to see he has money for cigarettes.
2. If he makes small payments here and there until 9/8/11 but still owes thousands in arrears, can he still go to jail?
3. What can the appointed attorney do for him? How does it work when he really does work under the table? I am just wondering what happens to deadbeats such as these??

This situation that you are about to see only affect a small portion in this population. You have a man after 18 years of marriage and gave the ex-spouse the divorce because he wanted to move the family from a crime ridden area and relocate them to a family friendly environment. The mother decides to listen to her girlfriends and now this father is wrongfully convicted of Non Payment of Child Support;however, during the small series of videos. You will see how he was trapped in a system that will not release him. Therefore, if all men are "Deadbeats Daddies" because of Child Support then the women who collect child support like it is a constitutional right. Then these type of mothers shall be called "Sperm Trappers"? You Decide.
