I was reading away in this forum and it occurred to me that there are some important issues that have been over-looked if we ever hope to change things here. The fact we have a sheriff's office that is to lazy to respond to a call, is just the tip of the iceburg. This whole area is full of corruption and abuse of power when it comes to who the law protects and who it pursecutes. Most of us will never have to deal with Oregon county "justice", and we have a tendancy to become complacent. We adapt the common opinion that people who have problems with the judiciary have brought it on their self. I used to believe that, and it took being wrong to make me see that anyone can easily find them selves persona non grata in Oregon County courts. We have a prosecutor who prosecutes on the basis of who you are, or who you have been associated with, and has proven time after time that he will not pursue cases on the basis of personal opinion. No one should be above the law, but being placed below it is the ultimate violation of a person's rights. There is something fundamentally wrong where justice is withheld from a person, because no matter the lifestyle they choose to lead, everyone is entitled to the same protections under the law. The past deeds and/or associations of the victim are supposed to be irrevelant when a crime has been committed against him or her. Prosecutorial discretion was never meant to be used this way. Example 1: Mr. X a registered sex offender is attacked and beaten because his neighbors found out his status. Did he deserve it? Quite possibily, but even he has the right to live without the fear of harm to his person. You can argue that the victim deserved what he got. He's a monster, a sub human life form, but our societies laws are there to keep order. His attackers are just as guilty of a criminal act as he was. The court decided his punishment and whether we find it fair or unfair, as long as he was abiding by his restrictions, he is entitled to the same rights as any other citizen. Example 2: Mr X, a criminal has a relationship with Ms. Z, who has never been in trouble. Mr X's crimes are his, she is not automatically a criminal or involved in criminal activities by merely having a relationship with him. There is no law anywhere against having bad judgement in affiars of the heart, but the Oregon County judiciary tries and convicts her in "the court of personal opinion". Crimes committed against her are not prosected, despite the fact that she files complaints. Deputies are not interested in investigating her complaints, the prosecutor declines to persue charges and the matter is dropped. Then someone calls in on her or her family and that same deputy is there in her front yard in 5 minutes, the prosecutor ready to do battle on behalf of that victim. Now as you sit here reading this I ask you to think about this carefully. If there are people that reside below the law, then everything you were brought up to believe about our society and system of justice is a fallacy. We can either continue to rationalize whether a person deserves their treatment and allow this, in some cases dual victimizations, to continue or we can do something about the problem. This should be a concern to everyone, because my second example could be your sister, your daughter, your mother, or yourself. Corruption and abuse of powers has had a strangle hold on this county for years. They have their way of doing things and they are not going to change unless they are forced to. The same person being elected again and again, dispite his incompetentence, because no one else wants the job is complacency. We need someone who remembers that they are not required to like the victim, their job is to prosecute people who ignore the laws. It is time to find someone who will stand up for the victims that have been living below the law in this county.

I am sure Oregon County is not unique in these problems. At first glance it would seem that there should be an easy fix, but unfortunately there isn't. I truely believe that the public in general truely doesn't care about this issue, and 90% will continue to ignore it unless they themselves or someone they care about is faced with the flustration of dealing with it directly. There is really no reason for the prosecutors to keep on the right track if no one bothers to question what they are doing. We in Oregon County and many small counties around the country are lucky enough to live in areas where the crime rate is relatively low and violent crimes are rare. In Oregon County there were 320 criminal case filed last years according to casenet, and this year to date there have been 49 cases filed in criminal court. Most cases filed are misdomeaners (bad checks, driving violations, DWI, marijuana possession, ect). The prosecutor is hardly overworked here. But back to my origional concerns. The prosecutor can not claim, like they do in other places, that he is overwhelmed by the sheer volume of cases in his court, so we are back to his opinions again. He gets to decide what cases he will pursue, and in atleast the last 5 years that I have been monitoring him he has steadily refused most of reported cases of child abuse and child molestation. That doesn't mean it doesnt happen, it means he uses "prosectorial discretion" not to file charges against the individual allegedly responsible. I myself had a problem with this. I filed a restraining order against the man, who at the time I had beed married to for 11 years. There were COURT ORDERED investigations done by DHS, who presented evidence to the prosecutor, who then declined to prosecute. Is my child below the law? Does she not deserve the peace of mind in knowing that there are laws to protect her? Apparently not in Oregon county. The public doesn't ever know that their child's right to justice is going to be dismissed until it happens to them. While I acknowledge the fact that it is a common charge usually leveled at the male in a domestic dispute, and thankfully untrue in many cases, doesn't mean that there hasn't been a crime in all cases. That is why there are investigations done by DHS investigaters trained to look for these false claims before they ever reach the criminal level. I find his inaction in matters this serious to be a gross abuse of power. And who gave him this power? We did, we elected him, so if we don't get the protection we deserve under the law and we don't speak out, or we don't care because it was not our child we have only ourselves to blame. We can take our justice system back. VOTE HIM OUT.

I know for a fact that the prosecutor only goes by favoritism thats all it is. A child in my family was molested by another family member when taken to the sheriff's office the deputy that actually tried to help us was eddie johnson. but as he said once it goes to the prosecutor there is nothing he can do its out of his hands. What happened to this person NOTHING. he was friends with the prosecuting attorney and of course nothing happened when we even had the evidence and the child also saying they did it. and the person molesting the child was caught red handed doing it in the shower but yet nothing was done. not even a court date was set.

My point exactly, and don't expect the judge to be sympathetic either. They are all a part of the system we have here. I have been thinking that if there were enough of us that would get together and petition the attorney general we might be able to force at least an investigation into these and other cases of the prosecutor not doing his job.

That is exactly what needs to be done. The attorney general would have to be involved. I was actually told to move my son out of the county by someone in law enforcement in another county. They told me that once someone is targeted, it doesn't matter if they do anything or not, they will be accused of everything.

I am in the process of drafting a letter to the attorney general, though I need to look up facts and dates. I would like to get others that have had this happen to them to include their cases too. This would show a definite pattern of the prosecutor's unwillingness to prosecute certian crimes and people.

its doesn't matter who you are if u hang out or just be nice an give the wrong person a ride to town home ect an someone sees u that means u are either screwing them or doing what ever the person u were just trying to be nice to is doing my point is unless your last name hasn't never been introuble meening from your family in the past then your ok but if not u are in trouble @ birth.. all b/c of how are system works..

If I caught him "red-handed" the cops wouldn't be called. There are plenty of holes that need filled in. A shovel and 50 pounds of lime will take care of it. And if that makes me a criminal, so be it, I can live with that. There are legal crimes and there are moral crimes, only God will judge some cases.

We all felt the same way and he would have been dead the day he pulled in my families driveway to drop off a dog my dad was on his way out the door with the gun and I told my dad I said I know what he did is wrong and I know what he deserves but should you spend the rest of your life in prison for killing him? funny thing is right after all this happened he took off to springfield. Another incident that happened with us is that a friend of ours had a car that he had towed in and it was legally his the people never came to pick it up and after 30 days the vehicle is yours. well he fixed the car and titled it in his name called the bank that had the lien against it which was out of CA and told them he had the car and gave them the tow and storage bill. also he reported it stolen to the cops as soon as it came up missing. come to find out the bank had someone come and repo the car and the prosecuting attorney would do nothing about it. but yet this bank still owes him money for the repairs he did to the car plus the tow and storage bill which is way more than what that car was worth but still bottom line fred o'neil should have done something about it.

You say he took off to Springfield which is good for his victim here, but what about people that don't know? The only sure way is to prosecute him and then he is forced to register. That or he becomes deceased. Since our prosecutor doesn't believe child molesters should be prosecuted he is free to continue his sick games with no one the wiser until he gets caught again. I find this unacceptable, but again unless people stand up and declare they are not going to tolerate the failure of the prosecutor we are doomed to living below the law.

Consider the 2 judges who were taking kickbacks for sending kids to a juvinille facility for such things as writing notes, the entire system can longer be trusted!!! I say the 50lbs of lime sounds like a great method especially in such a case!!!

Now, has it really dawned on anyone after reading this, that the forefathers had a reason for the second amendment??? So, a person gets sent up for five years for molesting an innocent child! Approximately one half of their sentence will be served and then a bleeding heart parole board puts him back on the streets again to ruin another innocent child. The liberal attitude of some of these idiots who sit at parole hearings amazes me. There's one thing for sure: Had it been the child or grandchild of one of the idiots that sits on the parole board, I am absolutely sure that their attitude toward these low life scumbags would change. By the way, I wouldn't vote for Fred O'Neil for dog catcher. I don't recall that Fred was opposed in the last election.

No! To the best of my recollection, Fred ran unopposed in the last election. Oregon County has always been in great support of Democratic candidates. So, even if a good Republican prosecutor ran for the position, he'd be defeated because of the narrow minded attitude of the general populace.
