Jena 6 Mychal Bell Claims Beating was Victim's Fault
Attorneys for Mychal Bell and his mother, Melissa Bell, say, according to a recent court filing, that the Dec. 4, 2006, attack on Justin Barker was his own fault. According to a response filed Feb. 29 to the civil lawsuit the Barkers brought in November, the Bells and their attorneys contend that on the morning of the attack, a passenger in Barker's pickup truck pointed and pumped a shotgun at Mychal Bell.
They also claim that during lunch that day, Barker insulted Bell with racial epithets, a tomato was thrown at Bell's lunch table from Barker's lunch table, and then -- just before Bell hit Barker -- Barker insulted him by cursing at him.
Henry Lemoine Jr., attorney for the Barkers in their lawsuit against the "Jena Six" defendants, their parents and the LaSalle Parish School Board, said claims of events leading up to the attack on Justin Barker aren't founded on any kind of fact.

This is a program of intervention for families faced with crises that could continue for six months.” During all of that, the students had to undergo evaluations from licensed professionals to determine that they were not a threat to any person. “Ultimately, after completing and passing all of the required provisions, they were permitted back into the general population of the school,” Breithaupt said.“To say that these students were simply ‘slapped on the wrist’ is a grave misconception of what punishment actually took place.” Breithaupt said that the three students had no history of behavioral problems at school or away from school, which was a central ingredient in determining whether or not they were expelled." an event that occurred at the LaSalle Parish Fairbarn. “The facility was rented by a woman who was throwing a party for her daughter,” Arbogast said.“During the course of that party that night, where both blacks and whites attended, Robert Bailey, Jr. and some other friends came to the party seeking a mutual friend inside the party.” Walters said that according to the statement given by Robert Bailey, Jr., he was asked to leave by the person who was giving the party. “My understanding of the case is that the mother was going back inside to get the friend and the defendant (Justin Sloan) comes out and hits him (Bailey),” Walters said.“A scuffle ensues and then Mr. Bailey leaves. All of this took place outside of the fairbarn.” The DA noted that this was not a fight because Robert Bailey did not swing at Sloan or fight back. “He did not do anything,” Walters said.“Robert Bailey, Jr. was the victim of this incident. He was hit by the defendant’s fist, knocked down, some type of scuffle occurred, then Mr. Bailey left.” The police and DA noted that contrary to reports since the incident that a beer bottle was used in the attack of Bailey, Bailey’s own statement written after the incident said that he was hit only with the fist of Sloan. “There was no statement given by the victim at that time that any weapon was used in the attack,” Walters said.“There is nothing in his statement that says ‘he hit me with a beer bottle.’ He did not go to the hospital for stitches and there is no medical evidence other than this was a simple battery.” Walters said that Sloan was arrested for simple battery, prosecuted for simple battery, pled guilty to simple battery, and was sentenced for simple battery. “As part of his sentence, he was made to apologize to Robert Bailey in open court,” Walters said.“In sumassion, it started as a simple battery, the evidence supported a simple battery, and it was prosecuted as a simple battery. It was only after the fact, after the ‘Jena Six’ began to receive national attention that I heard that a beer bottle was involved and stitches were involved. So, I checked with the local hospital and there was no medical evidence to support the accusation.” Now maybe you can understand half the comments. |

in essence: BEAT UP A WHITE MAN AND HAVE A LAWSUIT You get FAME Ron Paul- I agree with you 100%. If all of this happened and the blacks were the ones that got beat, it would be a hate crime. Ever since Jena 6, you seee so much more of 'hate crimes' one thing that bothered me about the 'whites only table' at the school, was that it more than likely the same thing at my old high school. you sit at certain tables and only your friends sit at that table. i am sure that they were not assigned tables. I am going to be honest and say that i hate Black History Month. Every day on TV, at least 5 times a day, you hear something about MLK or Jesse Jackson, etc. What about the white heritage? Why dont we elaborate on that a little bit more in the month of April?? |
Well, it was actually a tree that was being touted as "whites only", but you're right, it was just an informal thing, just a place where a certain group of kids who happened to be white hung out. It was never off-limits to blacks, and the silly story about how a black kid sat under it and it made the white kids mad so they hung the nooses and then the black kids staged a "sit-in" under the tree was a total fabrication of the the media....after the Jena 6 beating of Justin Barker. The beating of Justin by the 6 actually had *nothing whatsoever* to do with the nooses. This whole thing was a big farce, and I'm glad it's starting to fade away, although when the other trials start, it's just liable to flame up again. I think many have learned their lesson, though, and it won't get stirred up as badly this time. |

Ok all I can say is wow. In this day and age, where I'm from if you say a racial epithet you get beat up, period. And I think that's how it should be; minorities have been called derogatory terms by white people for waaaaay too long and I'm glad people don't think they just have to sit and take it anymore. The time when it was okay for white people to say the N-word is gone, and thank God.
And as for organizations to help minorities further their education, those were started because they were getting treated so differently than their white peers. THAT'S why they're not considered racist. And that's why you don't see organizations like them for white kids. White people can't say white power and black people can say black power because of the horrible things white people did to black people. It's not equal now because it wasn't equal from the beginning of American history. So thank your ancestors for that. And the size of the tomatoes being thrown at Mychal Bell and his friends? If someone threw a tomato at you because of your race (or for any other reason) would you say, "Well, it was only a cherry tomato" or "It was just a diced tomato" and be okay with it?? If someone throws a tomato at me I'm not just gonna sit there and take it; any self-respecting person would do something about it. If you look at these comments or wrote one and don't think there's anything wrong with what these people said, maybe you should rethink what it means to be racist. |

LA sounds like a backwoods, stuck in the past waste of space, BTW. Most of the racially charged comments are from people that live in LA. To read about this story and then look at these comments it seems that this is a snapshot from the 60's. Did you know that a black guy is a hair away from being President of the US? Can't we get to the point where we treat everyone the same. PERIOD.

Another ignorant poster who wants to be heard but doesn't know or wants to know the facts. It wasn't even a student that was involved in the fight at the party in which you are referring to "But a black boy was beaten too, but no ones in jail for that". And YES, he was arrested and charged. Was the punishment harsh for that one incident? Maybe so but you couple that with the previous incidents involving Bell LIKE THE FACT THAT HE DISLOCATD HIS GIRLFIENDS EYE FROM HER EYE SOCKET AND BRUISED 2 OF HER RIBS and I believe that his temper was going to lead to him seriously injuring the person he was beating or him killing them in a fit of rage. These kids are not your normal kids who just happened to get into an altercation. These are thugs who intimidate and beat the fear into those who they just don't like. Also, please let the noose issue go. 5 white boys beating a black boy = hate crime. 5 black boys beating a white boy = justice for the hanging of a noose? The sooner people stop blaming everyone else for their crimes and the sooner great punishments are involked on those who commit crimes, the sooner crime will be deterred Some of you sheepeople need to educate yourselves and stop being followers. |
Sir don't put all people in La in one box as a racist. Do you think that some may use a La. "location" instead of thier own for this very reason: to make people in our state look like backwood ignorant racist who can't get in the current decade? Racism is everywhere, not just here. And yes, I live in La. and grew up going to Jena as a child. It is quite a nice small rural town. It has recieved alot of negative publicity. However, Misty Lane did make a point: these young men were/are facing criminal charges and are asked to come present at an awards show that is designed and promoted to the black community. Let us not forget that Mychal Bell plead guilty and admitted to his part of the attack. And yes, 6 on 1 is an attack. The article states that a tomato was thrown during lunch from a table where Justin Barker was sitting and racial slurs from Justin Barker, but funny this is the first time you hear of this. Not even when he plead guilty in court did this come up. Reality is, 6 kids jumped 1 kid and beat the crap out of him. Regardless of race, this is wrong and justice is deserved by the victim. Problem is, 6 black boys were arrested, and I do agree that the charge was over what it should have been, and media got involved. I believe this was because Mychal was kept in jail. What they didn't tell you in the national news, was the he was already on probation for a previous battery charge from earlier in the year. Before you judge us in this state, read EVERYTHING, not just the ones pointed out to you. Read, not watch what is said on TV. |
